About measures for implementation of the Presidential decree of the Republic of Belarus of May 4, 2007 No. 209

For the purpose of implementation of the Presidential decree of the Republic of Belarus of May 4, 2007 "About lottery activities in the territory of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 209

1. Establish:

procedure for conducting examination of security of lottery tickets from counterfeit and premature establishment of prize according to appendix 1;

procedure for conducting examination of security program, hardware-software, the hardware used when carrying out lotteries from illegal access, modification, copying, plunder, destruction of information and other similar actions according to appendix 2;

procedure for maintaining databases when carrying out lotteries according to appendix 3.

2. To founders and organizers of lotteries to bring agreements and conditions of carrying out lotteries into accord with the Presidential decree of the Republic of Belarus of May 4, 2007 No. 209 "About lottery activities in the territory of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2007, No. 109, 1/8550) before its entry into force.

3. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

3.1. subitem 4.30 of item 4 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585 "Questions of the Ministry of Finance of the Republic of Belarus" (National register of legal acts of the Republic of Belarus, 2001, No. 105, 5/9328), to state in the following edition:

"4.30. in the field of lottery activities:

coordinates activities for organization and carrying out lotteries;

makes suggestions for improvement of the legislation regulating lottery activities;

establishes requirements for carrying out lotteries, obligatory for subjects of lottery activities (for electronic lotteries - in coordination with the State center of safety of information in case of the President of the Republic of Belarus);

approves conditions of carrying out republican lotteries;

performs registration of lottery and grants to the organizer of lottery the certificate on its registration;

keeps the state register of lotteries;

determines features of financial accounting when implementing lottery activities;

controls compliance with law, regulating lottery activities, and conditions of carrying out lotteries (for electronic lotteries - together with the State center of safety of information in case of the President of the Republic of Belarus);

establishes procedure for receipt in the republican cash budget, the republican and international lotteries received from carrying out;";

To republican state bodies, local executive and administrative organs till November 12, 2007 to bring the regulatory legal acts into accord with the Presidential decree of the Republic of Belarus of May 4, 2007 No. 209 and this resolution and to take other necessary measures for its realization.

the resolution of Council of Ministers of the Republic of Belarus of September 14, 1998 No. 1440 "About modification of the resolution of Council of Ministers of the Republic of Belarus of May 22, 1998 No. 816" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1998, No. 26, the Art. 681);

the resolution of Council of Ministers of the Republic of Belarus of December 29, 1998 No. 1997 "About modification of the resolution of Council of Ministers of the Republic of Belarus of May 22, 1998 No. 816" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1999, No. 1, the Art. 16).

6. This resolution becomes effective since November 12, 2007, except for Items 2, 4 and this Item which become effective from the date of official publication of the resolution.

Procedure for conducting examination of security of lottery tickets from counterfeit and premature establishment of prize

1. This procedure determines procedure for assignment, production and registration of results of examination of security of lottery tickets from counterfeit and premature establishment of prize (further examination).

2. In this procedure terms in the values determined by the Regulations on procedure of lottery activities in the territory of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of May 4, 2007 No. 209 "About lottery activities in the territory of the Republic of Belarus" are used (The national register of legal acts of the Republic of Belarus, 2007, No. 109, 1/8550).

3. Expertize is carried out for the purpose of establishment of the actual security of lottery tickets from counterfeit and premature establishment of prize and compliance to their requirements imposed to the level of security of the made lottery tickets from counterfeit and premature establishment of prize, the State committee of judicial examinations or public institution "Scientific and practical center of the State committee of judicial examinations of the Republic of Belarus" (further – the contractor) on contractual basis.

4. Customer of examination is the legal entity having license for activities, connected with development and production of forms and documents, and the performing production of lottery tickets (further – the customer).

5. For conducting examination the customer represents to the contractor:

statement for conducting examination;

the copy of the specification on production of the lottery ticket with the list and the description of all elements and remedies realized in the specific lottery ticket;
