This Law fixes the legal basis of compensation of building damage of the Toktogul hydroelectric power station and water storage basin in the territory of the Toktogul district and the village of Zhazykechuu of the city of Karakul of the Jalal-Abad region.
Operation of this Law extends on all the living and working physical persons and legal entities of the Toktogul district and village of Zhazykechuu of the city of Karakul of the Jalal-Abad region.
The Toktogul district and the village of Zhazykechuu of the city of Karakul of the Jalal-Abad region appear the territories of special state care.
Except the guaranteed compensation provided by this Law, the state gives the support of social and economic development of the called territories necessary for ensuring their normal viability.
The program of social and economic development of the called territories for certain period is developed with participation of the interested ministries, administrative departments and local authorities and affirms the Government of the Kyrgyz Republic.
Recognize that in the called territories only 33 thousand hectares of the earth are flooded, 23 thousand hectares of agricultural holdings, the woods and garden plots are removed from agricultural turnover.
For completion of production of agricultural products to allocate to rural producers of the specified earth territories from Fund of redistribution of agricultural holdings under the Ministry of agricultural and water economy of the Kyrgyz Republic in the procedure established by the Government of the Kyrgyz Republic.
Compensation of property damage is performed by construction of facilities of social and cultural life, water management objects, factory buildings and constructions, development and improvement of lands.
For the purpose of life support of the population of the specified territories the state pays compensations.
The amount of compensation and procedure for its payment are established by the Government of the Kyrgyz Republic in coordination with bodies of local public administration and local self-government.
Source of financing of compensation of damage to consider annual assignments of JSC Elektricheskiye stantsii into the special account of the Toktogul district and village of Zhazykechuu of the city of Karakul of the Jalal-Abad region for the cost account of the Toktogul hydroelectric power station in the amount of 70, 0 million som, taking into account its indexation on inflation, with reference of this amount on cost of the electric power developed by the Toktogul hydroelectric power station that is annually provided in structure of rate for electrical energy by authorized state body on fuel and energy complex regulation.
Transfer of compensation amount to the special account of the Toktogul district and the village of Zhazykechuu of the city of Karakul of the Jalal-Abad region which is subtracted from gross annual income of JSC Elektricheskiye stantsii is made according to the Tax code of the Kyrgyz Republic.
Payment for the electric power consumed by the population, pumping points of the Toktogul district and village of Zhazykechuu of the city of Karakul is performed at cost the electric power developed by the Toktogul hydroelectric power station taking into account the regulations of consumption established by the Government of the Kyrgyz Republic.
The privileges and guarantees provided by other laws of the Kyrgyz Republic for persons living in the called territories remain.
Persons guilty of violation of requirements of this Law bear responsibility according to the current legislation of the Kyrgyz Republic.
This Law becomes effective since January 1, 1999.
