1. Approve the enclosed Rules of use of retirement benefits and public social benefits of the disabled people living in the public medico-social institutions.

2. This order becomes effective after ten calendar days from the date of the first official publication.

Rules of use of retirement benefits and public social benefits of the disabled people living in the public medico-social institutions

1. These rules are developed according to the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" and determine procedure for use of retirement benefits from the State center for pension payment (further - retirement benefits) and the public social benefits (daleeposobiya) of disabled people living in the public medico-social institutions, the judgment recognized incapacitated and needing guardianship.

2. Retirement benefits and benefits of disabled people, the judgment recognized incapacitated and needing guardianship (further - sponsored), are listed by the Republican state state company "State Center for Pension Payment of the Ministry of Labour and Social Protection of the Population of the Republic of Kazakhstan" on bank accounts sponsored, opened by the head of the public medico-social institution (further - the guardian), in banks of the second level (further - banks).

3. For opening of the bank account sponsored the guardian represents to bank the copy of the judgment about recognition of person incapacitated, decisions of guardianship and custody body on establishment over incapacitated person of guardianship, and also the documents provided by the Rules of opening, maintaining and closing of bank accounts of clients in banks of the Republic of Kazakhstan approved by the resolution of Board of National Bank of the Republic of Kazakhstan of June 2, 2000 No. 266, registered in the Register of state registration of regulatory legal acts at No. 1199.

4. Retirement benefits and benefits of sponsored are spent by the guardian with preliminary permission of guardianship and custody body.

5. Cash withdrawal of money from the bank account sponsored can be performed by the guardian in the amount of no more than thirty percent (30%) of the amount which is monthly arriving on the bank account of sponsored.

Cash is used by the guardian on acquisition of medicines, objects of sanitary hygiene and medical care (including dental), in case of their absence in the public medico-social institution and based on the conclusion of the health worker of the public medico-social institution.

6. The money which remained on the bank account is used by the guardian for personal needs sponsored for acquisition of additional food, necessities, soft and firm stock according to appendix 1 to these rules, by money transfer to the supplier of goods, works, services via bank transfer according to the agreement.

7. On the bank account sponsored monthly there shall be amount in the amount of at least ten percent (10%) of monthly receipts of retirement benefits and benefits.

8. Determination of the needs and requirements sponsored in acquisition of additional food, necessities, soft and firm stock is performed by the guardian monthly on joint basis with participation of the health worker, diets sisters, the matron of the public medico-social institution, and also the authorized representative of local executive body of area (the city of republican value, the capital) concerning employment and social programs (further - authorized body) about what the decision in form according to appendix 2 to these rules is constituted.

9. Retirement benefits and benefits of sponsored cannot be used by the guardian on acquisition of food, the necessities, soft and firm stock provided to acquisition at the expense of means of local budgets and also on compensation of employees of the public medico-social institutions and the related social assignments.

In case of spoil sponsored bedding, beds, tables, chairs, cases their acquisition it can be performed before the expiration of their operation.

10. Data on the made expenses from the bank accounts sponsored on acquisition of additional food, medicines, necessities, soft and firm stock, objects of sanitary hygiene and medical care are reflected in the magazine according to appendix 3 to these rules.

11. Within year of the decision on need of acquisition of additional food, necessities, soft and firm stock, and also issue documents (receipts, delivery notes, checks, agreements and other financial records) on use of the money sponsored are created in cases (separately on months of the accounting period).

The specified documents are stored in accounts department of the public medico-social institution within five years.

12. The guardian shall submit quarterly to the 10th following reporting in authorized body the report on use of the received retirement benefits and benefits sponsored according to appendix 4 to these rules.

13. Control of correctness of expenditure by the guardian of the retirement benefits and benefits sponsored and also the size of cash amounts of the money withdrawn from the bank account according to Item 5 of these rules, and remaining balance of the money which are available on the bank account according to Item 7 of these rules is performed by authorized body.
