About approval of the Regulations on procedure for maintaining the Unified State register of the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity

According to the Law of the Kyrgyz Republic "About bases of technical regulation in the Kyrgyz Republic" and the order of the Government of the Kyrgyz Republic of December 30, 2005 "About obligatory confirmation of conformity of products" the Government of the Kyrgyz Republic decides No. 639:

1. Approve the enclosed Regulations on procedure for maintaining the Unified State register of the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity.

2. Bring in the Regulations on rules and procedure for carrying out obligatory certification of products approved by the order of the Government of the Kyrgyz Republic of December 30, 2005 No. 639 "About obligatory confirmation of conformity of products", the following changes:

- in Item 4.6.6 the first offer to state in the following edition:

"Rules and procedure for maintaining the Unified state register of the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity are determined by the Government of the Kyrgyz Republic".

3. To the ministries, the state committees, administrative departments, other executive bodies to bring the regulatory legal acts into accord with this resolution.

4. This resolution becomes effective in three months from the date of official publication.

5. To impose control over the implementation of this resolution on department of economy, trade, tourism and entrepreneurship of Government office of the Kyrgyz Republic.

Regulations on procedure for maintaining the Unified State register of the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity

I. General provisions

1. This Provision establishes procedure for maintaining the Unified State register of the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity (further - the Unified register) and provisions of the data containing in the Unified register.

2. Maintaining the Unified register is performed by authorized body on technical regulation (further - UOTR).

3. Data on the issued certificates of conformity on products which underwent obligatory confirmation of conformity are created by accredited bodies on certifications, data on the registered declarations of conformity on products which underwent obligatory confirmation of conformity created by state body on ensuring supervision in the sphere of sanitary and epidemiologic wellbeing of the population and/or accredited bodies on certification (further - registering bodies).

II. Procedure for maintaining the Unified register

4. Maintaining the Unified register includes collection UOTROM of data on the issued certificates of conformity and the registered declarations of conformity on products which underwent obligatory confirmation of conformity transferred to it by registering bodies and entering of these data into the Unified register, their storage, systematization and updating. These data are necessary for forming of the systematized data and coordination of activities of works on confirmation of conformity in the Kyrgyz Republic.

5. Are not represented to the Unified register and data on the issued certificates of conformity and/or the registered declarations of conformity on defensive products, and also on products used for the purpose of protection of the data which are the state secret or carried to the Kyrgyz Republic protected according to the legislation are not entered.

6. The issued certificates of conformity become effective from the moment of registration in the Register of registering body.

7. Data on the issued certificates of conformity and the adopted declarations of conformity which are drawn up in single form of the Eurasian Economic Union are presented by registering bodies in UOTR in the electronic and/or paper form within 3 days after registration.

Data on the issued certificates of conformity and the adopted declarations of conformity which are drawn up in the forms approved by the order of the Government of the Kyrgyz Republic "About approval of new blank forms of the certificate of conformity and declaration of conformity" of March 25, 2010 No. 178, are presented by registering bodies in UOTR in the electronic and/or paper form monthly no later than the 5th following month under report.

8. Data on the issued certificates of conformity and/or the registered declarations of conformity are entered in the Unified register in the form of the electronic record containing:

a) name, location of the applicant or customs applicant, RCBO code (in the presence);

b) name and location of the manufacturer of products and country of source of product;

c) code of registering body according to the appropriated certificate of accreditation;

d) information on subject to certification allowing to identify it (product name, type, brand, grade, products code according to the Commodity Nomenclature of Foreign Economic Activity, production type, product quantity (for batches), unit of measure, shipping documents);

e) the name of the technical regulation or other regulatory legal act and/or the standard, on compliance to which certification of conformity was carried out;

e) information on the carried-out testing (the name of test laboratory, number and date of the test report) which are spent for the purpose of confirmation of conformity of products;

g) registration number of the issued certificate of conformity, date of their registration, effective period, the scheme of certification of conformity or declaring about compliance (in case of recognition of the foreign certificate or the declaration instead of the scheme to specify - "recognition"), accounting number of the form on which the certificate of conformity is drawn up;

h) forms of obligatory confirmation of conformity:

02 - obligatory certification;

i) date and the reason of suspension or cancellation of the issued certificate of conformity;

j) date and the reason of the renewal suspended the issued certificate of conformity and/or the registered declaration of conformity (in case of available fact);
