The rule of issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance containing ozone-depleting substances

1. These rules of issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances, (further - Rules) are developed according to the Ecological code of the Republic of Kazakhstan of January 9, 2007 and determine procedure for issue of permissions to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances.

2. Physical persons and legal entities for receipt of the permission to works with use of ozone-depleting substances, repair, installation, equipment maintenance containing ozone-depleting substances (further - permission), represent to authorized body in the field of environmental protection (further - authorized body) the following documents:

1) the request for receipt of permission in form according to appendix 1 to these rules;

2) the copy of the certificate * or the certificate of state registration (re-registration) of the legal entity or the certificate on state registration of the individual entrepreneur acting without formation of legal entity;

3) form of data according to appendix 2 to these rules.

Note:

* the certificate on state registration (re-registration) of the legal entity (branch, representation) issued before enforcement of the Law of the Republic of Kazakhstan of December 24, 2012 "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning state registration of legal entities and accounting registration of branches and representations" is valid before the termination of activities of the legal entity.

3. Permission is issued by authorized body in form according to appendix 3 to these rules.

4. Permission is issued by authorized body no later than ten working days, and for small business entities no later than five working days from the date of submission of the statement with the relevant documents.

5. To the applicant the motivated answer about refusal in issue of permission in cases goes:

1) incompleteness of the submitted documents specified in Item 2 of these rules;

2) discrepancies of the request for receipt of permission and form of data to appendices 1 and 2 of these rules.

6. Permission to works with use of ozone-depleting substances, repair, installation, equipment maintenance, containing ozone-depleting substances, is issued for a period of one calendar year.

Permission is inaliennable and non-transferable.

7. Applicants bear responsibility for reliability of the data submitted for review of requests for issue of permissions.

8. The authorized body records the issued permissions.
