Procedure for determination of authorized organizations in the field of protection of the courts floating under National flag of the Russian Federation, and port means

I. General provisions

1. The procedure for determination of authorized organizations in the field of protection of the courts floating under National flag of the Russian Federation, and port means is developed in pursuance of the order of the Government of the Russian Federation of November 03, 2007 N 746 "About realization of provisions of Chapter XI-2 of the International convention on protection of human life at the sea of 1974 and the International code on protection of courts and port means".*

This Procedure is applied in case of determination of authorized organizations in the field of protection of the courts floating under National flag of the Russian Federation, and port means (the daleeupolnomochenny organizations) and determines general requirements to the procedure of such determination.

3. The body determining authorized organizations is the Federal Agency for Sea and Inland Water Transport (Rosmorrechflot).

II. Purpose of determination of authorized organizations

Main objective of determination of authorized organizations is establishment of capability of the legal entity who addressed to Rosmorrechflot for the purpose of its determination as authorized organization (further - the applicant), to carry out in full the assumed liabilities on accomplishment of the following works:

1) evaluating protection and plan development of protection of courts, port means;

2) implementation of consulting services in the field of protection of courts, port means;

3) support of the constituted valuation reports of protection and developed plans of protection of courts, port means for the purpose of their maintenance at the modern level;

4) development of engineering designs of retrofitting of courts, port means technical means of protection;

5) construction and commissioning, guarantee and field service of technical means of protection of courts and port means.

III. Criteria of determination of authorized organizations

5. Can act the Russian legal entities who as applicants:

1) have properly prepared personnel capable to provide high-quality performance of works, performed by authorized organization, on the corresponding types of activity;

2) have the staticized fund of the regulating, organizational and administrative, fabrication and operating documentation;

Licenses of federal executive bodies for the types of activity necessary in case of performance of works in the declared area have 3);

4) were implemented and certified the quality management system conforming to requirements of international standards of quality;

5) at least three years have work experience in the declared area in the field of transport complex of the Russian Federation.

6. Competence of the applicant is checked in the relation:

1) regulations and rules to which there shall correspond the vessels floating under National flag of the Russian Federation and port means;

2) ship and docks operations, including knowledge of design and the structure of courts and managerial aspects of work of business entities;

3) organizations of assessment works of protection, development and implementation of plans of protection of courts and port means;

4) knowledge and observance of regulations and rules of preparation of reporting documents.

7. The applicant provides:

1) comprehensive control of activities of the personnel;

2) confidentiality obtained yielded both results of works and prevention of unauthorized access to them;

3) compliance of qualification, experience and number of employees of the organization to amount of planned activities and number of customers.

IV. Determination of authorized organization

8. The applicant gives to the federal state institution subordinated to Rosmorrechflot specializing in area of transport safety and protection (further - organization) determined by it for consideration of requests and issue of the document (certificate) confirming compliance of the organization to requirements imposed to authorized organizations, the request in which the following shall be reflected:

the declared work types (services);

availability of branches in regions of the Russian Federation;

availability of the certified quality management system;

information on LOC ARM to acceptance of the commission of organization for expert evaluation of compliance of the applicant to requirements imposed to authorized organization with registration of the corresponding civil relations;

legal and bank details of the organization.

9. The following documents are attached to the request:

the copies of constituent documents certified in accordance with the established procedure;

the list of objects on which earlier the applicant carried out works in the field of protection;

structure raised for performance of works of forces and funds;

the documents confirming qualification of personnel;

the set of documents including copies of licenses, certificates, diplomas, the expert and scientific opinions, certificates;

other documents concerning the declared works (services) which can confirm competence of the applicant.

V. Procedure for consideration of the request and the enclosed documents

10. Works on determination of authorized organization include the following stages:

consideration of the request and decision making about further examination of documents of the applicant or about refusal in it;

conducting examination of documents of the applicant;

assessment of conformity of the applicant to requirements imposed to authorized organization;

decision making about registration and issue of the certificate of authorized organization or refusal in it.
