About the national social insurance
This Law determines legal, economic and organizational basis of the national social insurance of citizens and its action does not extend on voluntary social insurance.
The national social insurance is system of the types of providing insured persons guaranteed by the state when losing of earnings or the income by them owing to disease, labor mutilation or occupational disease, disability, pregnancy and childbirth, old age, unemployment, loss of the supporter, death and in other cases established by the laws of the Republic of Tajikistan at the expense of compulsory insurance premiums of employers and citizens.
The national social insurance is obligatory.
The legislation of the Republic of Tajikistan on the national social insurance is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.
In this Law the following concepts are used:
The insurer - citizens, legal entities (the company, organization, the organization and other business entity, irrespective of patterns of ownership and types of activity) and the physical persons hiring citizens according to employment contracts (contracts) including foreign legal and physical to persons, and also the international organizations performing the activities in the territory of the Republic of Tajikistan, obliged to bring according to the current legislation insurance premiums on the national social insurance.
The insurer - the legal entity performing insurance activity in the field of the national social insurance according to the current legislation.
Insured person - physical person for benefit of which the national social insurance is performed.
Insured event - accomplished fact with which approach there is obligation of the insurer to make payment to insured person or to compensate the costs incurred by it.
Insurance payment - the money payment made in case of loss occurrence, to insured person in the amount of and on the conditions established by the legislation on the national social insurance.
Insurance premium - obligatory payment on the national social insurance which the insurer shall bring to the insurer.
Rate of insurance premiums - the size of insurance premium as a percentage to the added compensation (income) on all bases or in firm sizes for separate categories of insurers.
Individual accounting - the organization and accounting of information about each insured person for the purposes of the national social insurance.
Insurance years of service - the total duration of the periods of payment of insurance premiums for insured person.
The individual accumulation settlement account - special part of individual accumulation account in which the amount of obligatory pension accruals, the income from their investment and indexation, and also payment from pension accruals is brought.
The basic principles of the national social insurance are:
general and binding character of the national social insurance and ensuring social protection of insured persons;
the state security of the reached level of social protection of insured persons;
