RESOLUTION OF THE MINISTRY OF TRANSPORT AND COMMUNICATIONS OF THE REPUBLIC OF BELARUS

of March 31, 2008 No. 40

About approval of rules of carriages of goods by railway transport public

(as amended on 13-07-2015)

In pursuance of Item 6 of the Charter of rail transport of the general use approved by the resolution of Council of Ministers of the Republic of Belarus of August 2, 1999 No. 1196, in edition of the resolution of Council of Ministers of the Republic of Belarus of September 3, 2007 No. 1134 and based on the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Approve enclosed:

Regulations of Admission of loads to transportation by railway transport public;

Rules of transportations by railway transport public of loads with the announced value;

Rules of transportations of the autotractor machinery by railway transport public;

Rules of transportations of the freezing together loads by railway transport public;

Rules of carriages of goods accompanied by conductors of consignors or consignees railway transport public;

Rules of transportations by railway transport public of loads in transport packets;

Storage precautions of loads in places public of railway stations;

Rules of sealing of cars and containers on rail transport public;

Rules of calculation of delivery dates of loads by railway transport public;

Rules of cleaning and washing of cars and containers;

Service regulations of railway tracks of uncommon use;

Rules of readdressing of loads on rail transport public;

Rules of filling of accounting card of accomplishment of the shipping request of loads by railway transport public;

Rules of creation of acts in case of carriages of goods by railway transport public;

Rules of calculations for carriages of goods by railway transport public.

2. This resolution becomes effective in two months after its official publication.

Regulations of Admission of loads to transportation by railway transport public

1. These rules regulate procedure for acceptance to carriage of goods by railway transport public in places of general and uncommon use of the railway stations open for commercial transactions.

These rules are applied to cargo reception to transportation as well in the international railway service if other is not established by the corresponding international treaties.

2. Carriages of goods can be performed by car, container, small, group and route sendings.

Car sending is considered shown to transportation according to one transport rail waybill (further - delivery note) load which transportation requires provision of the separate car.

The load shown to transportation on one superimposed which transportation requires provision of individual container is considered container sending.

The load shown to transportation on one superimposed which transportation does not require provision of the separate car is considered small sending.

The load shown to transportation on one superimposed which transportation requires provision more than one car, but less route sending is considered group sending.

The load shown to transportation on one superimposed which transportation requires provision of cars in the quantity meeting standards for routes on the weight and length is considered route sending.

Combined car sending the load of different names and line items of the nomenclature of loads shown on one superimposed to one consignee is considered.

3. The basis for cargo reception to transportation is availability of the shipping request of load with mark about its acceptance and the consent of carrier expressed by vising of the original of delivery note about loading appointment of the day.

4. To the consignor for loading of cars the carrier shall notify the consignor not later than two hours before giving with simultaneous registration of such notification in the book of notifications on time of giving of cars on the forthcoming giving for loading or unloading (further - the book of notifications).

The notification on time of giving of cars for loading is not required if loading is provided with the cars sent under unloading.

The notification procedure about time of giving of cars for loading (including when loading by means of the consignor in places public) is established by carrier. For the notification the available communicating device can be used. According to the proposal of the consignor other notification procedure can be established. For ensuring acceptance of notifications with the consignor persons, responsible for acceptance of notifications, are determined, surnames and phone numbers (faxes, telex) of which are in writing reported to carrier. For record of notifications on time of giving of cars for loading by the carrier keeps the book of notifications with indication of in it quantities and sorts of the cars, containers and other data provided by form.

The cars sent for loading with violation of submission due dates or without notice are accepted by the consignor for loading from the moment of presentation by their carrier.

At the same time cars are considered the sent and paid time of use of cars is calculated:

when giving without notice - after two hours from the moment of the actual giving of cars;

when giving of the term which is earlier established in the notification - from the moment of approach of this term;

when giving with delay to the term specified in the notification - from the moment of the actual giving of cars.

If delay exceeds two hours, then the carrier shall notify the consignor on the forthcoming giving again.

5. According to Item 38 of the Charter of rail transport of the general use approved by the resolution of Council of Ministers of the Republic of Belarus of August 2, 1999 No. 1196 (The national register of legal acts of the Republic of Belarus, 1999, No. 67, 5/1506; National legal Internet portal of the Republic of Belarus, 18.07. 2015, 5/40785), cargo loading can be temporarily stopped or limited. The carrier notifies consignors within 2 hours after receipt of the corresponding order of the Chief of the Belarusian railroad or his deputy on the termination or restriction of cargo loading. The notification is performed by the room of the announcement in division on servicing of consignors, consignees on railway station. According to the proposal of the consignor other notification procedure can be established by carrier. Consignors within 12 hours from the moment of the notification shall suspend or limit cargo loading to the established amounts.

