In pursuance of the Presidential decree of the Republic of Belarus of June 12, 2000 No. 339 "About enhancement of procedure and conditions of carrying out obligatory civil liability insurance of owners of vehicles" (The national register of legal acts of the Republic of Belarus, 2000, No. 58, 1/1365) and according to the Charter of the Belarusian bureau on transportation insurance approved by the Presidential decree of the Republic of Belarus of December 1, 1999 No. 701 (The national register of legal acts of the Republic of Belarus, 1999, to No. 93, 1/810), I order:

1. Approve the enclosed Instruction about procedure for carrying out obligatory civil liability insurance of owners of vehicles.

2. The order of the Belarusian bureau on transportation insurance of August 19, 1999 No. 1 "About approval of the Instruction about procedure for carrying out obligatory civil liability insurance of owners of vehicles" (1999, No. 66, 10/21) to declare the national register of legal acts of the Republic of Belarus invalid.

The instruction about procedure for carrying out obligatory civil liability insurance of owners

Chapter 1. General provisions

1. This Instruction determines procedure for document creation in case of the conclusion of agreements of obligatory civil liability insurance of owners of vehicles and payment of insurance indemnity to the victims, owners of vehicles - to the residents of the Republic of Belarus who signed agreements of all-inclusive internal insurance as a result of the road accidents.

2. In the Republic of Belarus according to the Regulations on insurance activity in the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of August 25, 2006 No. 530 "About insurance activity" in edition of the Presidential decree of the Republic of Belarus of April 14, 2014 No. 165 (The national register of legal acts of the Republic of Belarus, 2006, No. 143, 1/7866; National legal Internet portal of the Republic of Belarus, 19.04. 2014, 1/14942) (further - Regulations on insurance activity) the following agreement types of obligatory civil liability insurance of owners of vehicles consist in writing: agreement of internal insurance, agreement of all-inclusive internal insurance, agreement of boundary insurance and insurance contract "Green card".

Chapter 2. Procedure for the conclusion of the agreement of internal insurance

3. The agreement of internal insurance is signed with the vehicle owner - the resident of the Republic of Belarus or the vehicle owner - the nonresident of the Republic of Belarus who is temporarily in the territory of the Republic of Belarus or with the driver on behalf of the vehicle owner - the nonresident of the Republic of Belarus who is temporarily in the territory of the Republic of Belarus on all vehicles used in traffic in the territory of the Republic of Belarus.

4. The agreement of internal insurance is signed, as a rule, for one year.

In case of seasonal use of the vehicle this agreement can be signed for a period of one up to twelve months.

In case of acquisition or receipt of the vehicle before its registration the specified agreement shall be signed by the owner of this vehicle for fifteen days.

5. For the conclusion of the agreement of internal insurance the vehicle owner files to the insurer petition in form according to appendix 1 to this Instruction of the following content:

surname, own name, middle name (in case of its availability), identification number (in case of its availability) and the residence (the place of stay) of the insurer – physical person (according to registration at the place of residence (the place of stay) or full name and the location of the insurer – the legal entity (according to the place of state registration specified in constituent documents) and phone number;

surname, own name, middle name (in case of its availability) and the residence of the owner of the vehicle – physical person according to the registration certificate of the vehicle or full name and the location of the owner of the vehicle – the legal entity according to the registration certificate of the vehicle;

the basis on right of possession the vehicle (owing to the property right, the right of economic maintaining, operational management, according to the lease agreement, by proxy on vehicle control or on other bases, stipulated by the legislation or the agreement);

data on the vehicle: type, brand (model), registration sign, body number (landing gear), technical characteristics (engine capacity or capacity, loading capacity, seating capacity, engine power, electric vehicle or hybrid car);

the insurance term, the introduction of the insurance contract in force, procedure (one-timely or in two stages) and form (cash or in non-cash form in the form of bank transfer or in non-cash form with use of bank payment card) payments of premium;

use of the car as taxi, and the bus – for public conveyances in the regular message;

the name, series, number and date of issue of the documents confirming possibility of payment of premium under the contract of internal insurance (the agreement of all-inclusive internal insurance) with the physical person – the resident of the Republic of Belarus in the amount of 50 percent (the decision of body for work, employment and social protection about free or on favorable terms allocation of the vehicle or the Belarusian republican unitary insurance enterprise Belgosstrakh (further – Belgosstrakh) about free or on favorable terms allocation of the vehicle in connection with implementation of compulsory insurance from labor accidents and occupational diseases; certificate of the disabled person or participant of the Great Patriotic War; car driver license; the reference confirming cohabitation to one address with person to whom the power of attorney on the right of vehicle control, or other document confirming private use by the vehicle is issued);

the name of the insurer with which the previous insurance contract, series and number of the insurance certificate and term of insurance was signed;

data on making in the year of the road accidents preceding the conclusion of the insurance contract and damnification by the vehicle owner or persons to whom the previous insurance contracts signed concerning this vehicle extended;

data on age of the insurer – physical person and its years of service of driving on the corresponding class of vehicle.

