Questions of military and technical cooperation of the Russian Federation with foreign states

According to the Federal Law of July 19, 1998 "About military and technical cooperation of the Russian Federation with foreign states" and in connection with reforming of system and structure of federal executive bodies I decide No. 114-FZ:

1. Approve enclosed:

a) Regulations on the Commission on questions of military and technical cooperation of the Russian Federation with foreign states;

b) Regulations on procedure of military and technical cooperation of the Russian Federation with foreign states;

c) Regulations on procedure for provision to the Russian organizations of the right to implementation of foreign trade activity concerning military products;

d) Regulations on procedure for consideration of addresses of foreign customers and approval of drafts of decisions of the President of the Russian Federation, the Government of the Russian Federation and Federal Service for Military-Technical Cooperation on deliveries of military products, re-export or transfer to the third countries of the military products delivered to foreign customers and on transfer to the third countries of the military products made according to the Russian licenses;

e) Regulations on procedure for licensing in the Russian Federation of import and export of military products.

2. Determine federal executive bodies by coordination and control in the field of military and technical cooperation of the Russian Federation with foreign states, and also by the solution of other tasks of state regulation in this area according to the list according to appendix.

3. To the government of the Russian Federation in 3-month time:

a) bring the acts into accord with this Decree;

b) provide offers on reduction of acts of the President of the Russian Federation to compliance with this Decree.

4. Bring in the charter of the federal state unitary enterprise "Rosoboronexport" approved by the Presidential decree of the Russian Federation of January 6, 2001 No. 8 "About approval of the charter of the federal state unitary enterprise "Rosoboronexport" (The Russian Federation Code, 2001, No. 2, Art. 165; 2002, No. 45, Art. 4507; 2003, No. 47, Art. 4518), following changes:

a) in paragraphs five and the eighteenth Item 17 of the word of "Committee of the Russian Federation on military technically cooperation with foreign states" shall be replaced with words "Federal Service for Military-Technical Cooperation";

b) in Item 20 of the word "Committee of the Russian Federation on Military Technically Cooperation with Foreign States" shall be replaced with words "Federal Service for Military-Technical Cooperation".

5. Make change to the Presidential decree of the Russian Federation of November 17, 2003 No. 1357 "About the federal state unitary enterprise "Rosoboronexport" (The Russian Federation Code, 2003, No. 47, of the Art. 4518), having replaced in Item 1 of the word "Committee of the Russian Federation on Military Technically Cooperation with Foreign States" with words "Federal Service for Military-Technical Cooperation".

6. Recognize invalid:

The presidential decree of the Russian Federation of December 1, 2000 No. 1953 "Questions of military and technical cooperation of the Russian Federation with foreign states" (The Russian Federation Code, 2000, No. 49, the Art. 4799);

Item 1 of the Presidential decree of the Russian Federation of December 10, 2001 No. 1417 "About modification and amendments in the provisions and procedure approved by the Presidential decree of the Russian Federation of December 1, 2000 No. 1953 "Questions of military and technical cooperation of the Russian Federation with foreign states" (The Russian Federation Code, 2001, No. 51, the Art. 4873);

Item 5 of appendix No. 1 to the Presidential decree of the Russian Federation of October 21, 2002 No. 1209 "About reduction of acts of the President of RSFSR and the President of the Russian Federation in compliance with the Federal Law of August 8, 2001 No. 129-FZ "About state registration of legal entities" (The Russian Federation Code, 2002, No. 43, the Art. 4228).

7. This Decree becomes effective from the date of its signing.

Regulations on the Commission on questions of military and technical cooperation of the Russian Federation with foreign states

1. The commission on questions of military and technical cooperation of the Russian Federation with foreign states (further - the Commission) is the advisory and consultative body developing for the head of state of the offer, concerning the main directions of state policy in the field of military and technical cooperation of the Russian Federation with foreign states (further - military and technical cooperation).

2. The commission in the activities is guided by the Constitution of the Russian Federation, the Federal Law of July 19, 1998 No. 114-FZ "About military and technical cooperation of the Russian Federation with foreign states", other Federal Laws, decrees and orders of the President of the Russian Federation, and also this Provision.

3. The main functions of the Commission are:

a) preparation of offers to the President of the Russian Federation on development and realization of the main directions of state policy in the field of military and technical cooperation, and also on enhancement of the federal legislation, project development of regulatory legal acts and international treaties of the Russian Federation in the specified area;

b) the analysis and forecasting of situation in the field of military and technical cooperation for the purpose of ensuring political, economic and military interests of the Russian Federation;

c) consideration of drafts of the federal target programs concerning questions of military and technical cooperation;

d) consideration of the problems connected with implementation of military and technical cooperation and preparation of offers on their decision;

e) preparation of the offers directed to increase in efficiency of activities of federal executive bodies for coordination and control in the field of military and technical cooperation and also on the solution of other tasks of state regulation in this area;

e) consideration of the disagreements between federal executive bodies arising under the organization and implementation of military and technical cooperation and also development of recommendations about their elimination.