6. Preparation of tanks and bunker gondola cars under filling is made by consignors or in the presence of opportunity carrier at the expense of consignors according to the agreements signed between them.

Suitability of cars, containers under transportation of specific load in the commercial relation (condition of cargo sections of the cars, containers suitable for transportation of specific load, absence in cars, containers of foreign smell, other adverse factors, except for effects of precipitations in open cars, and also the features of internal designs of bodies of cars, containers influencing condition of loads in case of their loading, unloading and transportation) is determined in the relation:

cars - consignors if loading is made by them, or carrier if loading is made by carrier;

containers, specialized cars - consignors.

If according to requirements of acts of the legislation, the signed contracts or agreements to deliver goods suitability of cars, containers for transportation of separate categories of loads shall make sure of the commercial relation certain document, this confirmation in all cases is provided with the consignor at own expense.

Consignors in case of acceptance of cars, and also in case of detection of materiel or commercial failure of the car which could not be revealed in case of acceptance of cars have the right to refuse cars, the containers of carrier unsuitable for transportation of specific load. The carrier shall send cars, containers, operational, suitable for transportation of such load, instead of the specified cars, containers. At the same time the cars recognized unsuitable from among the sent cars are excluded, the payment for their giving and cleaning, use is not levied. The fact of giving of unsuitable cars, containers of carrier makes sure the act of general format which is signed by representatives of carrier and the consignor.

The carrier when giving on railway track of uncommon use of loaded cars according to the procedure of dual transactions determines technical suitability of such cars for loading of specific load.

7. According to Item 39 of the Charter of rail transport public unloading from cars and cargo loading in cars are made:

carrier under contracts with consignors in the places public having necessary devices and mechanisms, except for loads, unloading which loading are optional to carrier: dangerous and perishable loads, off-gage loads. Unloading, loading of crude animal products, load which mass of one place over 0,5 of ton and which is transported in the closed car, the loads transported by filling, in embankment and in bulk, the loads transported in specialized railway vehicles, the loads transported accompanied by conductors of consignors or consignees are also optional to carrier;

consignors - in places of uncommon use, and also in places public if cargo loading is optional to carrier.

Unloading and loading of empty or loaded containers from cars on cars in places public are provided with carrier at the expense of consignors.

The carrier under contracts with consignors can assume accomplishment of handling works in places of uncommon use, and also in places public if loading and unloading of loads are optional to it.

8. When loading small breakbulk cargoes the consignor shall combine small places in larger by coordination in sheaves or packagings in the corresponding container.

The loads needing container (packaging) for their protection from loss, shortage, damage (spoil) for protection from damage, pollution of cars, containers or other loads, safety control in case of transportation, shall be shown to transportation in operational container (packaging) corresponding to technical regulatory legal acts in the field of technical regulation and standardization on container (packaging). Loads, on container (packaging) of which technical regulatory legal acts in the field of technical regulation and standardization are not established, are shown to transportation in operational container (packaging) ensuring their complete safety and safety when transporting.

Requirements to container (packaging) of loads, quality of the transported products shall be provided by technical regulatory legal acts in the field of technical regulation and standardization. Container (packaging) in which the load is shown to transportation shall prevent pollution, contamination of cars, railway tracks and the environment.

The carrier has the right to check compliance of container (packaging) of loads to the specified technical regulatory legal acts in the field of technical regulation and standardization. The consignor upon the demand of carrier shall show technical regulatory legal act in the field of technical regulation and standardization on the shipped products, and also on container (packaging) if the load is packed. Technical regulatory legal acts in the field of technical regulation and standardization on container (packaging) shown to carriage of goods are provided to carrier by the consignor before presentation of load to transportation.

If in case of visual inspection of container (packaging) shown to cargo hauling shortcomings which cause concerns of loss, shortage, damage (spoil) of load and cars for this reason are noticed, the carrier can refuse cargo reception to transportation.

The loose goods which are subject to storage in covered warehouses (including grain, compound feed, salt) sent to railway stations of assignment with unloading by carrier in places public are shown by the consignor to transportation only in the packaged type.

