About Agency on the state financial control and fight against corruption of the Republic of Tajikistan

1. Create Agency on the state financial control and fight against corruption of the Republic of Tajikistan.

2. Approve the Provision, Structure of Central office and the Scheme of management of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan (appendix 1, 2, 3).

3. Determine that the management of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan consists of the Director, three deputies, including one first.

4. Establish the extreme number of staff of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan in number of 479 units (without service personnel), including Central office in number of 222 units.

Perform financing of content of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan in 2007 at the expense of the means provided for the being Committee of the state financial control of the Republic of Tajikistan and Head department of tax police of the Ministry of state revenues and charges of the Republic of Tajikistan for the corresponding year.

5. Determine that the Agency on the state financial control and fight against corruption of the Republic of Tajikistan is body of financial control and law enforcement agency to whom functions of the being Committee of the state financial control of the Republic of Tajikistan, Head department of tax police of the Ministry of state revenues and charges of the Republic of Tajikistan, and also structures on fight against corruption and economic crimes of corruption nature of the Prosecutor General's Office of the Republic of Tajikistan and other law enforcement agencies of the republic are assigned.

6. The corresponding regulatory legal acts of the Republic of Tajikistan regulating activities being Committee of the state financial control of the Republic of Tajikistan, Head department of tax police of the Ministry of state revenues and charges of the Republic of Tajikistan are effective before acceptance of the corresponding regulatory legal acts of the Republic of Tajikistan regulating activities of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan.

7. To the government of the Republic of Tajikistan:

- resolve organizational, financial and material matters of the Agency on the state financial control and fight against corruption of the Republic of Tajikistan;

- perform in accordance with the established procedure acceptance and transfer of the state office buildings, transport and other appliances former Committee of the state financial control of the Republic of Tajikistan, Head department of tax police of the Ministry of state revenues and charges of the Republic of Tajikistan;

- bring the decisions into accord with this Decree;

- to submit offers on modification and amendments in the legal acts of the Republic of Tajikistan following from this Decree within two-month term.

To state paragraph two of Item 1 of Structure of the central executive bodies of the Republic of Tajikistan approved by the Presidential decree of the Republic of Tajikistan of November 30, 2006 No. 9 "About enhancement of structure of the central executive bodies of the Republic of Tajikistan" in the following edition:

"Agency on the state financial control and fight against corruption of the Republic of Tajikistan".

9. Recognize invalid:

Regulations on the Agency on the state financial control and fight against corruption of the Republic of Tajikistan

I. General provisions

1. The agency on the state financial control and fight against corruption of the Republic of Tajikistan (further - the Agency) is the authorized financial and control and law enforcement agency of the Republic of Tajikistan which is carrying out the state control of efficiency of use of public funds and property for the organization of economic safety of the state by the prevention, identification, suppression, disclosure and investigation of crimes and offenses of corruption and economic nature.

3. Competence of the Agency are:

- control of acceptance, use and storage of the state fund of the precious metals and gemstones which are component of gold and foreign exchange reserves of the state;

- check of legality and timeliness of movement of means of the government budget and the state funds in national banks and other financial credit institutions;

- control of target use of the credit resources and foreign investments attracted by the Government of the Republic of Tajikistan, National Bank of Tajikistan in coordination with the President of the Republic of Tajikistan;

- the analysis of the revealed variations from the approved indicators of the government budget and the state funds and preparation of the offers directed to their elimination;
