About electric communication
This law establishes the legal basis of regulation and management of activities in the field of creation, functioning and development of electric communication in the Republic of Tajikistan, determines powers of state bodies and regulation of this area, and also the right and obligation of the physical persons and legal entities participating in the specified activities or using services of electric communication.
Electric communication is integral part of economic and social infrastructure of the Republic of Tajikistan and functions in its territory as the interconnected production and economic complex intended for satisfaction of needs and requirements of physical persons and legal entities, state governing bodies in services of electric communication.
In this law the following basic concepts are applied:
"electric communication" - any transfer or acceptance of signs, signals, the written text, images, sounds or information of any kind on wire, radio optical or to other electromagnetic systems;
"network of electric communication" - transmission systems and the switching or route equipment and other sources which transmit signals on wire, radio, to optical or other electronic means, including the satellite networks fixed (linear and package switching, including the Internet and IP-telephony) and the mobile land networks, networks used for broadcasting and television and also cable networks, irrespective of type of the transmitted data;
"services of electric communication" - product of activities of the operator and provider for acceptance, transfer, processing of signals and other types of information through networks of electric communication;
"the terminal equipment" - the technical means or devices connected through subscriber lines or with use of wire, fiber-optic and electromagnetic devices to network of electric communication by means of which the user can transfer, transform or accept messages;
"internetwork connection" - the technological interaction between networks of electric communication of different operators of electric communication providing transfer and acceptance of information between users;
"radio the equipment" - the electric transferring or receiving equipment by means of which information transfer without any wire lines of communication is performed;
"radio-frequency range" - the set of the electromagnetic waves (radio waves with frequencies ranging from 3 kHz to 3000 GHz) extending in space without artificial wave guide, used under the organization of radio communication, radio TV and broadcastings and in other cases of transfer of electric signal without physical connections;
"means of communication" - technical devices, the equipment, constructions and systems used for forming, processing, transfer, acceptance and switching of electromagnetic or optical signals;
"the operator of network of electric communication" - the physical person or legal entity owning network of electric communication, providing it functioning, development and rendering services of electric communication;
"provider of services of electric communication" - the physical person or legal entity rendering on commercial basis services of electric communication to users through networks of operators;
"universal services" - set of the services of electric public communication provided to all categories of users including access to telephone services and telegraph, information and service desk, services of pay-on-answer coin stations public for transfer of free calls to emergency services.
"the user of services of electric communication" - the physical person or legal entity using or requesting services of electric public communication;
"the government communication network" - ad hoc network of communication which provides information transfer, containing the state secret and functions for the benefit of government in peace and wartime;
sim card" - the identification module in which memory information on services is placed, data determining the user of services of electric communication, providing provision of services of the operator of network of electric communication;
"identity documents of physical person or constituent documents of the legal entity" - the documents provided in case of connection to network of electric communication for physical person - the passport (for stateless persons - registration leaf) and for legal entities - the certificate on state registration;
"numbering system" - procedure for distribution and assignment of numbering (combination of digits or signs) between operators, providers and the terminal equipment of users;