9. The tare and breakbulk cargoes shown to transportation by the consignor shall have transport marking irrespective of marking compliance to the requirements existing on other modes of transport. Content of transport marking, the place and method of its drawing, procedure for arrangement, the sizes of identification tags and texts shall conform to requirements of technical regulatory legal acts in the field of technical regulation and standardization on marking of loads and these rules. Transport marking consists of handling instructions, the main, additional and information texts.

10. Handling instructions - the images specifying address methods with load.

Need of drawing and types of the applied handling instructions on load are determined by technical regulatory legal acts in the field of technical regulation and standardization on products.

In the absence of technical regulatory legal acts in the field of technical regulation and standardization it is allowed to apply warning labels if it is impossible to express handling instructions address method with load.

11. The main texts applied on cargo pieces shall contain:

full or abbreviated name of the consignee;

full name of railway station of assignment and abbreviated name of the railroad;

quantity of cargo pieces in sending and sequence number of the place in sending (it is specified in fraction: in numerator - sequence number of the place in sending, in denominator - seating capacity in sending).

The quantity of cargo pieces and sequence number of the place shall be specified when are transported diverse or freight-all-kinds in the same container or homogeneous loads in container of different type or when mixing of grades in sending homogeneous loads or when transport equipment sets, or in transit with overload along the line or carriage of goods in one car small sendings is inadmissible.

12. Additional texts on cargo pieces shall bear:

full or abbreviated name of the consignor;

the name of the point of departure with indication of railway station of departure and carrier;

railway marking.

13. Railway marking is put on each cargo piece in transit of loads with small sendings in the form of fraction: numerator - sequence number according to the book of cargo reception to departure and through dash - number of places in sending; denominator - code of railway station of departure.

Railway marking is put:

the carrier - in case of acceptance to carriage of goods by small sendings in places public and along with it specified in the corresponding column of delivery note;

the consignor (before presentation of load to transportation) - in case of cargo loading by small sendings in places of uncommon use.

The carrier can establish procedure for drawing railway marking by consignors before presentation of load to transportation and in other cases.

14. Information texts shall bear:

masses gross and net cargo piece in kilograms. It is allowed to specify instead of net weight quantity of products in pieces, and also not to put weight gross and net or quantity of products in pieces if they are specified in the marking characterizing the packed products;

outline dimensions of cargo piece in centimeters (length, width and height or diameter and height). Such sizes are not specified if any of outline dimensions does not exceed 1 m in transit of load on open railway vehicles and 1,2 of m - in the closed car.

15. Transport marking (the main, additional and information texts and handling instructions) shall be applied on each cargo piece.

It is allowed to put the main, additional and information texts (except weight gross and net) at least on four cargo pieces in transit of homogeneous loads with car sendings. In this case places with marking place:

in closed cars - on two places at each door marking outside;

on open railway vehicles - in the upper tier of loading on two places at each longitudinal board of platform or gondola car marking outside. If loading is made level with boards or lower than the level of boards, places with marking shall be laid by marking up.

It is allowed not to put the main, additional and information texts (except weight gross and net) in transit loads in ordinary containers.

Features of drawing texts on the transport packets created from loads are given in rules of transportations by railway transport public of loads in the transport packets approved according to the legislation.

16. Loading, placement and fixture of loads in cars, containers shall ensure traffic security of trains, possibility of mechanization of handling works, safety of loads, cars, containers.

The freight list when which loading preparation of closed cars is performed of containers with observance of the conditions provided by the rules of transportations of dangerous goods approved in accordance with the established procedure is given in appendix 1 to these rules. The freight list, selection and preparation of cars for which shall be made according to the procedure provided for flammable solid substances, is given in appendix 2 to these rules.

Loads on which packaging there are handling instructions and warning labels shall be loaded in cars, containers with observance of requirements of these signs, texts.

Placement and fixture of loads in cars, containers are made according to rules of placement and fixture of loads, rules of transportations by railway transport public of loads in ordinary containers, the rules of transportations of separate types of loads approved according to the legislation, and also requirements of these rules.

Loading in one car, container of loads of different names is allowed on condition of observance of requirements of the corresponding rules of carriages of goods.

Loading in one car, container of such loads which on the properties can damage or spoil other loads, and also create emergency situation is forbidden.

