For the purpose of implementation of the Federal Law of June 24, 1998 N 89-FZ "About production wastes and consumption" (edition of 18:12. 2006) (Russian Federation Code, 1998, N 26, Art. 3009; 2001, N 1, Art. 21; 2003, N 2, Art. 167; 2004, N 35, Art. 3607; 2005, N 19, Art. 1752; 2006, N 1, Art. 10; 2006, N 52 (part I), the Art. 5498), in pursuance of the order of the Government of the Russian Federation of June 16, 2000 N 461 "About Rules of development and approval of standard rates of formation of waste and limits on their placement" (The Russian Federation Code, 2000, N 26, Art. 2772; 2006, N 52 (part II), Art. 5587; 2007, N 36, the Art. 4385) and according to the Regulations on Federal Service for Environmental, Technological and Nuclear Supervision approved by the order of the Government of the Russian Federation of July 30, 2004 N 401 "About Federal Service for Environmental, Technological and Nuclear Supervision" (The Russian Federation Code, 2004, N 32, Art. 3348; 2006, N 5, Art. 544; 2006, N 23, Art. 2527; 2006, N 52, 5587) I order to the Art.:

1. Approve the enclosed Methodical instructions for project development of standard rates of formation of waste and limits on their placement.

2. Direct this order to state registration in the Ministry of Justice of the Russian Federation.

Methodical instructions for project development of standard rates of formation of waste and limits on their placement

I. General provisions

1. Methodical instructions for project development of standard rates of formation of waste and limits on their placement (further - Methodical instructions) are intended for the individual entrepreneurs and legal entities performing activities in the field of the address with waste (further - business entities), and also the territorial authorities of Federal Service for Environmental, Technological and Nuclear Supervision (further - territorial authorities of Rostekhnadzor) making the decision on approval of standard rates of formation of waste and limits on their placement.

2. Methodical instructions determine single approach to development and general requirements to content and execution of drafts of standard rates of formation of waste and limits on their placement.

3. Action of Methodical instructions does not extend to questions of the treatment of radioactive waste.

4. In case of project development of standard rates of formation of waste and limits on their placement (further - PNOOLR) are considered:

- amounts of the used raw materials, materials, products taking into account design capacity;

- results of inventory count of waste and subjects to their placement;

- availability and capacity of the available subjects to use and neutralization of waste of this type;

- availability, capacity, capacity and estimated useful life of the available subjects to placement of waste;

- ecological, sanitary and hygienic and other requirements to placement of waste;

- possibility of ensuring safety of resource potential at the placed waste;

- economically reasonable amount of transfer quantity for export of waste;

- availability of the available technologies of conversion of withdrawal of this type which are included in the databank about technologies of use and neutralization of waste which is component of the state inventory of waste;

- maximum permissible harmful effects of the waste assumed to placement on the environment;

- ecological situation in the territory.

5. Business entities develop and draw up PNOOLR according to Appendix 2 to Methodical instructions and submit the specified projects for approval in territorial authorities of Rostekhnadzor in duplicate on paper, and also on the magnetic carrier.

In case of availability at business entity of territorially separate divisions (branches) located in different municipal districts or city districts, PNOOLR are developed for each territorially separate division (branch) separately.

If the business entity acts as the lessor of part of the production territories, rooms or the equipment and grants to the lessee the right to place waste on own objects, then waste of the lessee shall be included in PNOOLR of the lessor. If the lessee independently performs activities for the address with waste, the documents confirming these obligations of the lessee are attached to PNOOLR.
