1. Approve the enclosed Technical regulation "Requirements to Packaging, Marking, Labelling and Their Correct Drawing".

2. This resolution becomes effective after six months from the date of official publication.

Technical regulation "Requirements to Packaging, Marking, Labelling and Their Correct Drawing"

1. Scope

1. The technical regulation "Requirements to Packaging, Marking, Labelling and Their Correct Drawing" (further - the Technical regulation) extends to the products (goods) of national and import production packed (packed up) and not packed (not packed up) into packaging (container) at the manufacturer (producer) realized in the territory of the Republic of Kazakhstan and establishes general requirements to packaging, marking, labeling and their correct drawing.

2. Provisions of this Technical regulation are subject to application in case of implementation, transportation, storage, operation, repair, recovery, utilization, destruction of products (goods), development of regulatory legal acts and regulating documents on standardization, when carrying out the state control of observance of the requirements established by technical regulations and also in case of confirmation of conformity.

Technical regulations and regulating documents on the standardization operating in the territory of the Republic of Kazakhstan, regulating requirements to packaging, marking, labeling and their correct drawing separate types of products (goods) are applied regarding not contradicting requirements of this Technical regulation.

2. Terms

4. In this Technical regulation the following terms are applied:

1) expiration date - the period before which expiration products (goods) are considered safe for proper use in case of observance of conditions of processes (stages) of production (production), turnover of products (goods);

2) date of production (production) - the date which is put down by the manufacturer (producer), informing on the moment of the end of engineering procedure of production (production) of products (goods);

3) date of packaging (packing, pouring of liquid products) - date of placement of products (goods) in packaging (container);

4) the manufacturer (producer) - the physical persons or legal entities making products for the subsequent alienation or own consumption in the production purposes;

5) ingredient - substance of animal, vegetable, microbiological or mineral origin, and also the natural or synthesized nutritional supplements used in case of production (production) of foodstuff and which are present at ready-made product in initial or the changed type;

6) the collective trademark is the trademark of association (union) or other consolidation of legal entities and (or) individual entrepreneurs serving for designation of the products (goods) which are turned out or sold by them having single quality or other characteristics;

7) marking - the texts, trademarks, symbol and drawings bearing information for the consumer and applied on products (goods), documents, instruction sheets (inserts), labels, counterlabels, kolyeretka, labels, stickers (stickers), packaging (container);

8) the name of the place of origin of products (goods) is the geographical specifying used for designation of products (goods) which special characteristics only or are mainly connected with the place of its production (production), including environment and (or) human factors;

9) nutrition value - the degree of satisfaction of organism in nutrients determined by structure and flavoring advantages;

10) the consumer - the physical person or legal entity acquiring products (goods) for the direct use (use) or further sale;

11) the supplier - the physical person or legal entity selling products (goods);

13) the trademark - the designation registered according to the legislation or protected without registration owing to international treaties in which the Republic of Kazakhstan participates, serving for difference of products (goods) of one legal entities or physical person from uniform products (goods) of other legal entities or physical persons;

14) packaging (container) - means or complex of the means providing protection of products (goods) against damages, spoil and losses.

3. General requirements to marking, labeling of products (goods) and to information for consumers

6. Information for the consumer in case of sales of products (goods) shall be provided directly with products (goods), the text, symbols and (or) drawings on packaging (container), the label, kolyeretka, the counterlabel, label, sticker (sticker), documents, instruction sheets (inserts) taking into account requirements imposed according to the legislation to marking of separate types of products (goods).

In case of sales of products (goods) information for the consumer is provided by the manufacturer (producer) and (or) the packer, the supplier.

7. Information for the consumer on packaging (container), the label, kolyeretka, the counterlabel, label, sticker (sticker), documents, instruction sheets (inserts) on application and the text in marking are put in the state and Russian languages.

Information for the consumer is stated taking into account regulations of spelling of the state, Russian or other language on which information for the consumer on products (goods) is given.

8. Information for the consumer have directly on each unit of production (goods) in the place, convenient for reading (acquaintance), on packaging (container), the label, kolyeretka, the counterlabel, label, sticker (sticker), documents, instruction sheets (inserts).

9. Information for the consumer is placed by the method provided in the regulating documentation on standardization and shall be accurate and easily readable.