Stacking of tare and packaging and breakbulk cargoes in interdoor space is made with departure from doors at least 25 cm.

Loads shall be laid in the car regularly, densely and if necessary are reliably fixed that there was no shift, fall, bulk on door, attrition or their damages in transit, untwistings of fixing connections, turn of the rotating parts, exit out of loading dimension limits, and also safety of the car when loading, unloading was ensured and along the line.

Cargo loading over two meters long in the closed cars going to places public is not allowed, except for the loads which are subject to unloading in places public by the consignee.

17. Carriage of timber deck cargoess, firewood and timber are performed in the packets, stacks and furrings allowing to mechanize as much as possible handling works.

Acceptance to carriage of timber deck cargoes, firewood, timber in furrings, packets, stacks is made with indication of in delivery note along with the mass of load of quantity of furrings, packets, stacks.

18. In case of presentation of loads for transportation the consignor specifies in the original of delivery note their lot and limiting error of its measurement, and in case of presentation of tare and breakbulk cargoes - also quantity of cargo pieces. Limiting value of error is specified in the corresponding column of delivery note. The limiting error of measurements is not specified in case of determination of mass of load by means of measurement, on cliche and the standard.

Determination of mass of load by means of measurement of loads or is not allowed settlement way without approval of carrier if their loading to the complete capacity of cars, containers can entail exceeding of load-carrying capacity (overload) of cars, container.

The mass of tare and breakbulk cargoes is determined before their presentation to transportation with indication of on each cargo piece of weight gross and net.

If cargo pieces of standard weight are shown, specifying of weight on each cargo piece is not obligatory, except as specified, when technical regulatory legal acts in the field of technical regulation and standardization provide obligatory specifying of weight gross and net on standard places. In this case in the original of delivery note in the corresponding column also standard mass gross and net of one cargo piece is put down. About method of determination of weight the consignor shall specify in the original of delivery note.

The load total mass in the car, container shown to transportation on one delivery note is determined by weighing or summing of the weight specified on each cargo piece according to cliche by standard weight, and also settlement way and by means of measurement. The total mass of net load in case of the method "according to the standard" is determined by multiplication of seating capacity by mass gross of one cargo piece.

The mass of the loads transported in containers in all cases is determined by the consignor.

19. Determination of mass of the loads transported by filling in tanks is made by weighing or settlement way of measurement of height of filling and scoping of juicy load by the sender on the basis of application of tables of calibration of cistern cars. The consignor shall specify also in delivery note under the name of load the filling height, temperature and density of load in the tank.

The mass of the loads transported in bunker gondola cars is determined by the consignor in the settlement way or weighing on railway truck scales.

20. Weighing of loads on railway truck scales is made with stop and declutching of cars or with stop without declutching of cars.

Weighing of cars in movement is allowed only on the railway truck scales intended for this method of weighing. Weighing in movement of tanks with liquid cargoes is allowed only on condition of simultaneous finding of all wheels of the tank on cargo receiver, that is povagonno.

21. With stop and declutching of cars the following loads are always weighed:

the grain, grain loads transported by embankment, seeds of oil-bearing and bean crops, compound feeds and bran;

the food loads transported by filling in tanks (except alcohol ethyl);

potatoes transported by bulk, vegetables, melon cultures, non-ferrous not packaged metals and non-ferrous scrap.

Weighing on railway truck scales of other loads is made with stop of cars without their declutching or in movement on the railway truck scales intended for this method of weighing.

The mass of meat, meat products, other perishable loads transported by bulk in refrigerated cars is determined by the consignor on commodity scales.

22. The tare mass of the car, container is accepted according to cliche on the car, container. In the presence of railway truck scales at consignors it is allowed to determine car tare mass by means of weighing with indication of in the corresponding column of superimposed actual mass of container of the car.

23. When weighing loads on railway truck scales the consignor in necessary cases shall make load dosage (additional load or partial unloading). For this purpose he shall organize dosing site at railway truck scales, provide it with stock, and in case of departure of bulk goods (including crushed stone, mineral fertilizers, cement, clay, sand) - as well mechanisms transactions on dosage were performed in the course of weighing.

24. The mass of the removable equipment, details of fixture, devices, and also materials for winterization of the car which in case of issue of load on station of destination are removed from the car and are issued to the consignee together with load, enters weight and it is specified in delivery note under the name of load according to the procedure, provided by rules of filling of carriage documents on carriage of goods by railway transport public. The mass of the removable and fixed equipment, and also materials for winterization of the car which are not issued to the consignee on station of destination joins in car tare mass.

