State Parties of the Combining GUAM - The Azerbaijan Republic, Georgia, the Republic of Moldova and Ukraine which further are referred to as "Party"
being guided by the conventional principles and rules of international law relating to peacekeeping, safety, development good-neighbourhood and friendship between the states, in particular provisions of Articles of organization of the United Nations, the Helsinki Final Act, the Parisian Charter for New Europe and the Charter of the European safety of Organization for Security and Cooperation in Europe
confirming commitment to the purposes and cooperative principles determined in the Yalta Charter of GUUAM of June 7, 2001 and other fundamental documents accepted within Consolidation
for the purpose of implementation of provisions of the Chisinau declaration "For Democracy, Stability and Development" of April 22, 2005,
confirming commitment to democratic standards and values, and also aspiration to continue movement on the way of the European integration,
expressing deep concern in connection with the continuing not settled conflicts and the increasing safety hazards, including proceeding from conflict zones, especially threats of the international terrorism, aggressive separatism and extremism and the related other dangerous phenomena,
noting the increasing role in the all-European processes of regional cooperation on the basis of mutual respect of the sovereign rights of the states, and emphasizing that such cooperation promotes development of democracy for the purpose of strengthening of safety and stability, economic development, cultural and social prosperity,
expressing the aspiration to approve democratic values in all spheres of their activities and in life of society, to strictly observe human rights, to strengthen spirit of trust and tolerance, unconditional priority of supremacy of law, both in internal, and in the international cases,
based on historically developed bonds of their people,
aiming at further deepening of full cooperation,
considering that their interaction reaches qualitatively new level,
agreed to transform the Combining GUAM to the international regional organization - "The organization for democracy and to razvitiyegua", referred to as further GUAM and accepted for this purpose this Charter.
Main objectives GUAM are:
- approval of democratic values, ensuring supremacy of law and respect of human rights;
- ensuring sustainable development;
- strengthening of the international and regional security and stability;
- deepening of the European integration for creation of general space of safety, and also expansion of economic and humanitarian cooperation;
- development of social and economic, transport, energy, scientific and technical and humanitarian potential of the Parties;
- activation of political interaction and practical cooperation in the spheres which are of mutual interest.
For achievement of the above-stated purposes of the Party will develop mutually beneficial cooperation, being guided by the principles of respect of sovereignty and territorial integrity of the states, immunity of their international and acknowledged borders and non-interference to their internal affairs and other conventional principles and rules of international law.
1. The structure includes GUAM:
a) Council;
b) Secretariat.
2. Council is the main body of the organization which carries out the work at the level of heads of states (summit), Ministers of Foreign Affairs, national coordinators and permanent representatives.
3. Functions, powers and operating procedure of Council are determined by this Charter and Rules of procedure GUAM.
4. Functions and operating procedure of the Secretariat are determined by this Charter, Financial positions, Rules of procedure and Regulations on the Secretariat.
5. According to the solution of SMID working and facilitative branches on permanent or temporary basis can be created, and also be held meetings of representatives of the relevant ministries and/or departments of the Parties.
1. Council of Heads of States (CHS):
a) determines priorities and GUAM develops the main activities;
b) resolves matters of principle of its internal device and functioning, interaction with other states and the international organizations;
c) makes decisions on membership to GUAM and provision of the status of the observer or partner;
d) considers the most urgent international problems and makes relevant decisions and recommendations.
2. Council of heads of states holds the meetings, as a rule, once a year.
1. Council of Foreign Ministers (CFM):
a) provides accomplishment of the decisions and recommendations accepted by SGG;
Ь) holds consultations in the field of foreign policy on the questions which are of mutual interest;
c) GUAM for accomplishment of specific objectives creates and determines functions and operating procedure of working and facilitative branches;
d) GUAM considers and makes decisions on the current questions of activities;
e) GUAM the next year approves the budget;
f) considers the draft of the agenda of SGG;
g) considers and solves other questions provided by this Charter.
2. SMID holds the meetings, as a rule, two times a year.
1. The Council of National Coordinators (CNC) provides interaction within GUAM, preparation of meetings of SGG and SMID. National coordinators are appointed Ministers of Foreign Affairs of the Parties.
2. SNK holds the meetings, as a rule, four times a year.
1. The Council of Permanent Representatives (CPR) on permanent basis carries out work on ensuring activities GUAM, including:
a) considers the course of accomplishment of decisions of higher bodies;
b) considers and approves drafts of the agenda of meetings, decisions and other documents which will be accepted at meetings of higher bodies;
c) participates in preparation and holding meetings of higher bodies;
d) makes decisions within the powers on the questions connected with activities GUAM.
2. Permanent representatives of the Parties with permanent accreditation in case of GUAM in the location of its Secretariat are part of SPP.
1. The secretariat performs activities organizational technical supply GUAM, being guided by this Charter and decisions of Council.
2. The secretariat functions under the leadership of the Secretary general.
3. The staff of the Secretariat performs the functions as the international officials.
