About additional insurance premiums for funded pension and the state support of forming of pension accruals

Article 1. Subject of regulation of this Federal Law

Article 2. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) insured person - person who voluntarily entered legal relationship on mandatory pension insurance according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation" for the purpose of payment of additional insurance premiums for funded pension;

2) the employer of the insured person paying additional insurance premiums for funded pension (further - the employer), - person which is for the specified insured person the insurer on mandatory pension insurance according to the Federal Law "About Mandatory Pension Insurance in the Russian Federation";

3) additional insurance premium for funded pension - individually paid payment paid for the account of own means insured person estimated, withheld and listed by the employer or paid by insured person independently on conditions and according to the procedure which are established by this Federal Law;

4) the state support of forming of pension accruals - the fees on joint financing of the forming of pension accruals performed by resources of the national welfare fund, formed as a part of the federal budget, and transferred to the budget of Fund of pension and social insurance of the Russian Federation for benefit of the insured person who paid additional insurance premiums for funded pension on conditions and according to the procedure which are established by this Federal Law;

5) fee of the employer - the means of the employer paid to them for benefit of insured person on conditions and according to the procedure which are established by this Federal Law.

Article 3. Legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension

1. Legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension arise based on the application for the voluntary introduction in legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension according to the procedure established by this Federal Law, except for persons who made money transfer of pension accruals in structure of means of pension reserves as one-time fee under the agreement of long-term savings according to the Federal Law of May 7, 1998 No. 75-FZ "About non-state pension funds" (further - the Federal Law "About Non-state Pension Funds") submitted by person.

2. The insured person who entered legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension and performing their payment, having the right to stop or resume payment of the specified fees, and also to determine their size.

3. The right to the funded pension created at the expense of additional insurance premiums for funded pension, fees of the employer and fees on joint financing of forming of pension accruals is implemented in case of observance of the conditions established by the Federal Law of December 28, 2013 No. 424-FZ "About funded pension" (further - the Federal Law "About Funded Pension").

Article 4. The statement for the voluntary introduction in legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension

1. The statement for the voluntary introduction in legal relationship on mandatory pension insurance for the purpose of payment of additional insurance premiums for funded pension (further also - the application) can be submitted to territorial authority of Fund of pension and social insurance of the Russian Federation personally by the citizen through the employer or through the multipurpose center of provision of the state and municipal services (further - the multipurpose center). The application can be also submitted by different way, including in electronic form which procedure for registration is determined by the Government of the Russian Federation and which moves with use of information and telecommunication networks, access to which is not limited by certain  group of people, including the single portal of the state and municipal services, at the same time identification and check of authenticity of the signature of the citizen are performed according to the procedure, determined by subitems 1 - 4 items 4 of article 32 of the Federal Law of July 24, 2002 N 111-FZ "About investment of means for financing of funded pension in the Russian Federation" (further - the Federal Law "About Investment of Means for Financing of Funded Pension in the Russian Federation").

2. Shall be specified in the statement:

1) insurance number of the individual ledger account of the citizen;

2) surname, name, citizen's middle name;

3) residence of the citizen.

3. The application form and the instruction for its filling affirm Fund of pension and social insurance of the Russian Federation.

4. The employer who received the application, in time, not exceeding three working days from the date of receipt of the statement sends it directly to territorial authority of Fund of pension and social insurance of the Russian Federation in place of registration as the insurer on mandatory pension insurance or through the multipurpose center. Employers whose number of workers for the preceding accounting period exceeds 10 people submit the received applications in territorial authority of Fund of pension and social insurance of the Russian Federation in the form of the electronic documents signed by the strengthened qualified digital signature according to the Federal Law of April 6, 2011 No. 63-FZ "About the digital signature". In the same procedure the received applications can be submitted in territorial authority of Fund of pension and social insurance of the Russian Federation by employers whose number of workers for prior calendar year constitutes 10 people less. The format of submission of the specified statement in electronic form is determined by Fund of pension and social insurance of the Russian Federation.
