Regulations on Association of the food industry

1. The association of the food industry (the Association is referred to as) is state body the companies of the food and meat-and-milk industry, and also other companies and the organizations which are part of Association.

The companies and the organizations which are part of Association have rights of the legal entity and keep economic independence.

2. The association submits directly to the Cabinet of Ministers of Turkmenistan and performs the activities according to the Constitution of Turkmenistan, the laws of Turkmenistan, acts of the President of Turkmenistan, decisions of the Cabinet of Ministers of Turkmenistan, other regulatory legal acts and this Provision.

3. The main objectives of Association are:

development and realization of the main directions of development of industries of the food and meat-and-milk industry;

providing population of the country with meat-and-milk, confectionery, fat-and-oil, beer and soft drinks and wineproducing products;

saturation of the consumer market self-produced food;

effective use of potential production, labor, material and financial resources;

implementation in production of the new equipment and the technologies providing production, conforming to the international standards;

protection of state interests and safety of the country in providing with the food entering the nomenclature of Association;

determination of the priority directions of investment policy and forecasting of perspectives of development of industries of the food and meat-and-milk industry;

production of high-quality provisions and providing gain in productivity of work;

forming and expansion of the markets of the made products;

implementation of step-by-step reforming of the companies of the food and meat-and-milk industry.

4. According to the tasks assigned to it the Association performs the following functions:

develops and performs the measures directed to increase in providing the country with food;

provides enhancement of the production technology, develops industry standards and specifications, and also other specifications and technical documentation, compounding, technical and technology instructions, implements new types of products from local raw materials;

enhances form of business of functioning of jurisdictional enterprises;

develops and performs complex measures for rational use and deep conversion of raw materials and materials, and also implementation of wasteless technologies;

carries out work on attraction of foreign and domestic investments to construction new, modernization of operating plants;

coordinates activities of jurisdictional enterprises for accomplishment of production programs, creates favorable conditions for their effective work;

performs price policy proceeding from the developing environment and demand of the consumer market and provides control of respect of discipline of the prices by jurisdictional enterprises;

creates safety stocks of provisions for secured provision of the population;

exercises the state licensing and control of the production of meat-and-milk, fat-and-oil, beer and soft drinks and confectionery products, and also alcohol and other alcoholic products performed by the companies and the organizations irrespective of their forms of business, including with participation of foreign investors;

constitutes the state departmental register for accounting of the companies and organizations performing alcohol import, and also production of alcohol and alcoholic products;

gives to jurisdictional enterprises financial and legal support, consulting and methodical services;

participates together with other ministries and departments in development of offers on the main directions economic and sci-tech cooperation with foreign countries;

determines personnel policy in industry, will organize advanced training of specialists;

performs foreign economic activity according to the legislation of Turkmenistan;

develops and performs the measures directed to growth in volumes of production export-oriented products on the basis of studying of world market conjuncture;

develops strategy of reforming of industries of the food and meat-and-milk industry;

performs other activities which are corresponding to tasks of Association, not contradicting the legislation of Turkmenistan.

5. The association for accomplishment of the tasks assigned to it has the right:

bring suggestions for improvement of legal and economic conditions of production economic activity of the companies of the food and meat-and-milk industry in the supreme legislative and executive bodies of Turkmenistan;

coordinate and control activities of jurisdictional enterprises;

represent the interests of jurisdictional enterprises in the supreme bodies of the executive authority, the international organizations, associations and the unions;

in coordination with higher body to attract investments of domestic and foreign entrepreneurs for the solution of priorities in industries of the food and meat-and-milk industry; enhance form of business of functioning of jurisdictional enterprises;

create network of corporate shops of retail and wholesale trade, public catering for sales of products of own production;

organize subsidiary farms;

accept on voluntary basis in coordination with the Cabinet of Ministers of Turkmenistan in structure of Association of the company and organization, irrespective of patterns of ownership, turning out food and meat-and-milk products, interested in joint activities;

perform in accordance with the established procedure foreign economic activity.

6. The association is headed by the Chairman appointed to position and dismissed to Presidents of Turkmenistan.

The chairman of Association has the deputies appointed to position and dismissed by the President of Turkmenistan.

Distribution of obligations between deputies is made by the Chairman of Association.

7. Chairman of Association:

performs in accordance with the established procedure management of activities of central office of Association and jurisdictional enterprises;

bears the personal responsibility for accomplishment of the tasks assigned to Association;

appoints to position and dismisses employees of central office of Association, heads of jurisdictional enterprises;

acts on behalf of Association, represents its interests in bodies of the state and executive authority, in the organizations, the companies, organizations, and also in the international organizations;

signs agreements, agreements and other documents on behalf of Association;

introduces in accordance with the established procedure in the Cabinet of Ministers of Turkmenistan for consideration drafts of legal acts on the questions entering competence of Associations;
