I. General provisions

1.1. The procedure for carrying out and condition of tender on selection of the organizer of the biddings on investment attraction concerning the real estate units which are in federal property (further hereinafter is referred to as - tender) who is carried out by the initiator of the project who is not the receiver of budgetary funds for the purpose of the conclusion with the winner of the service provision agreement on the organization and holding the auction on the right of the conclusion of the investment agreement are hereby determined.

1.2. The tender on selection of the organizer of the biddings on investment attraction concerning the real estate units which are in federal property which is carried out by the initiator of the project who is the receiver of budgetary funds for the purpose of the conclusion with the winner of the service provision agreement on the organization and holding the auction on the right of the conclusion of the investment agreement is performed according to the procedure and on the conditions determined by the legislation of the Russian Federation on order placement.

II. Commission on selection of the organizer of the biddings

2.1. For carrying out tender by the initiator of the project the contest committee on selection of the organizer of the biddings (further imenuyetsyakomissiya) as a part of at least 5 people, including the head of the initiator of the project who is commission chairman is created and approves regulations of the commission.

The commission is created within 3 working days after receipt of the copy of the order of Federal Agency for State Property Management by the initiator of the project about coordination of the conclusion of the investment agreement.

2.2. The commission performs the following functions:

a) establishes requirements to participants of tender;

b) considers requests of applicants for participation in tender with the documents attached to them;

2.3. Commission sessions are competent if at them there are at least four members of the commission.

Members of the commission shall be timely notified by the initiator of the project on the place, date and time of carrying out commission session.

The commission chairman conducts commission session and declares the winner of tender.

Decisions of the commission are made by a simple majority vote the members of the commission who are present at meeting. In case of equality of votes the voice of the commission chairman is decisive. During the vote each member of the commission has one voice.

Decisions of the commission are drawn up by protocols which are signed by all members of the commission who participated in meeting.

III. Information support of carrying out tender

3.1. The notice shall be published by the initiator of the project in the official printing publication of the subject of the Russian Federation in the place of state registration of the initiator of the project as the legal entity in whom addresses of the official sites in Internet network where the tender documentation is placed shall be also specified, and is posted on the official site of Federal Agency for State Property Management in Internet network. According to the decision of the commission information on carrying out tender can be also placed in other mass media.

The notice shall be published at least in 30 days prior to day of opening of envelopes with bids.

3.2. The notice on carrying out tender shall contain the following data:

b) the commitment form and the list of the documents attached to the request and requirements to their registration;

c) procedure, place, start date and end date of submission due date of bids;

e) the place, procedure, date and time of opening of envelopes with bids;

e) evaluation procedure and comparisons of bids, summing up tender;

3.3. The data specified in the notice on carrying out tender shall correspond to the data containing in the tender documentation coordinated and approved according to Item 4.1 of this Procedure.

IV. Contents of the tender documentation

4.1. The tender documentation developed by the initiator of the project affirms the commission within 5 working days after forming of the commission.

4.2. The tender documentation shall contain:

a) requirements to content, form and structure of the bid and instruction for its filling;

b) procedure, place, start date and end date of term of order taking for participation in tender. At the same time start date of term of order taking for participation in tender is the day following behind day of publication in the official printing publication or placements on the official site of the notice on carrying out tender;

c) the requirements to participants of tender established according to the Section V of this Procedure;

d) procedure and term of withdrawal of bids, procedure for modification of such requests;

e) procedure, start date and end date of term of provision to applicants for participation in tender of explanations of provisions of the tender documentation;
