About Judicial department of the Kyrgyz Republic and Training center of judges under the Supreme Court of the Kyrgyz Republic

For the purpose of proper material, financial provision of local courts of the Kyrgyz Republic and execution of court resolutions, I decide creations of single system of the organization of training and advanced training of judges:

1. Remove Judicial department under the Ministry of Justice of the Kyrgyz Republic from maintaining the Ministry of Justice of the Kyrgyz Republic and enter it into system of judicial branch of the power of the Kyrgyz Republic, having transformed to Judicial department of the Kyrgyz Republic. Assign to Judicial department of the Kyrgyz Republic of function on material logistics of local courts of the Kyrgyz Republic, National council for justice of the Kyrgyz Republic and bodies of judicial self-government, and also on execution of court and other resolutions, stipulated by the legislation. Keep the operating procedure for material logistics of public vessels of the Kyrgyz Republic.

2. Remove Training center of judges of the Kyrgyz Republic from maintaining Judicial department of the Kyrgyz Republic and enter it into system of judicial branch of the power of the Kyrgyz Republic, having transformed to Training center of judges under the Supreme Court of the Kyrgyz Republic. Determine that training and advanced training of judges, government employees of offices of courts of the Kyrgyz Republic, Judicial department of the Kyrgyz Republic, and also training of applicants for positions of judges of local courts of the Kyrgyz Republic is performed only in Training center of judges under the Supreme Court of the Kyrgyz Republic.

3. Keep behind Training center of judges under the Supreme Court of the Kyrgyz Republic, the buildings (rooms) which are earlier occupied by Judicial department of the Kyrgyz Republic and its divisions and the used property.

To the government of the Kyrgyz Republic to resolve issue of allocation of the respective building to Training center of judges under the Supreme Court of the Kyrgyz Republic which area allows to perform training of judges, workers of offices of courts, Judicial department of the Kyrgyz Republic and applicants for positions of judges of local courts, and also to provide activities of Judicial council of the Kyrgyz Republic and National council for justice of the Kyrgyz Republic or to allocate funds for construction of such building for Training center of judges of the Kyrgyz Republic.

7. To the government of the Kyrgyz Republic, the Supreme Court of the Kyrgyz Republic, Judicial department of the Kyrgyz Republic and Training center of judges under the Supreme Court of the Kyrgyz Republic to bring the decisions into accord with this Decree and to take the necessary measures following from this Decree.

8. Within the developed Concept of reforming of judicial and law enforcement agencies of the Kyrgyz Republic to consider expedient study of question of introduction of institute of bailiffs since 2010 with use of pilot project based on certain administrative and territorial units.

To the Supreme Court, Judicial department and the Government of the Kyrgyz Republic to make the approved offers on carrying out pilot project and introduction of institute of bailiffs till October 1, 2008.

12. Declare invalid the Presidential decree of the Kyrgyz Republic "About entering of amendment into the Presidential decree of the Kyrgyz Republic "About Judicial department of the Kyrgyz Republic" of July 31, 1998" of February 17, 2000 No. 33.

13. To the government of the Kyrgyz Republic in accordance with the established procedure:

- resolve the organizational, financial and other matters following from this Decree;

- bring the decisions into accord with this Decree.

14. To impose control of execution of this Decree on department of legal policy of Administration of the President of the Kyrgyz Republic.

15. This Decree becomes effective from the date of signing.