25. The method of determination of mass of load and also who (the consignor or carrier) determined the mass of load is specified in the corresponding graphs of the original of delivery note. In case of determination of mass of load according to the standard the mass of one place in addition is specified. Seating capacity of the loads shown to transportation in all cases is determined by the consignor.

26. The loaded closed cars (including specialized), tanks shall be sealed up by seals or locking and sealing devices (further - ZPU):

carrier if the load is submerged by carrier;

the consignor, if the load is submerged by the consignor. Besides, loaded containers shall be sealed up by the consignor.

Sealing of cars and containers is performed according to rules of sealing of cars and containers on rail transport public.

The freight list, allowed to transportation in cars without seals or ZPU, but with compulsory use of curling for locking of doors, hatches, is established by rules of sealing of cars and containers on rail transport public.

Household things (that is loads for the personal, family, house and other needs which are not connected with implementation of business activity) are transported in containers for ZPU of carrier or the organizations rendering forwarding services.

Expenses of carrier on imposing of seals, ZPU on cars, containers when implementing customs or other types of control are compensated at the expense of consignors or consignees.

27. After the end of loading the consignor shall clear body of the car and container, including roof, charging hatches of the covered and specialized cars of remaining balance of loads, to wipe pattern texts on the car, to clear frame and undercarriages of the car, intercar connections.

28. In load acknowledge to transportation the carrier on receipt in the corresponding column of back of the road sheet issues to the consignor the receipt on cargo reception. The superimposed and issued on its basis to the consignor receipt on cargo reception confirm the conclusion of the transportation agreement of load. In case of presentation of load to transportation the authorized representative of the consignor represents to carrier on railway station of departure the power of attorney on the right of signing of delivery note and other necessary documents which is drawn up according to the legislation.

Cargo reception time to transportation makes sure imposing of calendar stamp of carrier of the corresponding column of delivery note.

29. Cargo reception to transportation in the international railway service is performed according to the Agreement on the international railway freight traffic of November 1, 1951 (further - SMGS) and other international treaties, and also these rules.

By carrier for separate professions of the workers performing servicing of consignors, consignees the corporate clothes can be established.

30. When importing by consignors to railway station of departure of load of earlier provided term of its loading in places public the load can be accepted on storage. In this case in the corresponding graphs of delivery note date of the actual loading by carrier of this load in places public in the car is specified.

31. Cargo reception to transportation is performed by carrier taking into account observance of requirements to cars in the commercial relation as follows:

acceptance to carriage of goods in the cars of the covered type which are sealed up with imposing of seals or ZPU, or cars with imposing of curlings in the cases provided by rules of carriages of goods is made by carrier without check of loads in cars by carrying out visual survey of condition of cars (including operability of seals or ZPU, curlings, hatches, upholsteries);

acceptance to carriage of goods in cars of open type (except for containers) is made by carrier by carrying out visual survey of load in the car on availability of signs of loss, shortage or damage (spoil) of loads, and also on observance of requirements of rules of placement and fixture of loads;

acceptance to carriage of goods, submerged in large size containers on railway tracks of uncommon use if the carrier approves loading of these containers on cars by doors outside, is performed according to the procedure, provided by the paragraph the second this Item;

acceptance to carriage of goods, submerged in containers on railway tracks of uncommon use, is performed by carrier by carrying out visual survey of the containers submerged in cars on availability of signs of defect of containers. At the same time containers shall be submerged by the consignor in cars doors inside (in folded condition) without access to seals or ZPU and availability of seals or ZPU on container is not checked by carrier;

acceptance to carriage of goods, submerged in containers in places public, is performed according to the procedure, provided by the paragraph the second this Item.

32. The conclusion of the transportation agreement does not exempt the consignor from obligation of protection of loads in the cars including loaded by containers (further - cars with loads), until the actual interchange switching with loads to carrier according to the instruction sheet of the acceptance inspector.

If at the time of the actual interchange switching with loads the carrier will find the circumstances testimonial of defect of cars or cargo damage, cars with loads to departure are not accepted, the instruction sheet of the acceptance inspector is not signed by carrier.

The defects revealed by carrier are eliminated with the consignor, and cars with loads are shown to carrier again.

