RESOLUTION OF PARLIAMENT OF THE REPUBLIC OF MOLDOVA

of March 20, 2008 No. 57-XVI

About approval of the Regulations on the Center for human rights, its structure, staff list and procedure for financing

(as amended on 13-03-2014)

According to the Law on parliamentary lawyers N 1349-XIII of October 17, 1997

The parliament accepts this resolution.

Art. 1. - Approve:

Regulations on the Center for human rights according to appendix 1;

structure of the Center for human rights according to appendix 2;

the staff list of the Center for human rights in number of 55 units.

Art. 2. - To perform financing of the Center for human rights at the expense of the government budget.

Art. 3. - Recognize invalid:

The resolution of Parliament on approval of the Regulations on the Center for human rights, its structure, the number of staff and procedure for financing N 1484-XIII of February 5, 1998 (The official monitor of the Republic of Moldova, 1998, N 22-23, Art. 129);

The resolution of Parliament on modification and amendments in the Resolution on approval of the Regulations on the Center for human rights, its structure, the number of staff and procedure for financing N 1619-XIII of April 2, 1998 (The official monitor of the Republic of Moldova, 1998, N 36-37, Art. 255);

The resolution of Parliament on modification and amendments in the Resolution of Parliament on approval of the Regulations on the Center for human rights, its structure, the number of staff and procedure for financing N 1072-XIV of June 22, 2000 (The official monitor of the Republic of Moldova, 2000, N 84-87, Art. 634);

The resolution of Parliament N 1453-XIV of March 7, 2001 about modification and amendments in the Resolution of Parliament N 1484-XIII of February 5, 1998 (The official monitor of the Republic of Moldova, 2001, N 29-30, Art. 101);

The resolution of Parliament on modification and amendments in Regulations on the Center for human rights N 201-XVI of July 26, 2007 (The official monitor of the Republic of Moldova, 2007, N 127-130, Art. 571).

Art. 4. - This resolution becomes effective from the date of acceptance.

Appendix No. 1

Regulations on the Center for human rights

I. General provisions

1. The center for human rights (further - the Center) is independent public institution.

2. The center is legal entity, has own budget which constitutes part of the government budget.

3. The center has seal and forms with the name and with the image of the State Emblem of the Republic of Moldova.

4. The permanent location of the Center is the municipium of Chisinau.

II. Main objectives and functions of the Center

5. The main objectives of the Center are:

a) ensuring activities of parliamentary lawyers for implementation of guarantees of respect for constitutional rights and human freedoms in the Republic of Moldova the central and local authorities of the public power, the companies, organizations, the organizations, irrespective of type of property and form of business, public associations and officials of all levels;

b) enhancement of the legislation in the field of human rights protection;

c) legal education of the population.

6. For the purpose of accomplishment of the tasks assigned to it the Center:

a) considers addresses of citizens which rights and freedoms are broken, and also the cases having special social significance;

b) periodically considers the questions concerning the treatment of persons imprisoned in places of their content for the purpose of strengthening in need of their protection against tortures and others cruel, inhuman or degrading treatments or punishment;

c) on analysis results of the constitutional rights and human freedoms granted about violation prepares and sends to the central and local authorities of the public power of the note and offer of general nature, belonging to ensuring constitutional rights and freedoms of citizens, enhancement of activities of administrative-and-management personnel, improvement of the treatment of persons imprisoned and conditions of their content;

d) extends among the population information materials on human rights;

e) cooperates with mass media, and also with the public associations which are engaged in human rights activities in the country and abroad.

7. For the purpose of implementation of the powers the Center interacts in accordance with the established procedure with the central and local authorities of the public power.

8. The center represents to Parliament the annual report on respect for human rights in the Republic of Moldova which is published in the Official monitor of the Republic of Moldova.

III. Structure of the Center

9. The structure of the Center affirms Parliament.

10. The center consists of four equal parliamentary lawyers, one of whom is specialist in questions of protection of the rights of the child (further - the child's lawyer), of employees, and also of representations.

11. According to the joint decision parliamentary lawyers can specialize on separate branches of law.

12. The parliament on representation of the Chairman of the parliament appoints the director of the Center from among parliamentary lawyers.

13. The director of the Center, except direct obligations of the parliamentary lawyer, performs the following functions:

a) directs work of the Center and represents it in the country and abroad;

b) appoints to position and dismisses employees of the Center;

c) establishes official pay rates the employee of the Center according to the current legislation, resolves issues of establishment of salary supplements and payment of awards;

d) grants leaves by the employee of the Center;

e) imposes authority punishments on employees of the Center;

f) resolves issues of increase in professional qualification, training and business trips of employees of the Center;

g) approves regulations on services and representative offices of the Center;

h) will organize preparation of annual reports of the Center.

14. The director of the Center performs the powers by the publication of orders and orders.

15. Employees of the Center perform organizational, information, scientific and analytical, financial and economic and other support of activities of parliamentary lawyers.

16. In other municipiums and the cities, except Chisinau, representations as territorial subdivisions of the Center are effective.

17. Employees of the Center receive official IDs which sample affirms the director.

18. To projects implementation, belonging to human rights protection, can be attracted and other specialists, representatives of public associations, at the same time for the specified purposes are created temporary work groups.
