About the Code of behavior of the government employee

(as amended on 21-12-2017)

The parliament adopts this ordinary law.

Chapter I. General provisions

Article 1. Subject, purpose and scope

(1) the Code of behavior of the government employee (further - the Code) regulates behavior of the government employee in case of execution of the state position.

(2) the Purpose of the Code is determination of standards of behavior in public service and informing citizens on proper conduct of the government employee for rendering high-quality public services, ensuring effective management in case of realization of public concerns, assistance to the prevention and eradication of corruption in the field of public management, creation of the atmosphere of trust of citizens to bodies of the public power.

(3) the Standards of behavior provided by the Code are obligatory for all government employees.

(4) Violation of the code is, on circumstances, minor offense, offense or crime to which are applied according to provision of the legislation on the state position and the status of the government employee, the Code about offenses or the Criminal code.

Chapter II. Principles of behavior of the government employee

Article 2. Principles of behavior of the government employee

In case of execution of the state position the government employee is guided by the following principles:

a) legality;

b) impartiality;

c) independence;

d) professionalism;

e) loyalty.

Article 3. Legality

(1) In case of accomplishment of the obligations assigned to it the government employee shall observe the Constitution of the Republic of Moldova, the current legislation and the international agreements which party is the Republic of Moldova.

(2) the Government employee considering that demand from him or he is forced to be effective illegally or in defiance of standards of behavior, shall report about it to heads.

Article 4. Impartiality

(1) the Government employee shall make decisions and be effective without prejudice, without any discrimination and it is fair, without giving preferences depending on race, nationalities, ethnic origin, language, religion, floor, views, political affiliation, property status or social origin to any persons or groups.

(2) the Behaviour of the government employee shall be based on respect, conscientiousness, correctness and politeness in the relations with applicants, and also with heads, colleagues and subordinates.

(3) the Government employee shall not, using the official position, to influence on physical persons or legal entity, including other government employees, forcing them to delinquent behavior.

Article 5. Independence

(1) the Political affiliation of the government employee shall not influence his behavior and decisions made by it, and also policy, decisions and measures of bodies of the public power.

(2) In case of execution of the state position it is forbidden to the government employee:

a) participate in collection of funds for activities of political parties and other social and political organizations;

b) use administrative resources for support of competitors on elections;

c) expose in premises of bodies of the public power the symbols or objects containing emblems or names of political parties or their candidates;

d) conduct promotion for benefit of any batch;

e) create or promote creation of divisions of political parties within bodies of the public power.

Article 6. Professionalism

(1) the Government employee shall carry out the service duties responsibly, competently, effectively, accurately and honesty.

(2) the Government employee otvetstven for accomplishment of the service duties before the direct head, the higher head and body of the public power.

Article 7. Loyalty

(1) the Government employee shall serve honesty body of the public power in which works, and also to legitimate interests of citizens.

(2) the Government employee shall abstain from any actions and acts able to cause damage to image, reputation or legitimate interests of body of the public power.

Chapter III. Standards of behavior of the government employee

Article 8. Information access

(1) According to the obligations assigned to it and according to the legislation on information access the government employee shall:

a) provide active, correct and timely informing citizens on the questions which are of public interest;

b) provide open entry to information;

c) observe the terms of provision of information provided by the law.

(2) the Government employee shall observe the restrictions on information access provided by the law for the purpose of protection of confidential information, private life of person and homeland security, and also provide protection of information which is at its disposal against unauthorized access, change or destruction.

(3) Communication with mass media on behalf of body of the public power is performed only by the government employee, the right given it.

Article 9. Use of public resources

(1) the Government employee shall provide protection of public property and not allow causing any damage by it.

(2) the Government employee shall use the working hours, and also property of body of the public power only for implementation of the activities connected with the held state position.

(3) the Government employee shall provide according to the obligations effective use of public money according to appointment.

(4) use of property of body of the public power when implementing by the government employee for personal reasons Is forbidden to the publicistic, teaching, research and other not forbidden by the law activities.

Article 10. Behavior within the international relations

(1) the Behaviour of the government employee representing body of the public power in the international organizations, educational institutions at conferences, seminars and other actions, shall not cause damage to image of the country and reputation of body of the public power which it represents.

(2) the Government employee who is in official journey shall behave according to legal rules and observe the laws of the host country.

(3) In the relations with representatives of other states the personal opinion on ethnic questions or international problems is forbidden to express to the government employee.

Article 11. Gifts

(1) the Government employee is forbidden to ask or accept the gifts, services, privileges, offers or any other benefits intended for him personally or for his family if their offer or provision is directly or indirectly connected with execution of service duties.
