Based on part (2) article 49 of the Law on social integration of persons with restrictions of opportunities No. 60 of March 30, 2012, and also for the purpose of strengthening of measures for social protection of persons with limited opportunities of the musculoskeletal device Government DECIDES:  

1. Approve Regulations on procedure for assignment and payment of annual compensation for expenses to transport servicing of persons with limited opportunities of the musculoskeletal device according to appendix No. 1.

2. To impose control over the implementation of this resolution on the Ministry of Labour, Social Protection and Family.

3. Recognize invalid some orders of the Government according to appendix No. 2.

4. This resolution becomes effective on January 1, 2008.

Appendix No. 1

to the Order of the Government of the Republic of Moldova of November 21, 2007 No. 1268

Regulations on procedure for assignment and payment of annual compensation for expenses to transport servicing of persons with limited opportunities of the musculoskeletal device

I. General provisions

1. In this provision the used concepts mean the following:

annual compensation for expenses on transport servicing - annual money payment for compensation for expenses on transport servicing of persons with limited opportunities of the musculoskeletal device;

person with limited opportunities of the musculoskeletal device - person with the limited functional activities caused by some defects of the musculoskeletal device of physical nature connected with the state of health which requires the special public assistance and protection from the state. These violations, conditions or diseases in character are constants, influence working capacity of this category of citizens and are expressed in loss or restriction of opportunity to move on an equal basis with other citizens.

II. Categories of receivers

2. Compensation is paid based on the conclusion of the National consultation of establishment of restriction of opportunities and working capacity or its structure to the following categories of persons with restrictions of opportunities of the musculoskeletal device:

a) to persons with restrictions of opportunities as a result of war and to persons equated to them;

b) to persons with restrictions of opportunities in connection with inborn disease or disease since the childhood;

c) to persons with restrictions of opportunities in connection with labor accident or in connection with occupational disease;

d) to persons with restrictions of opportunities in connection with general disease;

e) to children with restrictions of opportunities aged to 18 years.

In case of issue of the conclusion to the categories of persons stated above the diseases of the musculoskeletal device provided in appendix No. 3 to this Provision will be considered.

III. Conditions of purpose of compensation

3. Compensations to persons specified in Item 2 this provision are established based on the application submitted to departments/managements of social security and protection of family at the place of residence.

4. Copies of the following documents are enclosed to the application for establishment of compensation:

a) the identity certificate (passport) or the certificate of birth (for handicapped children aged up to 18 years);

b) certificate;

c) the certificate of restriction of opportunities and working capacity issued by the National consultation of establishment of restriction of opportunities and working capacity or its structures;

d) the conclusion of the National consultation of establishment of restriction of opportunities and working capacity or its structures about need of transport servicing of person with restrictions of opportunities of the musculoskeletal device.

5. In case of establishment of annual compensation of departments/management of social security and protection of family take into account document package from the personal records of receivers submitted by the Ministry of Labour, Social Protection and Family and update them as necessary.

6. Persons who for the first time addressed for establishment of annual compensation represent all document package, specified in item 4 of this provision, and departments/management of social security and protection of family in turn constitute personal records of receivers.

IV. Amount of compensation

7. Annual compensation for expenses on transport servicing of persons with limited opportunities of the musculoskeletal device specified in Item 2 this provision is established in the amount of 800 lei.

V. Compensation payment procedure

8. In case of the right to annual compensation it is appointed since month in which there was this right, on condition of submission of necessary documents within three months from the date of emergence of the specified right. Otherwise compensation is appointed since month of submission of necessary documents. The amount of compensation is established in proportion to number of complete months until the end of the year since month in which there was this right or necessary documents were respectively submitted.

In case of loss of the right to annual compensation its payment stops since January 1 of the next year.
