Approve the enclosed Rules of determination of limits of the check point through frontier of the Russian Federation.

Rules of determination of limits of the check point through frontier of the Russian Federation

1. These rules establish procedure for determination of limits of the check point through frontier of the Russian Federation (further - the check point).

2. Limits of the check point are understood as borders of the territory (water area) within the railway, automobile station or the station, sea, river (lake) port, the airport (airfield), military airfield open for the international messages (the international flights), and also specially allocated in close proximity to frontier of the site of the area where the omission through frontier of the Russian Federation of persons, vehicles, freights, goods and animals is in accordance with the legislation of the Russian Federation performed.

The territory (water area) of the check point established within sea, river (lake) port, the railway station or the airport can consist of one or several certain sites.

3. Limits of the check point cannot go beyond (border) of the territory of the railway, automobile station or the station, the airport (airfield), military airfield, the territory and the water area of sea, river (lake) port.

4. Limits of the check point join specially equipped sites of the territory, the building, construction and certain rooms (part of rooms), and in sea, river (lake) ports also of the water area necessary for implementation boundary, customs and other types of control.

5. Limits of the check point are determined on the basis of the land management and project documentation approved in accordance with the established procedure on construction (reconstruction), the equipment and hardware of the buildings, constructions and rooms necessary for implementation boundary, customs and other types of control.

6. Check point limits on the site of the area which is specially allocated in close proximity to frontier of the Russian Federation are determined in borders of this site on the basis of data of the state cadastral registration.

7. For determination of geographical coordinates of limits of the check point geodetic measurements and reconciliation of results of measurements with data of the land management and project documentation on construction (reconstruction), the equipment and hardware of the buildings and constructions necessary for implementation boundary, customs and other types of control, or data of the state cadastral registration are taken.

Work on carrying out geodetic measurements will be organized and controlled by the Ministry of Transport of the Russian Federation.

If limits of the check point include necessary for implementation boundary, customs and other types of control certain rooms (part of rooms), limits of the check point are determined based on the project documentation on construction (reconstruction), the equipment and hardware of the respective buildings and constructions.

8. The description of limits of the check point (including geographical coordinates) is provided in the act of the commission on determination of limits of the check point.

The commission is created by the Ministry of Transport of the Russian Federation.

Representatives of the Ministry of Transport of the Russian Federation, federal executive bodies are part of the commission, authorized to exercise control at check points, and also the Ministries of Defence of the Russian Federation if the check point is in limits of the territory of military airfield.

Results of work of the commission are drawn up by the act which is signed by members of the commission.

Graphical representations of limits of the check point with indication of certain sites of the territory (water area) of the check point in the scale allowing to display them on leaf of the A3 format are applied to the act of the commission.

9.
