About approval of the Concept of reforming of the salary in the Republic of Tajikistan

(as amended of the Order of the Government of the Republic of Tajikistan of 31.12.2014 No. 794)

According to article 16 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" and article 6 of the Law of the Republic of Tajikistan "About the state forecasts, concepts and programs of social and economic development of the Republic of Tajikistan", the Government of the Republic of Tajikistan decides:

1. Approve the Concept of reforming of the salary in the Republic of Tajikistan it (is applied).

2. To the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan together with the Ministry of Finance of the Republic of Tajikistan, the Ministry of Economic Development and Trade of the Republic of Tajikistan within the means which are annually provided in the Government budget to take necessary measures for implementation of the Concept of reforming of the salary in the Republic of Tajikistan.

3. To the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan to develop and approve the actions plan on implementation of the Concept of reforming of the salary in the Republic of Tajikistan and to perform coordination of activities of the ministries and departments in this direction.

The concept of reforming of the salary in the Republic of Tajikistan

Introduction

Need of adoption of the Concept of reforming of the salary in the Republic of Tajikistan (further - the Concept) is caused by the fact that in the conditions of market economy various patterns of ownership on means of production which require use of the corresponding systems of the organization of compensation of workers, introduction of uniform approach to creation of the mechanism of regulation of system of the organization and compensation in the conditions of the market economy, determination of the real salary level, strengthening stimulating it, regulating and social functions are created.

In the period of the market relations the role of the state in the field of regulation of compensation comes down, generally to establishment of the minimum wages guaranteeing normal reproduction of labor power according to quantity and quality of the spent work, to fiscal regulation and general procedure for wages indexation, providing guarantees stipulated by the legislation, agreements, collective agreements.

This Concept is based on the analysis of the developed tendencies of stabilization of macroeconomic situation, the experience of management accumulated by the state apparatus during transition period and designed to determine the purposes, specific objectives and terms of realization of advanced system of the organization of compensation of workers of all industries of economy of the Republic of Tajikistan.

1. Current status of system of the organization of compensation in the Republic of Tajikistan

Sew the main fundamental legislative document stranykonstitution of the Republic of Tajikistan - incorporates Articles, completely and to quite definitely devoted work including compensations in the country. The labor code of the Republic of Tajikistan - accurately creates all basic provisions about work and is the main document on legal regulation of employment relationships in the Republic of Tajikistan.

For regulation of compensation of workers (especially workers of the budget sphere) the resolution of Council of Ministers of the Republic of Tajikistan of September 21, 1993 No. 487 entered the Single scale of charges on compensation and it is basis of tariff system. It represents tariffing scale from 18 job grades and compensation of all employee categories from the working category to heads of the organization. However compensation of employees of state-financed organizations is regulated by separate and corresponding presidential decrees of the Republic of Tajikistan and the orders of the Government of the Republic of Tajikistan in recent years.

Compensation of workers not of the budget sphere is determined by the owner of the company, within industry agreements, collective agreements and employment contracts (contracts), and regulated by the operating system of the taxation on profit (income) of the company.

In the conditions of transition to market economy and expansion of the rights of the organization in the field of compensation the sizes of rates (salaries), systems of awarding and condition of payment of remunerations (bonuses) are for long service determined in the collective agreement.

Higher amount of payment, than provided in collective agreements can be provided in employment contracts. The specific amount of incentive payments is determined by the employer by results of work of the worker.
