About approval of the Technical regulation "Requirements to Safety of Fruits, Vegetables, Root Crops and Products of Their Conversion"

According to the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of Fruits, Vegetables, Root Crops and Products of Their Conversion".

2. This resolution becomes effective after six months from the date of the first official publication.

Technical regulation "Requirements to Safety of Fruits, Vegetables, Root Crops and Products of Their Conversion"

1. General provisions

1. This Technical regulation "Requirements to Safety of Fruits, Vegetables, Root Crops and Products of Their Conversion" (further the Technical regulation) is developed according to the laws of the Republic of Kazakhstan of December 4, 2002 "About sanitary and epidemiologic wellbeing of the population", of November 9, 2004 "About technical regulation" and of July 21, 2007 "About safety of food products" establishing requirements to safety of fruits, vegetables, products of their conversion and processes of lifecycle.

2. This technical regulation extends to the made and imported fruits, vegetables, root crops and products of their conversion (further - fruit and vegetable products) according to the Commodity nomenclature of foreign economic activity of the Republic of Kazakhstan (the Commodity Nomenclature of Foreign Economic Activity of RK) according to appendix of 1 present of the Technical regulation.

Requirements of the Technical regulation extend to products of conversion of fruit, vegetables, mushrooms relating to the following groups commonly accepted in the fruit and vegetable industry:

fruit (vegetable, mushroom) semifinished products;

cooled fruit (vegetable, mushroom) products;

fast-frozen fruit (vegetables, mushrooms);

fermented vegetables;

salty vegetable (mushroom) products;

soaked fruit products;

dried fruit (vegetables, mushrooms);

dried nuts (seeds, beans);

fruit (vegetable) candied fruits.

3. To the most probable critical factors in case of which there are dangerous impacts of fruits, vegetables, root crops and products of their conversion on life, health of the person, consumer interests and environmental protection in the territory of the Republic of Kazakhstan and consequently, and need of establishment of requirements from the state bodies controlling sanitary, phytosanitary and hygiene standards and requirements belong:

- development (creation) of products;

- production and conversion of products;

- expiration date, storage and transportation;

- sales of products;

- withdrawal, utilization and destruction.

4. This Technical regulation does not include the requirement, to products of baby food, juice and juice products, alcoholic beverages, and also to nutritional supplements, canned food, the preserved food produced from fruits and vegetables. This Technical regulation also does not include requirements to fodder, technical products and the medical supplies produced from fruits, vegetables, wild-growing fruits, berries, grassy plants and genetically modified objects.

5. It is excluded

1-1. Dangerous factors (risks)

5-1. Treat dangerous factors (risks) arising in the course of lifecycle of fruits, vegetables, root crops and products from them which are minimized for safety of the person, the environment: content of fertilizers, toxic elements, mycotoxins, pesticides, radionuclides, nitrites and nitrates, mechanical, microbiological pollution of fruit and vegetable and other raw materials, technological means, nutritional supplements, finished goods.

5-2. Probable risks arise in case of the following stages (processes) of product lifecycle:

1) development (creation) of fruit and vegetable products;

2) to preparation for production, stays on storage, production facilities, in case of contact with machines, the equipment, materials;

3) to acceptance and preparation of fruit and vegetable and other raw materials, including nutritional supplements and ingredients to production of fruit and vegetable products;

4) production (production) of fruits, vegetables, root crops and products of their conversion;

5) storage, transportation, realization of fruits, vegetables, root crops and products of their conversion;

6) utilization, destruction.

5-3. One of dangerous factors (risks) is falsification of fruits, vegetables, root crops and products of their conversion. For the purposes of factual determination of falsification their testing (research) on the following indicators are carried out:

1) availability of antibiotics (preservatives) in fresh fruits, vegetables, root crops;

2) availability of nitrites and nitrates, other connections used for acceleration of maturing of water-melons, wild strawberry, cherry, etc. fruits, vegetables;

3) in the fruit and vegetable products prepared in syrup, marinade, brine, filling - the mass of the main fruit and vegetable products in lump net;

4) in tomatoprodukta - contents of fillers, thickeners (starch), artificial dyes (karmuazin, amaranth, ponso 4R, eritrozina, red 2G, "charming red AS", tartrazin, "yellow sunset", hinolinovy yellow and indigokarmina), artificial fragrances;

5) in fruit and vegetable jellies - contents of fillers, thickeners (starch), artificial dyes, artificial fragrances;

6) in products of conversion of fruits and vegetables - contents of carotinoids (alpha betaa gamma karotinov, lyuteina, lycopene, zeaksantin, neyrosporin, beta kriptoksantina, fitoyena, fitoflyuena, violaksantina, neoksantina, biksina and norbiksina);

7) in products of conversion of fruits and vegetables - ochratoxin A contents;

8) in products of conversion of fruit and vegetables - contents of synthetic sweeteners (saccharin, aspartame, atsesulfam To, tsiklamata);

9) in products of conversion of fruit and vegetables - contents of genetically modified objects;

10) to other indicators established according to the legislation of the Republic of Kazakhstan on safety of food products.

1-2. Identification of fruits, vegetables, root crops and products of their conversion

5-4. Identification of fruit and vegetable products is made by survey of marking and appearance, carrying out testing of samples with appearance assessment on section, smell, taste and consistence. Test methods and control shall correspond to the regulating documents existing in the territory of the Republic of Kazakhstan.

5-5. Identification of fruits, vegetables, root crops and products of their conversion is carried out for the purpose of:

1) references of fruits, vegetables, root crops and products of their conversion to scope of this Technical regulation;

2) establishments of compliance of fruits, vegetables, root crops and products of their conversion, including their names and identification indicators, to requirements of this Technical regulation, regulating documents for standardization;

3) establishments of compliance of fruits, vegetables, root crops and products of their conversion to the data containing in information for consumers, the declaration of conformity or the certificate of conformity provided by the manufacturer or the seller.

5-6. Identification of fruits, vegetables, root crops and products of their conversion is carried out in case of assessment and confirmation of conformity of fruits, vegetables, root crops and products of their conversion to requirements of this Technical regulation, regulating documents for standardization and also if information on fruits, vegetables, root crops and products of their conversion contains its incomplete description.

5-7. Bodies for confirmation of conformity and test laboratories (centers) carry out identification of fruits, vegetables, root crops and products of their conversion when holding procedure of confirmation of conformity.
