About approval of the Regulations on the Ministry of Defence of the Republic of Tajikistan

1. Approve the enclosed Regulations on the Ministry of Defence of the Republic of Tajikistan.

2. Recognize invalid the following orders of the Government of the Republic of Tajikistan:

- of July 15, 1997 No. 301 "About approval of the Regulations on the Ministry of Defence of the Republic of Tajikistan";

- of October 25, 2003 No. 479 "About entering of amendments into Regulations on the Ministry of Defence of the Republic of Tajikistan".

Regulations on the Ministry of Defence of the Republic of Tajikistan

I. General provisions

1. The Ministry of Defence of the Republic of Tajikistan is the central executive body of the government in the field of defense performing management of Armed Forces of the Republic of Tajikistan and local authorities of military management. The Minister of Defence of the Republic of Tajikistan bears responsibility for their development and preparation for accomplishment of tasks of defense, provides defensive policy, compliance with law in military area, effective functioning of bodies of military management.

The Ministry of Defence of the Republic of Tajikistan is guided in the activities by the Constitution of the Republic of Tajikistan, the constitutional laws of the Republic of Tajikistan, the laws of the Republic of Tajikistan, decisions of Majlisi Oli of the Republic of Tajikistan, acts of the President of the Republic of Tajikistan, the order of the Government of the Republic of Tajikistan, the international acts recognized by the Republic of Tajikistan and this Provision.

II. Powers

6. The main objectives of the Ministry of Defence of the Republic of Tajikistan are:

- development and realization of state policy in the field of defense;

- ensuring reflection of aggression and drawing to aggressor of defeat;

- ensuring protection of airspace of the Republic of Tajikistan, including ensuring anti-terrorist safety of airspace and in necessary cases rendering assistance to the state security agencies in preparation and carrying out counter-terrorist operations;

- ensuring the armed cover of frontier;

- providing organization and conducting territorial defense;

- ensuring permanent combat readiness of Armed Forces of the Republic of Tajikistan;

- management of garrisons;

7. Except the powers provided by the Law of the Republic of Tajikistan "About defense" the Ministry of Defence of the Republic of Tajikistan performs the following functions:

- develops drafts of normative legal acts relating in the field of defense;

- provides compliance with law about defense, develops and represents in accordance with the established procedure suggestions for improvement of the legislation on defense of the country;

- organizes military patriotic education of staff of Armed Forces of the Republic of Tajikistan;

- informs state bodies, mass media and the public of the republic on activities of Armed Forces of the Republic of Tajikistan;

- represents offers to the Government of the Republic of Tajikistan on amount of the material resources, special property allocated for defense and exercises control of efficiency of their use in Armed Forces of the Republic of Tajikistan;

- creates inventories of material resources for the special period, organizes and determines terms of their storage;

- performs quartering of troops, construction and operation of special, defensive and general objects;

- publishes regulations according to the current legislation on military questions and exercises control of their execution;

- develops offers and recommendations to the Security Council of the Republic of Tajikistan on coordination of activities of the law enforcement agencies directed to protection of sovereignty and territorial integrity;

- develops offers on carrying out the approved military, military and technical and personnel policy;

- prepares in accordance with the established procedure offers in the Government of the Republic of Tajikistan on assignments for needs of defense and to other military questions;

- reports to the Government of the Republic of Tajikistan on use of the funds allocated for defense;

- creates the state defensive orders on creation, production and repair of military equipment and other military property, and also their purchase;

- provides established procedure in garrisons, attracts for this purpose in coordination of force and means of other military forming of the Republic of Tajikistan;

- performs in accordance with the established procedure matching and placement of personnel and bears responsibility behind condition of military discipline in Armed Forces of the Republic of Tajikistan;

- performs cooperation and on interaction with military departments of other states, according to the Presidential decree of the Republic of Tajikistan and in coordination with Majlisi Oli of the Republic of Tajikistan provides accomplishment of the international obligations outside the republic;
