Regulations on procedure for providing with public welfare payments

This Provision is developed according to the Law of Turkmenistan "About public welfare payments" and determines general rules and procedure for providing with public welfare payments (benefits hereinafter are referred to as further).

General provisions

1. Allowances are granted to citizens of Turkmenistan, foreign persons and stateless persons (citizens hereinafter are referred to as further) in the presence of the corresponding bases established by the Law of Turkmenistan "About public welfare payments" for each type of benefits.

2. The request for purpose of benefit is made by person having the right to its obtaining, is direct in social welfare institution at the place of residence, and in appropriate cases is direct in administration of the company, the organization, organization on place of employment, for the serviceman, face of the commanding and ordinary structure of law-enforcement bodies - on the duty station.

If person having the right to benefit is minor or incapacitated, the request for its appointment is made by his parents or the guardian.

Day of the request for benefit day of acceptance by territorial authority of social security (the etrap, the city) statements for purpose of benefit with all necessary documents is considered.

6. In case of documents acceptance territorial authority of social security:

b) performs check of reliability and justification of issue of the submitted documents in need cases. At the same time the territorial authority of social security has the right to demand from legal entities and physical persons of representation in appropriate cases of additional documents.

7. Recalculation of benefit, the translation from one type of benefit for another, renewal of payment of earlier granted allowance are made by territorial authority of social security in coordination with the Ministry of Social Welfare of Turkmenistan no later than in two weeks.

8. The decision on purpose of benefit is made no later than monthly term from the date of adoption of documents by territorial authority of social security. In case of refusal in purpose of benefit the territorial authority of social security in writing informs on it addressed for benefit with indication of cause of failure and procedure for appeal, at the same time returning all documents.

9. The statement for purpose of benefit with all the submitted documents, and also the decision on its appointment is stored in territorial authority of social security.

10. Document forms for purpose of benefit, the rule on their filling, the instruction about procedure for registration and business management on persons receiving benefits affirm the Ministry of Social Welfare of Turkmenistan.

11. When moving on the permanent residence to other area within Turkmenistan the case which is drawn up on the receiver of benefit is sent to social welfare institution at the new place of residence.

The territorial authority of social security according to the written application of the receiver of benefit about its departure for the permanent residence out of limits of Turkmenistan returns the case which is drawn up on the receiver with the corresponding mark about it.

Documents necessary for purpose of benefits

12. The disability leaf, and in case of it uteridublikat, issued by medical institution shall be enclosed to the application for purpose of maternity allowance.

13. The copy of the certificate of birth of the child, the reference from the residence of parents shall be enclosed to the application for purpose of child care allowance.

14. The basis for purpose of temporary disability benefit is the disability leaf issued by medical institution.

The list of diseases and cases for issue of leaf of disability is established by the Ministry of Health and the Medical Industry of Turkmenistan.

15. The act of survey by medico-social commission of experts (MSEK hereinafter is referred to as further) and form No. 88 shall be enclosed to the application for purpose of disability benefit.

In necessary cases are represented:

the documents confirming length of service, length of service on military service, service in law-enforcement bodies;

certificate of the salary, income, cash allowance;

the act of accident owing to general disease, labor mutilation (injury) or occupational disease;

the certificate of stay dependent on the face of disabled family members which addressed for benefit;

the certificate of recognition of person needing foreign leaving;

certificate of the disabled veteran;

the document, confirmatory that the person in need in benefit was unreasonably repressed and is rehabilitated subsequently;

the document certifying that person is participant of mitigation of consequences of radiation accidents and catastrophic crashes;

act of survey of removal or change of group of disability.

16. On loss of the supporter shall be enclosed to the application for purpose of benefit:

the death certificate of the supporter or the document certifying unknown absence of the supporter;

the certificate of birth or passport forming the basis of the certificate of age of person on which the allowance is granted;

the document confirming the related relations of family members with the died supporter. As the document confirming the related relations the passport, the certificate of birth, the marriage certficate, certificates of housing bodies (local government bodies) of family composition, and in the established cases - the judgment are accepted;

the reference of housing bodies (local government bodies) on the family members who were dependent on the supporter.
