For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of Petroleum Storage Depots and Gas Stations".

2. This resolution becomes effective after six months from the date of the first official publication.

Technical regulation "Requirements to Safety of Petroleum Storage Depots and Gas Stations"

1. Scope

1. This Technical regulation "Requirements to Safety of Petroleum Storage Depots and Gas Stations" (further - the Technical regulation) establishes requirements to safety of petroleum storage depots and stationary, container, portable gas stations (daleeavtozapravochny stations).

2. The regulations establish:

1) the Minimum requirements of safety to petroleum storage depots and gas stations in case of their designing, installation and construction works, operation and liquidation;

2) assessment and confirmation of conformity of petroleum storage depots and gas stations to requirements of regulations taking into account risk degree of external natural impacts, production and operational factors, possible effects of environmental pollution.

2. Terms and determinations

3. In regulations the following terms and determinations are applied:

gas station - the technology complex equipped with the equipment, providing storage and retail sale of oil products;

underground storage tank (underground storage) - the reservoir intended for storage of oil products if the highest level of liquid in the reservoir is lower 0,2 of m of at least lower planning mark of the adjacent platform (within 3 m from reservoir wall);

the petroleum storage depot - the organization having complex of buildings and constructions, the processing equipment, the reservoir park, technical devices and communications intended for acceptance, storage and wholesale of oil products;

the passport of the petroleum storage depot or gas station - the document containing information on its main characteristics and the responsible operator, the carried-out reconstruction and repairs, information on the performed and their results;

safety of the petroleum storage depot, gas station - lack of the unacceptable risk connected with damnification of life, to health of the person and the environment;

operation of the petroleum storage depot or gas station - control of technical condition of buildings (constructions), diagnostics, maintenance, running repair of technical devices of the petroleum storage depot or gas station;

extreme amounts of dangerous substances on the petroleum storage depot, gas station - amount of the oil products which are on petroleum storage depots, warehouses, gas stations which availability is the basis for declaring;

storage location of oil products - complex of technology constructions, the equipment providing acceptance, storage and leave of oil products;

technical devices - processing equipment (reservoirs, tanks, cylinders, barrels, pipelines, including connecting details of pipelines, pumps), aggregates (slivo-bulk devices, underground constructions, small-size coppers), the locking, regulating and safety armature, their nodes and components; electroinstallations; metering stations and control, including fuel-dispensing columns, measuring instruments and automation; the filters mud-catchers used on petroleum storage depots and gas stations;

risk assessment - the analysis and assessment of opportunity and effects of realization of dangers, comparison with criteria of unacceptable risk;

admissible risk level - socially acknowledged level of safety.

3. Conditions of creation and operation of petroleum storage depots and gas stations

4. The technical devices, materials applied on petroleum storage depots and gas stations are allowed to application in the territory of the Republic of Kazakhstan according to the procedure established by the legislation on industrial safety.

5. Quality and technical characteristic of the materials and finished products applied to production of technical devices of petroleum storage depots and gas stations is confirmed by passports or certificates of the manufacturer.

6. By delivery of the technical devices intended for petroleum storage depots and gas stations maintenance of technical devices shall be provided by information in the state and Russian languages including the name, the countries and manufacturer (contractor), admissible useful life (resource), method of application.

7. On petroleum storage depots and gas stations, passports of dangerous wastes according to Ecological the Code of the Republic of Kazakhstan, the sanitary passport according to the Law of the Republic of Kazakhstan of December 4, 2002 "About sanitary and epidemiologic wellbeing of the population", the ecological passport according to GOST 17.0.0.04-90 and the passport of the petroleum storage depot or gas station are kept.

4. Designing of petroleum storage depots and gas stations

4.1 General requirements to designing of petroleum storage depots and gas stations

8. When designing all possible dangers in case of accidents, refusals, external impacts, expected human errors taking into account statistical data of accident rate on similar objects shall be identified, technical and economic indicators of construction and operation.

9. For all identified dangers the risk assessment settlement, experimental or analytical is carried out by methods.

10. Taking into account the carried-out risk assessment the package of measures for liquidation of risk or its reduction to admissible level in case of operation of petroleum storage depots, gas stations is determined.

11. In case of determination of admissible risks by the project organization are considered:
