About some measures for updating of fixed assets in building sector

For the purpose of creation of conditions for development of material and technical resources of building sector, updating of fixed assets of the organizations performing activities in the field of construction and the industry of construction materials:

1. Determine that from July 1, 2006 to December 31, 2010:

1.1. in the innovative fund formed by the Ministry of Architecture the increased assignments in the amount of no more 13,5 of percent from product cost, goods (works, services) received (executed) when implementing activities in the field of construction the industries of construction materials are made:

the organizations which are under authority of the Ministry of Architecture including economic societies concerning which this Ministry is authorized to manage shares (shares) in their authorized funds belonging to the state;

non-state legal entities, shares (share in authorized fund) of which are not in property of the Republic of Belarus (its administrative and territorial units), except for the organizations registered as residents of free economic zones;

1.2. in innovative funds of republican state bodies (except for the Ministries of Architecture), other state organizations subordinated to the Government of the Republic of Belarus, National academy of Sciences of Belarus assignments in the amount of, the provided in paragraph one of subitem 1.1 of this Item, the organizations which are under their authority including economic societies, shares (shares) belonging to the state in which authorized capitals they manage, performing activities in the field of construction and the industry of construction materials, not specified in subitem 1.1 of this Item are made;

1.3. contributions to innovative funds are not made:

the organizations called in subitems 1.1 and 1.2 of this Item from product cost, goods (works, services) - on objects of house construction *, constructions of garages and parkings;

the organizations when implementing activities in the field of construction regarding construction, repair and construction, and also special and installation works in the territories entering space limits of the Village Councils (except for the territories of urban settlements and the cities of district subordination), from cost of these works - in the cases established by the President of the Republic of Belarus;

1.4. funds of innovative fund Ministries of Architecture are allocated:

1.4.1. at least 70 percent - on updating of the construction site engines and mechanisms, vehicles and processing equipment including acquired on leasing production capacities of the organizations of the republic, necessary for development, performing activities in the field of construction and the industry of construction materials including debt repayment on the loans of banks attracted from the date of entry into force of this Decree on implementation of the State program of innovative development of the Republic of Belarus for 2007 - 2010 years approved by the Presidential decree of the Republic of Belarus of March 26, 2007 No. 136 (The national register of legal acts of the Republic of Belarus, 2007, No. 79, 1/8435), the State comprehensive program of development of regions, small and medium residential locations for 2007-2010 approved by the Presidential decree of the Republic of Belarus of June 7, 2007 No. 265 (The national register of legal acts of the Republic of Belarus, 2007, No. 144, 1/8650), Development programs of the glass industry of the Republic of Belarus for 2006-2010 and for the period till 2015, the Republic of Belarus approved by the Presidential decree of May 25, 2006 No. 351 (The national register of legal acts of the Republic of Belarus, 2006, No. 86, 1/7617), the State comprehensive program of development of material and technical resources of the building sector for 2006-2010 approved by the resolution of Council of Ministers of the Republic of Belarus of September 1, 2006 No. 1118 (The national register of legal acts of the Republic of Belarus, 2006, No. 145, 5/22842; 2009, No. 118, 5/29700), and payment (compensation) of percent on them:

in Belarusian rubles - at the rate to 100 percent of the refunding rate of National Bank increased no more than by 3 percent points of margin;

in foreign currency - at the rate to 100 percent of rate on the credit.

The decision on the direction of funds for debt repayment on the credits of banks, and also about payment (compensation) at the expense of means of innovative fund Ministries of Architecture of part of interest for using bank loans and determination of the size of the percent which are subject to payment (compensation) at the expense of means of this fund in accordance with the established procedure is accepted by the Ministry of Architecture;

1.4.2. on development of standard projects of buildings, engineering and transport communications and constructions, standard process charts **;

1.5. the economic societies performing activities in the field of construction and the industry of construction materials which share (share) in authorized funds are at the same time in republican and utility property except for specified in the paragraph the second subitem 1.1 of this Item make contributions to innovative funds of regional executive committees and the Minsk Gorispolkom according to the procedure and the size, determined in the paragraph the second Item 3 of this Decree.

2. The republican state bodies, other state organizations subordinated to the Government of the Republic of Belarus the National academy of Sciences of Belarus, local executive and administrative organs has the right to provide guarantees on the credits issued by banks of the Republic of Belarus to the organizations making contributions to their innovative funds on updating of the construction site engines and mechanisms, vehicles and processing equipment including acquired on leasing, capacities of the organizations, necessary for development, within means of these innovative funds.