The fact of delay of cars with loads to departure is drawn up by carrier the act of general format according to the procedure, provided by rules of creation of acts in case of carriages of goods by railway transport public. In this case in case of registration of delivery notes on cargo reception to transportation delivery date of loads increases by the term of delay of cars to departure because of the consignor about what in the original of delivery note in the corresponding column intended for carrier and the road sheet in the upper front part carrier the mark becomes: "Delivery date is increased on ___ days because of the consignor under the act of general format No. ____________ from __________". The first copy of the act of general format is put to delivery note.

33. Depending on cargo reception conditions to transportation by the actual confirmation of interchange switching with loads from the consignor to carrier are:

when loading the cars including loaded by containers on railway tracks of uncommon use when servicing by their locomotive of carrier - signatures of the consignor and carrier in the instruction sheet of the acceptance inspector;

when loading the cars including loaded by containers on railway tracks of uncommon use when servicing by their locomotive which is not belonging to carrier - signatures of the owner of railway track of uncommon use or the partner with which the contract for operation of railway track of uncommon use or the contract for giving and cleaning of cars, and carrier in the instruction sheet of the acceptance inspector is signed. In this case acceptance transactions are performed on the exhibition ways established by agreements to date of transmission of cars;

in case of cargo loading in cars in places public and in the places of uncommon use located in the territory of railway stations, consignors - the signature of the consignor and carrier in the instruction sheet of the acceptance inspector;

in case of cargo loading in cars in places public carrier - marks of carrier in the original of delivery note in case of acceptance of small, car sending, the signature of the consignor and carrier in the job specification KEU-16 in case of cargo reception in container. The form of the job specification KEU-16 and procedure for its filling are given in rules of transportations by railway transport of loads in ordinary containers.

34. Features of acceptance to transportation of separate types of loads are regulated by the rules of carriages of goods by railway transport public approved according to the procedure, established by the legislation.

35. Cargo reception to transportation with use of the electronic waybill, and also execution of the instruction sheet of the acceptance inspector, the job specification KEU-16 in electronic form is made in the presence of the contract on electronic exchange of documents between carrier and the consignor and in the procedure established in it.

36. According to Item 64 of the Charter of rail transport public carrier under the agreement with the consignor special conditions of carriages of goods, responsibility of the parties for their safety can be established. When implementing transportations by national (common network) carrier special conditions of carriages of goods are established by the Belarusian railroad.

At the same time the consignor before the conclusion on special conditions shall approve data of condition with the consignee with carrier of the transportation agreement of load.

Carriages of goods on special conditions can be performed by carrier in the following cases:

in transit loads which transportation is not provided by the rules of carriages of goods by railway transport public approved according to the procedure, established by the legislation;

in transit loads which are transported with discrepancy of container, packaging and condition of load to requirements of technical regulatory legal acts in the field of technical regulation and standardization, or in case of application of new types of container and packaging;

in transit with use of cars, containers in which the corresponding rules of carriages of goods by railway transport public do not provide transportation of separate types of loads;

other cases provided by the rules of carriages of goods by railway transport public approved according to the procedure, established by the legislation.

Special conditions of carriages of goods do not regulate procedure for application of rates, payments for works (services), penalties.

Rules of transportations by railway transport public of loads with the announced value

1. These rules establish procedure for presentation by consignors of loads to transportation by railway transport public with the announcement of their value.

2. The announcement the consignor of value is obligatory in case of presentation to transportation of the following loads:

precious metals, stones and products from them;

valuable bellows, and also products from them;

museum and antiquarian values, objects of art, pictures, statues and other art products;

the household things (that is loads for the personal, family, house and other needs which are not connected with business activity) transported without maintenance.

It is allowed to accept for shipment household things without announcement of value under condition if the consignor in the original of the transport rail waybill in the column "Special Statements and Sender's Marks" makes the mark "Without Announcement of Value" and will assure her the signature.

3. The announcement of value of the loads shown to transportation on open railway vehicles, in bulk, in bulk, in bulk, accompanied by conductors of consignors or consignees in cars, containers which are sealed up by consignors is not allowed.

The announcement of value of other loads shown to transportation can be made only at the request of the consignor.

4. The announced value of load shall not exceed load costs. 5. In case of presentation to cargo hauling with the announced value the consignor together with the transport rail waybill shall show to carrier the inventory of loads with the announced value completed in the corresponding GU-112, form provided in appendix to these rules. In transit load with use of the electronic waybill the inventory can be constituted in electronic form in the presence of the contract on electronic exchange of documents between carrier and the consignor.