6. Along with the statement specified in Item 5 of this Instruction, the vehicle owner represents the registration certificate (log book) of the vehicle, and in case of lack of distribution of the registration certificate (log book) of the vehicle – other document confirming acquisition or receipt of the vehicle.

The physical person also submits to the insurer the identity document (the passport, the residence permit, the certificate of the refugee).

7. In the presence at the owner of two and more units of vehicles of the data on vehicles are enclosed to the application in form according to appendix 2 to this Instruction. At the same time in the Section "Data on the Vehicle" of the statement record is made: "See appendix".

8. In case of receipt of the statement from the legal entity for the conclusion of the agreement of internal insurance the insurer draws up the account with indication of the premium amount of euro which from the moment of receipt of the statement goes to this person for payment to three-day time.

9. The document of the established sample certifying the conclusion of the agreement of internal insurance is the insurance certificate in the form approved by the Belarusian bureau on transportation insurance (further - the Belarusian bureau) in coordination with the Ministry of Finance of the Republic of Belarus (further - the Ministry of Finance).

At the same time with the insurance certificate specified in part one of this Item, one form of the notice on the road accident in the form approved by the Belarusian bureau in coordination with the Ministry of Finance and the Ministry of Internal Affairs of the Republic of Belarus is issued to the insurer (further - the Ministry of Internal Affairs).

Chapter 3. Procedure for the conclusion of the agreement of all-inclusive internal insurance

10. The agreement of all-inclusive internal insurance including obligatory civil liability insurance of the vehicle owner and his vehicle on damnification case as a result of the road accident consists with the vehicle owner - the resident of the Republic of Belarus. At the same time the vehicle owner - the resident of the Republic of Belarus signs the agreement of internal insurance or the agreement of all-inclusive internal insurance at the choice.

11. The agreement of all-inclusive internal insurance is signed for a period of six months up to one year.

12. For the conclusion of the agreement of all-inclusive internal insurance the vehicle owner files to the insurer the petition specified in Item 5 of this Instruction.

13. Along with the statement the vehicle owner represents the registration certificate (log book) of the vehicle, and in case of lack of distribution of the registration certificate (log book) of the vehicle – other document confirming acquisition or receipt of the vehicle.

The physical person also submits to the insurer the identity document (the passport, the residence permit, the certificate of the refugee).

17. In case of the conclusion of the agreement of all-inclusive internal insurance the insurer examines the vehicle, if necessary - its photography also constitutes the certificate of survey of the vehicle in form according to appendix 3 to this Instruction.

At the same time the insurer shall provide the vehicle in time specified by the insurer and the place. In case of impossibility of provision by the insurer of the vehicle in time specified by the insurer and the place its survey is made in the place, the day and time approved with the insurer.

Chapter 4. Procedure for filling of the insurance certificate

18. The insurance certificates specified in Items 9 and 16 of this Instruction are filled in in the following procedure:

18.1. in the line "Name of Insurance Company (Division), Location and Phone" are specified the name of the insurance company (separate division) which granted the insurance certificate, the location address, contact telephone number and the accounting number of the payer (ANP);

18.2. in line "Is issued" surname, own name, middle name (are entered in case of its availability) and the residence (the place of stay) (according to registration at the place of residence (the place of stay) of the insurer - physical person or the name and the location (according to the place of state registration specified in constituent documents) the insurer - the legal entity;

18.3. in the column "Insurance Term" the term for which the agreement of internal insurance (the agreement of all-inclusive internal insurance) is signed (for example, the agreement of internal insurance - 1 month, 1 year is specified; the agreement of all-inclusive internal insurance - 6 months, 1 year).

