About approval of the Regulations on procedure for forming and use of means of state non-budgetary fund of social protection of the population of the Ministry of Labour and Social Protection
According to item 4 of article 22 of the Law of the Republic of Belarus of December 26, 2007 "About the budget of the Republic of Belarus for 2008" the Council of Ministers of the Republic of Belarus DECIDES:
1. Approve the enclosed Regulations on procedure for forming and use of means of state non-budgetary fund of social protection of the population of the Ministry of Labour and Social Protection.
2. Establish in 2008:
amount of means of state non-budgetary fund of social protection of the population of the Ministry of Labour and Social Protection on forming sources according to appendix 1;
amount of use of means of state non-budgetary fund of social protection of the population of the Ministry of Labour and Social Protection in the directions according to appendix 2.
3. This resolution becomes effective since January 1, 2008.

1. This Provision developed according to item 4 of article 22 of the Law of the Republic of Belarus of December 26, 2007 "About the budget of the Republic of Belarus for 2008" (The national register of legal acts of the Republic of Belarus, 2008, No. 4, 2/1400), is established procedure for forming and use of means of state non-budgetary fund of social protection of the population of the Ministry of Labour and Social Protection (further - Fund).
2. Fund joins in the republican budget and is subject to transfer into accounts of the main State Treasury of the Ministry of Finance.
3. Fund are formed for the account:
compulsory insurance premiums of employers, the working citizens, the Belarusian republican unitary insurance enterprise Belgosstrakh for persons receiving monthly insurance payments and temporary disability benefits in connection with damage of health owing to labor accident or occupational disease;
compulsory insurance premiums of the physical persons paid by them independently;
the compulsory insurance premiums paid by the citizens of the Republic of Belarus, foreign citizens and stateless persons performing business activity;
receipts from employers of compensation amounts of expenses on pension payment to the workers occupied at works with harmful and severe conditions of work;
returns on capitalization of fund;
voluntary transfers (the free (sponsor's) aid and donations) in Fund;
other receipts (the percent paid by bank for use of money of Fund, administrative penalties, imposed by bodies of Fund, and other stipulated by the legislation receipts).
4. Fund is used on:
pension payment on age, on disability, on the occasion of loss of the supporter, for long service, rendering services in pension payment and benefits;
allowance payment on the national social insurance (due to illness and temporary disability, on pregnancy and childbirth, in connection with the child's birth, the woman who got registered in medical institution to the 12 weeks term of pregnancy on allowance payment to the families raising children on burial);
payment monthly provided according to the statement of mother who is bringing up the handicapped child aged up to 18 years, day, free from work;
pension payment to the citizens who went abroad on the permanent residence according to the legislation and international treaties of the Republic of Belarus;
rendering financial support to the needing elderly and disabled citizens;
financing of actions for employment of the population;
payment to claimants as compensation of the half-received amount of the alimony in connection with the idle time or other circumstances taking place for the reasons which are not depending on the debtor with subsequent compensation to Fund of paid amounts the employer;
financing of payments on sanatorium treatment and improvement;
financing of specialized educational sports facilities of Federation of trade unions of Belarus;
financing and material logistics of the current activities of Fund and its territorial authorities;
financing of other payments according to the legislation on the national social insurance.
Fund has purpose and is not subject to expenditure for the needs which are not provided by this Item.
Use of fund is performed through territorial authorities of the main State Treasury of the Ministry of Finance.
5. Control of correctness of charge, timeliness and completeness of payment transfer in Fund, and also behind expenditure of fund on purpose is assigned to Fund and its territorial authorities, and also the Ministry of Finance.
6. The fund which is not used in reporting year goes to expenses of Fund of the next financial (budget) year.
