RESOLUTION OF BOARD OF THE PENSION FUND OF UKRAINE

About approval of the Procedure for provision of documents for appointment (recalculation) and payment of monthly perpetual monetary pay to judges in resignation of the Pension fund of Ukraine by territorial authorities

According to article 138 of the Law of Ukraine "About judicial system and the status of judges", Items 9, 11 Regulations on the Pension fund of Ukraine, No. approved by the Presidential decree of Ukraine of April 06, 2011 384, the board of the Pension fund of Ukraine DECIDES:

1. Approve the Procedure for provision of documents for appointment and payment of monthly perpetual monetary pay to judges in resignation of the Pension fund of Ukraine by territorial authorities which is applied.

2. To legal management (Ryabtseva T. B.) submit this resolution for state registration to the Ministry of Justice of Ukraine.

3. To impose control of execution of this resolution on the First Deputy Chairman of the board V. O. Kravchuk.

Procedure for submission of documents for appointment (recalculation) and payment of monthly perpetual monetary pay of the judge in resignation, judges of the Constitutional Court of Ukraine territorial authorities of the Pension fund of Ukraine

I. Request for purpose of monthly perpetual monetary pay

1. Judges in resignation, including judges of the Constitutional Court of Ukraine in resignation, judges of the Constitutional Court of Ukraine whose powers are stopped on the bases established by Items 1, 2 parts one of article 149-1 of the Constitution of Ukraine or who are dismissed on the bases established by Items 1, 4 parts two of article 149-1 of the Constitution of Ukraine in the presence of the length of service granting the right to resignation (further - the judge of the Constitutional Court of Ukraine) monthly perpetual monetary pay is appointed.

2. The statement for appointment/recalculation of monthly perpetual monetary pay (appendix 1) moves in territorial authority of the Pension fund of Ukraine (further - the body appointing monthly perpetual monetary pay) the judge personally or through the authorized person of court on the last place of employment.

For incapacitated persons, persons whose capacity to act is limited the application is submitted by legal representatives.

The statement for appointment/recalculation of monthly perpetual monetary pay moves in the body appointing monthly perpetual monetary pay through the structural division performing acceptance and servicing of persons (the service center), or the web portal of electronic services of the Pension fund of Ukraine (further - the web portal), or means of the single state web portal of electronic services (further - the Action Portal) with use by the judge of the digital signature which is based on the qualified digital signature certificate together with the scanned copies of documents which correspond to originals of documents and are suitable for perception of their content (shall contain the accurate image of complete structure of the text of the document and its details).

The address through the web portal or means of the Action Portal is performed according to Regulations on the organization of acceptance and servicing of persons addressing to bodies of the Pension fund of Ukraine, the approved resolution of Board of the Pension fund of Ukraine of July 30, 2015 No. 13-1, registered in the Ministry of Justice of Ukraine on August 18, 2015 at No. 991/27436.

In case of filing of application about appointment/recalculation of monthly perpetual monetary pay means of the Action Portal and in case of sales term of technical capability on its forming and representation, forming of the statement is performed by means of the Action Portal according to the data specified in Appendix 1 to this Procedure. The data necessary for forming of the statement can be received by electronic information exchange with information and communication systems and public registers of public authorities.

3. Monthly perpetual monetary pay is appointed from the date of, the dismissal of the judge following behind day from position in resignation or the dismissals/terminations of powers of the judge of the Constitutional Court of Ukraine (further - dismissal of the judge from position) if the request for purpose of monthly perpetual monetary pay happened no later than three months from the date of dismissal of the judge from position.

In case of the address is later than three months from the date of dismissal of the judge from position monthly perpetual monetary pay is appointed from the date of the address on its appointment.

4. Day of acceptance by the body appointing monthly perpetual monetary pay, statements for purpose of monthly perpetual monetary pay and documents which list is provided in the Section II of this Procedure is considered day of the request for purpose of monthly perpetual monetary pay.

If the application for purpose of monthly perpetual monetary pay is submitted through the web portal or means of the Action Portal, day of the request for appointment registration date on the web portal or means of the Action of the Statement Portal together with the scanned copies of documents which list is provided in the Section II of this Procedure which correspond to originals of documents is considered and are suitable for perception of their content (shall contain the accurate image of complete structure of the text of the document and its details).

5. If not all necessary documents, the body appointing monthly perpetual monetary pay are added to the statement for purpose of monthly perpetual monetary pay in writing notifies on what documents need to be filed in addition (in case of filing of application through the web portal or means of the Action Portal such message goes through private electronic office of the user of the web portal or means of the Action Portal). If they are given no later than three months from the date of receipt of such notification, day of the request for purpose of monthly perpetual monetary pay day of adoption of the statement for purpose of monthly perpetual monetary pay or registration date of the statement on the web portal or means of the Action Portal is considered.

6. If documents which need to be submitted in addition within three months are not submitted, monthly perpetual monetary pay, with the consent of the judge, is appointed according to the available documents.

II. Documents necessary for purpose of monthly perpetual monetary pay

1. In case of filing of application about purpose of monthly perpetual monetary pay person shows the passport of the citizen of Ukraine.