Further it is specified from what and on what number, month and year the agreement of internal insurance (the agreement of all-inclusive internal insurance) is effective (for example, from July 1, 2014 to December 31, 2014);

18.4. in the column "time" time of payment of premium (is specified in case of payment of premium in two stages - its parts) cash or time of issue of the insurance certificate (in case of payment of premium (its part) in non-cash form in the form of bank transfer or in non-cash form with use of bank payment card) in case from the same day insurance term is established. If the term of insurance is established from any other day within a month from the moment of payment of premium (its part) and in case of the conclusion of the agreement of internal insurance (the agreement of all-inclusive internal insurance) for new term before the expiration of operation of the previous agreement, in this column time 00.00 is specified. Time of the termination of the duration of the agreement of internal insurance (the agreement of all-inclusive internal insurance) corresponds to 24 o'clock in the afternoon of the end of its action;

18.5. in the column "Type" the vehicle type coded as follows is specified:

cars (VAZ, ZAZ, "Muscovite", AZLK, IZh, GAZ, LUAZ, UAZ) with engine capacity:

to 1200 cubic cm inclusive - N1;

over 1200 to 1800 cubic cm inclusive - N2;

over 1800 to 2500 cubic cm inclusive - N3;

over 2500 to 3500 cubic cm inclusive - N4;

over 3500 cubic cm - N5;

cars, including minibuses, with number of seats to 8 inclusive (apart from driver's seat), except for cars VAZ, ZAZ, "Muscovite", AZLK, IZh, GAZ, LUAZ, UAZ, with engine capacity:

to 1200 cubic cm inclusive - A1;

over 1200 to 1800 cubic cm inclusive - A2;

over 1800 to 2500 cubic cm inclusive - A3;

over 2500 to 3500 cubic cm inclusive - A4;

over 3500 cubic cm - A5;

passenger cars taxi (the M1 type *) - A6;

electric vehicles:

electric vehicles - P1;

hybrid cars - P2;

trail cars to cars:

cargo and folding residential - B1;

trail cars dachas (caravan) - B2;

cargo and ranch wagons **, their landing gear load-carrying capacity:

to 1 t inclusive - C0;

over 1 to 2 t inclusive - C1;

over 2 to 8 t inclusive - C2;

wheel tractors and road machines with engine power:

to 50 hp inclusive - V1;

over 50 to 200 hp inclusive - V2;

trail cars and semitrailer trucks to cargo vehicles, their chassis, trail cars and semitrailer trucks to tractors load-carrying capacity:

to 5 t inclusive - E0;

over 5 to 10 t inclusive - E1;

over 10 to 20 t inclusive - E2;

over 20 t - E3;

kvadritsikla (microcar), microcar, motorcycles, motor scooters and mopeds with engine capacity:

to 150 cubic cm inclusive - F1;

over 150 to 750 cubic cm inclusive - F2;

over 750 cubic cm - F3;

buses with number of seats:

to 20 inclusive - L1;

from 21 to 40 inclusive - L2;

over 40 - L3;

the buses used for public conveyances in the regular message (the Sq.m type ***) - L4;

trolleybuses, trams - W.

In case of the conclusion of contracts of internal insurance with the nonresidents of the Republic of Belarus who are temporarily in the territory of the Republic of Belarus for filling of this column the codes of types of vehicles specified in Item 23 of this Instruction are used;

* Belong the category M1, vehicles used for public conveyance, having except driver's seat no more than eight places for sitting and which are drawn up according to STB 13892003, on which to the M1 type registration signs of 13 type are issued (STB 914-99 (ISO 7591:1982).

If on the vehicle bodies of the State automobile inspectorate of the Ministry of Internal Affairs issue duplicative registration signs (on yellow background with the TAX, TBX, TEX series, etc.), the insurance contract concerning this vehicle is signed on type A 6, and in the graph of the insurance certificate "Registration sign" the registration sign with the TAH series, for example, 7 TAX 5820 is specified;

18.8. in the column "Technical characteristic" the engine capacity or loading capacity, number of seats, capacity are specified depending on vehicle type. At the same time vehicle capacity is determined by difference between the permitted maximum (complete) mass of the vehicle and its off-load weight which are specified in the registration certificate (log book) of the vehicle.

In case of absence in the registration certificate (log book) of the vehicle of these characteristics load-carrying capacity of vehicles is determined by the technical characteristics of the vehicle established by the manufacturer.

Load-carrying capacity of cargo vehicles of special purpose is determined proceeding from model based on which they are designed.

On the special purpose vehicles which do not have analogs, load-carrying capacity is determined in relation to similar model.

On passenger cars taxi (the M1) type, to electric vehicles, trail cars to the cars, chain track tractors, tractors, buses used for public conveyance in the regular message to trolleybuses and trams this column is not filled in;
