"About rules of goods origin" (Monitorul Oficial al Republicii Moldova, 2002, N 174-176, Art. 1755), according to Regulations (CEE) of the commission N 2454/1993 of July 2, 1993 about provisions on application of regulations (CEE) N 2913/92 of Council on establishment of the Customs code of community, Regulations (CE) N 55/2008 of Council of January 21, 2008 for introduction of autonomous preferences for the Republic of Moldova and on change of Regulations (CE) N 980/2005 and the Decision 2005/924/EU commissions ORDER:

1. Approve Regulations on filling, the certificate and issue of certificates of origin for the goods exported from the Republic of Moldova within prefential trade regimes with the European Union (Pacific Rim) and the states providing to the Republic of Moldova the General Preferential system (GSP) according to appendix.

2. To assign execution of this order to chiefs of customs.

3. To impose control of execution of this order on management of customs and tariff regulation, management of customs procedures, management of finance and logistics and management of information flows and customs statistics.

4. Declare invalid the Order of Customs Service N 226-O of July 2, 2006 (Monitorul Oficial al Republicii Moldova, 2006, N 98-101, Art. 353).

5. This order becomes effective since March 1, 2008.

Regulations on filling, the certificate and issue of certificates of origin of the goods exported within prefential trade regimes with the European Union (ATP) and the states which provide to the Republic of Moldova the General Preferential system (GSP)

I. General provisions

1. This provision is developed according to provisions of the existing regulations of the Republic of Moldova and world situations which regulate the procedure of filling, the certificate and issue of certificates of movement of goods EUR.1 and certificates of origin of goods of the Form A.

2. Customs authorities will certify goods origin according to provisions of Regulations (CE) N 55/2008 of Council of January 21, 2008 for introduction of autonomous preferences for the Republic of Moldova and on change of Regulations (CE) N 980/2005 and the Decision 2005/924/EU commissions and issue certificates of movement of goods EUR.1 (appendix No. 1).

3. Customs authorities will certify origin of the exported goods to the states which are not members of the European Union, and provide to the Republic of Moldova the General Preferential system and issue certificates of origin of goods of the Form A (appendix No. 2).

4. The certificate of movement of goods EUR.1 - the supporting document unambiguously testimonial of the country of goods' origin, exported to the states of the European Union within the Autonomous Trade Preferences provided to the Republic of Moldova according to provisions of Regulations (CE) N 55/2008 of Council of January 21, 2008 for introduction of autonomous preferences for the Republic of Moldova and on change of Regulations (CE) N 980/2005 and the Decision 2005/924/EU commissions.

5. The certificate of origin of goods of the Form A - the supporting document which is unambiguously confirming the country of goods' origin, exported to the states which are not members of the European Union and provide to the Republic of Moldova the General Preferential system.

6. The certificate of movement of goods EUR.1 makes sure and issued according to provisions of Regulations (CE) N 55/2008 of Council of January 21, 2008 for introduction of autonomous preferences for the Republic of Moldova and on change of Regulations (CE) N 980/2005 and the Decision 2005/924/EU commissions for goods which correspond to the rules of goods origin established by Regulations of the commission (EU) N 2454/1993 of July 2, 1993 concerning regulations of application of regulation (SEE) of N 2913/92 Council of establishment of the Customs code of community.

7. The certificate of origin of the Form A makes sure and issued only in cases when goods fall under the type of goods included in prefential treatment according to the General Preferential system are exported to the state which provides to the Republic of Moldova the corresponding preferential system and which correspond to the criteria of origin established according to normative provisions of the mentioned states.

8. Certificates of movement of goods EUR.1 and certificates of origin of goods of the Form A are issued only for the goods coming from the Republic of Moldova on condition of their direct delivery to the states of the European Union and according to the states which provide to the Republic of Moldova the General Preferential system.

9. The certificate of certificates of origin of the goods specified in items 4 both 5 these regulations, and their issue are made by the authorized staff of competent customs authorities (appendix N 3) for the region of commodity export.

10. The forms of certificates of origin specified in items 4 and the 5th this provision are documents with particular treatment which are stored in the places which are specially established for this purpose.

11. Issue of forms of certificates of origin of the goods (blank) specified in item 4 and the 5th this provision to the exporter is made for filling for a fee according to appendix No. 2 to the Law N 1380-XIII of November 20, 1997. "About customs tariff" with maintaining register in which numbers of forms of certificates, data on the exporter, date of issue, the sign and seal of the exporter and person who issues the form are specified.
