Approve the Procedure for use in 2008 for the means provided in the government budget for provision of housing for citizens who suffered as a result of the Chernobyl catastrophic crash which is applied.

Procedure for use in 2008 of the means provided in the government budget for provision of housing for citizens who suffered as a result of the Chernobyl catastrophic crash

1. This Procedure determines use mechanism in 2008 of the means provided by the Ministry of Emergency Situations according to the budget program "Provision of Housing for Citizens Who Suffered as a result of the Chernobyl Catastrophic Crash" (further - budgetary funds).

2. The main manager of budgetary funds is the Ministry of Emergency Situations, managers of budgetary funds of the lowest level are head departments (management) of the Ministry of Emergency Situations in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations according to the distribution approved by the Ministry of Emergency Situations (dalsherasporyaditel).

Distribution of budgetary funds is performed taking into account the number of citizens who suffered as a result of the Chernobyl catastrophic crash and are on accounting of citizens who need improvement of housing conditions (room accounting), agrees the given Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations this.

3. Budgetary funds are allocated on:

completion of construction of housing on the terms of share participation;

acquisition of housing in the secondary market;

expense recovery, connected with independent acquisition (construction, completion) of housing, including in housing cooperative (citizens who move in the directions from the territories which underwent to radioactive pollution as a result of the Chernobyl accident).

4. At the expense of budgetary funds provision of housing for citizens who suffered as a result of the Chernobyl catastrophic crash (first of all settled out from zone of unconditional (obligatory) settling out), improvement of housing conditions of disabled people concerning whom the causal relationship of disability is established with the Chernobyl catastrophic crash for families with children who are disabled people as a result of the Chernobyl catastrophic crash is performed within the regulations established by the legislation and need special leaving.

5. Completion of construction of housing on the terms of share participation and acquisition of housing in the market at the expense of budgetary funds are performed according to the Law of Ukraine "About purchase of goods, works and services for public funds".

The cost of housing is determined by results of carrying out the tender proceeding from the smallest price which developed in the region, but not above the mediate cost of construction of housing determined by Minregionstroy (for Kiev - the mediate cost of construction of housing increased in time 2,5; of Sevastopol, regional centers, cities of Kiev region and cities of the Autonomous Republic of the Krymoposredstvovanny cost of construction of housing increased twice).

During determination of total cost of the acquired housing the expenses connected with renewal of the property right and payment of stipulated by the legislation taxes and fees (obligatory payments) are considered.

6. The expenses connected with independent acquisition (construction, completion) of housing including in housing cooperative, are compensated by managers to citizens taking into account its area and within the regulations established by the legislation according to actual expenses, but not above the mediate cost of construction of housing, by money transfer into the accounts of citizens opened in banks which suffered as a result of the Chernobyl catastrophic crash, or into accounts of housing cooperatives based on the reference characteristic of bureau of technical inventory count, the act of introduction of housing in operation, the agreement of purchase sale of housing or the agreement on construction of housing or participation in housing cooperative.

7. Managers perform expenses at the expense of budgetary funds based on the relevant documents (agreements on housing construction, the agreement of purchase sale of housing and (or) the service provision agreement on purchase sale of housing, the certificate of payment of fees in housing cooperative) according to the Procedure for servicing of the government budget on expenses approved by the State Treasury.

8. Managers perform monitoring of level of provision of housing for citizens who suffered as a result of the Chernobyl catastrophic crash, by results of which the Ministry of Emergency Situations quarterly submits to the Ministry of Finance information on use of budgetary funds and condition of provision of housing for the marked-out citizens by regions.

9. Creation and provision of the financial reporting about use of budgetary funds, and also control of their target and effective expenditure is performed in the procedure established by the legislation.