In case of presentation to transportation according to one transport rail waybill of loads of the different announced value their distinctive signs, seating capacity and their announced value are specified in the inventory of loads separately.

The inventory of loads with the announced value is constituted in triplicate. The first copy of the inventory remains at carrier. The second copy of the inventory returns to the consignor. The third copy is fixed in the car, container in a visible place or in transit loads small sending invests in one of cargo pieces.

6. The carrier during the cargo reception shown to transportation checks compliance of quantity of cargo pieces this to the inventory of loads. The carrier has the right to demand representation by the consignor of the documents confirming load cost and also the opening by the consignor shown to cargo hauling for survey and check of value if there is basis to assume that load value is overestimated by the consignor.

7. In case of execution of the carriage documents submitted by the consignor the representative of carrier on railway station of departure shall check correctness of filling with the consignor of the inventory of loads, specify in it number of the transport rail waybill, undersign for the line "The Inventory Is Accepted" and put down calendar stamp of carrier in the inventory.

If the inventory is constituted on several sheets, the calendar stamp and signatures of the consignor and carrier are put down on each leaf.

8. For the announced value of load the payment is levied. The amount of payment is specified in the transport rail waybill.

Rules of transportations of the autotractor machinery by railway transport public

Chapter 1. General provisions

1. These rules regulate procedure railway transport public of transportations of the autotractor machinery.

Treat the autotractor machinery: passenger, cargo, special equipment vehicles, buses, trolleybuses, their bodies, tractors, excavators, farm vehicles, road trains, contrailers, microcars and other equipment on wheel and caterpillar to the course.

2. Preparation of the autotractor machinery for transportation is performed according to GOST 26653-90 "Preparation of general cargoes for transportation".

The autotractor machinery is prepared by the consignor for transportation so that its safety and traffic security of trains in course of carriage was ensured.

In case of presentation to transportation of the autotractor machinery the consignor shall:

check operability of brake system and after loading to slow down the machine so that there could not be self-brake release, merge water;

stop fixers and fix all moving and rotary parts by the method excluding their movement and turn;

remove and pack easily dischargeable details and nodes. Details and nodes which can be removed from the autotractor machinery without use of tools are considered as easily dischargeable details and nodes (including mirrors, brushes snowplows);

remove and pack or protect packaging material all fragile details (including flew down), and also unprotected benzo-and electric motors, accumulators. Transportation of the autotractor machinery without protection of fragile details is allowed provided that the consignor bears responsibility for fight and for all effects connected with lack of protection. In the column "Special Statements and Sender's Marks" of the original of the transport rail waybill (further – delivery note) the consignor shall make the mark "Transportation without Protection of Fragile Details". In this case the damages question for fight and for the effects connected with lack of protection of fragile details is solved between the consignor and the consignee without participation of carrier;

close doors of cabins, salons, the covered bodies, cowls, luggage carriers, compartments on latches, locks (in case of their absence to equip with additional locking devices) and to seal up cabin, salon, body, cowl. At the same time sealing shall be made by seals which removal is impossible without their damage; seals shall be imposed so that the possibility of access to cabin, salon, body, cowl without damage of seals was excluded. Seals shall not damage the painted surface of the autotractor machinery.

3. The dismantled accessories and nodes of the autotractor machinery placed for the period of transportation in cabin, salon, luggage carrier, the covered body, and also the nodes established on the regular places in cabin, salon, luggage carrier, the covered body are allowed to be transported unpacked.

In transit the autotractor machinery accessories and nodes, spare parts, the tool are transported by consignor routes or groups of cars (two cars and more) in closed cars, ordinary containers in the corresponding packaging together with all batch of the autotractor machinery. In this case in the column "Special Statements and Sender's Marks" of the original the superimposed consignor specifies: "The tool, accessories and nodes did not invest".

In transit the autotractor machinery in the eight-wheel closed cars intended for transportation of cars, dismantle of easily dischargeable accessories and nodes and protection of fragile details are not required.

4. The list of the removed accessories and nodes is specified the consignor in the original of delivery note in the column "Special Statements and Sender's Marks". In transit the autotractor machinery with different types of technological shortage in the column "Special Statements and Sender's Marks" of the original of delivery note the list of missing details and nodes on each unit of the transported autotractor machinery is specified.
