About approval of standard rates of cost of compensation of the losses of farm-production connected with providing agricultural holdings for nonagricultural needs
For the purpose of protection of agricultural holdings the Government of the Kyrgyz Republic decides:
1. Approve standard rates of cost of compensation of the losses of farm-production connected with providing agricultural holdings for nonagricultural needs (are applied).
2. Determine that the means received in compensation of losses of farm-production are listed by physical persons and legal entities to which the parcels of land are provided, before issue of the documents certifying the right to the parcel of land to them in the republican budget and are used on:
- development of new lands;
- melioration of the operated lands;
- increase in fertility of soils;
- accomplishment of project investigation works on development new and melioration of the operated lands, increase in their fertility.
3. Determine that the lost profit is compensated by new land users and owners former at the rate on one year: 1760 som from hectare of the irrigated ploughland, 610 som - bogharic ploughland, 350 som - haymakings, 90 som - pastures.
4. Determine that the amounts of losses of farm-production and lost profit are calculated on the actual term of alienation of the parcels of land, and by provision in unlimited use or in property for 99 and 25 years respectively.
5. To the state agency on registration of the rights to real estate under the Government of the Kyrgyz Republic in coordination with the Ministry of Finance of the Kyrgyz Republic to enter to standard rates of compensation of losses the correction factors reflecting change of costs of farm-production and the purchase prices on food wheat which developed in the domestic market.
5-1. Losses of farm-production are not compensated:
by providing the parcels of land for construction of the meliorative systems intended for irrigation and drainage of lands of agricultural purpose;
by providing the parcels of land (except for the ploughland and sites occupied with long-term plantings, cultural pastures and haymakings) under construction of pond and lake fisheries, fish nurseries, spawning and growing farms and fish rearing stations;
by providing the parcels of land under construction of individual apartment houses, schools and preschool institutions, medical institutions, objects of physical culture and sport, the sphere of culture and art;
by providing lands for objects of nature protection and historical and cultural assignment (reserves, natural, memorial, national and dendrology parks, botanical gardens, wildlife areas, except for hunting, nature sanctuaries, archaeological and historical and architectural, burials);
by providing the parcels of land under construction of agricultural objects of seed, cattle, experienced and selection, experimental farms, stock-rearing farms, pens, chabansky houses.
6. Declare invalid the resolution of Council of Ministers of the Kyrgyz SSR of March 15, 1990 No. 76 "About the cost of development of new lands and the standard rate of compensation of the losses of farm-production connected with withdrawal of agricultural holdings for nonagricultural needs".
