About the Security Council of the Republic of Kazakhstan

1. Approve:

1) Regulations on the Security Council of the Republic of Kazakhstan (appendix No. 1);

2) Structure of the Security Council of the Republic of Kazakhstan (appendix No. 2).

2. Declare invalid the Presidential decree of the Republic of Kazakhstan of November 22, 1996 No. 3237 "About the Security Council of the Republic of Kazakhstan".

3. This Decree becomes effective from the date of signing.

Regulations On the Security Council of the Republic of Kazakhstan

I. General provisions

1. The Security Council of the Republic of Kazakhstan (further - the Security Council) according to the subitem 20) of article 44 of the Constitution of the Republic of Kazakhstan is the advisory advisory body formed by the President of the Republic of Kazakhstan for development of decisions and assistance of realization by the head of state of powers on ensuring defense capability and national security, preserving the state sovereignty, independence and territorial integrity of the Republic of Kazakhstan, maintenance of socio-political stability in the country, protection of constitutional rights and freedoms of citizens.

2. The legal basis of activities of the Security Council is constituted by the Constitution and the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, the international agreements of the Republic of Kazakhstan, and also this Provision.

II. Main objectives of the Security Council

3. The main objectives of the Security Council are:

1) determination of the main directions of protection of national interests, identification, the analysis, assessment and forecasting of threats of national security, the choice of means and methods on ensuring national security of the country;

2) development of the main directions of state policy in the field of ensuring national security of the country;

3) introduction of offers and recommendations to the President of the Republic of Kazakhstan for decision making concerning domestic, foreign and military policy in the field of ensuring national security and to measures for implementation of these decisions, and also for increase in efficiency of activities of the state bodies ensuring safety of the personality, society and state;

4) preparation of recommendations about the conclusion, execution and denouncement of the international treaties of the Republic of Kazakhstan infringing on national interests.

III. Functions of the Security Council

4. According to the main objectives the following functions are assigned to the Security Council:

1) implementation of the complex analysis of development of the situation in the world and regions in relation to national interests of the Republic of Kazakhstan, identification and forecasting of emergence of sources of internal and external threats of national security, taking measures to their prevention and neutralization;

1-1) consideration and assessment of contents of strategic and program documents in the most important directions of development of the country;

1-2) coordination of activities of law enforcement agencies;

2) consideration of topical issues of providing public, military, political, economic, information, ecological safety;

2-1) preparation of operational decisions on prevention of the crisis situations connected with substantial socio-political, economic, military, ecological and other effects including recommendations about questions of subsurface use;

3) the analysis, monitoring, inspection of activities of law enforcement agencies, Armed Forces, other troops and military forming, coordination and reforming of activities of the state bodies participating in ensuring national security, introduction of offers to the President of the Republic of Kazakhstan on enhancement of these activities;

3-1) discussion of the candidates recommended for appointment to positions of the first heads of the Prosecutor General's Office, Committee of homeland security, the Ministries of Foreign Affairs, defense, internal affairs, justice, Services of foreign intelligence Syrbar, Committee on financial monitoring of the Ministry of Finance;

3-2) hearing of reports of heads of law enforcement agencies, the Armed Forces, other troops and military forming and other state bodies participating in ensuring national security;

4) preparation of the annual report to the President of the Republic of Kazakhstan about security status of the Republic of Kazakhstan as main program document for the central and local executive bodies concerning domestic, foreign and military policy in the sphere of homeland security;

4-1) consideration of the annual report of the Government of the Republic of Kazakhstan on results of activities of the central executive bodies of the country in the sphere of ensuring national security for the purpose of development of offers to the Head of state;

5) development of offers on ensuring protection of the constitutional system, the state sovereignty and territorial integrity of the Republic of Kazakhstan, preparation of drafts of decisions of the head of state concerning safety of the personality, society and the state;

6) at the request of the President of the Republic of Kazakhstan is performed by monitoring of use of strategic resources of the country;

6-1) analysis of results of control of target use of the funds of the republican budget allocated for defense, public order and safety;

7) the analysis of bills on national security issues, submission of recommendations about them to the President of the Republic of Kazakhstan;

8) control of execution of the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan, decisions of the Security Council on national security issues, introduction of offers to the President of the Republic of Kazakhstan about measures for elimination of the revealed shortcomings, the reasons and conditions promoting their origin;

8-1) organization of scientific research in the field of safety of the personality, society and the state.

IV. Structure of the Security Council and procedure for its forming

5. The President of the Security Council is the President of the Republic of Kazakhstan.
