About approval of the Instruction about procedure for maintaining the State register of burdenings of personal estate and filling of statements

According to the Law of Ukraine "About providing requirements of creditors and registration of burdenings" and the resolution of the Cabinet of Ministers of Ukraine of 05.07.2004 No. 830 "About approval of the Procedure for maintaining the State register of burdenings of personal estate" PRIKAZYVAYU:

1. Approve the Instruction about procedure for maintaining the State register of burdenings of personal estate and filling of statements which is attached.

2. To the state company "Information center" of the Ministry of Justice of Ukraine till 02.08.2004:

create the software of the State register of burdenings of personal estate;

provide due transferring of the database of the State register of pledges of personal estate to the database of the State register of burdenings of personal estate;

provide commissioning of the State register of burdenings of personal estate.

3. Determine that for use of the State register of burdenings of personal estate by receipt of extraction the payment is levied in the amount of, provided by the resolution of the Cabinet of Ministers of Ukraine of 05.07.2004 No. 830.

4. Determine that registrars of the State register of encumbrances of personal estate (further - the Registrar) make statements of the State register of encumbrances of personal estate (including excerpts about public encumbrances of personal estate) in duplicate, one of which remains in the case of the Registrar, and the second is presented to the applicant.

5. Recognize invalid from 02.08.2004:

the order of the Ministry of Justice of Ukraine of 29.07.2003 No. 92/5 "About issue of extraction from the State register of pledges of personal estate which testify to availability or lack in it of record about tax pledge", registered in Ministry of Justice 29.07.2003 for No. 654/7975.

6. To department of the civil legislation and entrepreneurship (I.I. Zavalnaya), to Department for civil status of citizens and notariate (Pavlova L. M.), state company "Information center" of the Ministry of Justice of Ukraine (Dobzhansky V. B.):

submit this order on state registration according to the Presidential decree of Ukraine of 03.10.92 No. 493/92 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes);

bring the order to permission of chiefs of Head department of justice, the Ministry of Justice in the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city justice departments, the regional state company "Information center" of the Ministry of Justice of branches of Ukraine and to provide its due application in work.

7. To chiefs of Head department of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city justice departments to bring this order to permission of district, city justice departments and notaries.