4. The commission for accomplishment of the main functions has the right:

a) request and obtain in accordance with the established procedure necessary information and materials from federal bodies of the government, public authorities of subjects of the Russian Federation, and also from organizations, the organizations and officials;

b) use in accordance with the established procedure databanks of Administration of the President of the Russian Federation and federal bodies of the government;

c) use state, including governmental, communication systems and communications;

d) attract in accordance with the established procedure to implementation of separate works of scientists and specialists, including on contractual basis;

e) interact in accordance with the established procedure with the Office of the Federation Council of Federal Assembly of the Russian Federation, State Duma administration of Federal Assembly of the Russian Federation, the Russian Government Office, devices of the Constitutional Court of the Russian Federation, the Supreme Court of the Russian Federation, the Prosecutor General's Office of the Russian Federation, independent divisions of Administration of the President of the Russian Federation, federal executive bodies, public authorities of subjects of the Russian Federation, and also with organizations, the organizations and officials on the questions entering its competence;

e) prepare offers on the conclusion in accordance with the established procedure of contracts with the research organizations, organizations, and also with specialists for performance of works in the field of safety of citizens, society and the state when implementing military and technical cooperation;

g) determine the agenda of the meetings and constitute lists of persons invited to them.

5. Information, material and other support of activities of the Commission is performed by Administration of the President of the Russian Federation, and also in necessary cases Federal Service for Military-Technical Cooperation and other federal executive bodies which representatives are part of the Commission.

The organization of ensuring activities of the Commission is assigned to Russian President's Foreign Policy Directorate.

6. The commission chairman, vice-chairmen, the responsible secretary, the deputy responsible secretary and members of the commission are part of the Commission.

The structure of the Commission affirms the President of the Russian Federation.

7. Work of the Commission is carried out according to the plans approved by the commission chairman.

8. Commission sessions are held by the commission chairman or according to its order one of vice-chairmen of the Commission.

Decisions of the Commission are drawn up by the protocol which affirms the commission chairman.

9. For the purpose of study of offers on separate problems of military and technical cooperation, preparation of materials for consideration on commission session the commission chairman on representation of the secretary of the Commission can create working group (secretariat).

Regulations on procedure of military and technical cooperation of the Russian Federation with foreign states

1. This Provision determines procedure of military and technical cooperation of the Russian Federation with foreign states (further - military and technical cooperation) according to the Federal Law of July 19, 1998 No. 114-FZ "About military and technical cooperation of the Russian Federation with foreign states".

2. Import to the Russian Federation, including temporary import (further - import), and export from the Russian Federation, including temporary export, transfer to lease, finance lease (leasing), export for conversion (further - export), military products when implementing military and technical cooperation are made according to decisions of the President of the Russian Federation, the Government of the Russian Federation or Federal Service for Military-Technical Cooperation according to the licenses granted by Federal Service for Military-Technical Cooperation, according to the procedure, established by the President of the Russian Federation. At the same time:

a) only the President of the Russian Federation makes decisions:

about export of the military products which are not included in the list of the military products permitted to transfer to foreign customers (further - the list No. 1), except for temporary export of such products for carrying out displays (demonstrations in operation) and participations in exhibitions of military product samples outside the territory of the Russian Federation. Authorized bodies and subjects of military and technical cooperation of foreign states, and also the international organizations representing the interests of foreign states can act as foreign customers;

about export of military products in the foreign states which are not included in the list of the states to which transfer of the military products specified in the list of the military products permitted to transfer to foreign customers (further - the list No. 2) is resolved;

about export of military products for transfer to the international organizations representing the interests of foreign states;

the paragraph the fifth the subitem and) Item 2 ceased to be valid according to the Presidential decree of the Russian Federation of 30.07.2013 No. 655

about transfer to foreign customers of licenses for military production;

about cooperation with foreign states in the field of development and military production, except for cooperation in the field of production of spare parts, aggregates, nodes, devices, components, special, educational and auxiliary property to such products;

about carrying out research and development works for the benefit of foreign customers;

about rendering military technical assistance to foreign states according to the international obligations of the Russian Federation, and also based on appeals of competent authorities of foreign states. Nature, amount, terms and procedure for rendering military technical assistance are determined by the President of the Russian Federation in each case separately;

about participation in international contests (tenders) for carrying out for the benefit of foreign customers of works on military product development, on transfer of licenses for production of developed military products, on the organization of its licensed production in the territories of foreign states, the specified works (transfer of the license, the organization of licensed production) providing permission to carrying out on condition of victory in international contest (tender) and containing the order to the Government of the Russian Federation to make the decision determining specific types, amounts, terms and conditions of performance of works (transfer of the license, the organization of licensed production);

b) based on decisions of the Government of the Russian Federation are performed:

export of the military products included in the list No. 1, in the foreign states included in the list No. 2, in cases if deliveries of military products are performed from availability of federal executive bodies, or with use of means of the federal budget, or using special conditions of calculations for military delivered goods (payment deferral, the foreign trade barter deal and others) or provide transfer of the data which are the state secret;

the paragraph third the subitem ) Item 2 ceased to be valid according to the Presidential decree of the Russian Federation of 30.07.2013 No. 655

rendering services in ensuring start of military foreign spacecrafts for the benefit of the foreign states included in the list No. 2;

creation in accordance with the established procedure the companies (organizations), joint with foreign customers, which are engaged in the development and military production included in the list No. 1;

the paragraph of the eighth of the subitem) Item 2 ceased to be valid according to the Presidential decree of the Russian Federation of 16.06.2015 No. 307

the paragraph the ninth the subitem ) Item 2 ceased to be valid according to the Presidential decree of the Russian Federation of 30.07.2013  No. 655

import (export) of military products for needs of the federal executive bodies incorporating troops and military forming within the state defense order by the state intermediary - the specialized organization created according to the decision of the President of the Russian Federation in the form of the federal state unitary enterprise founded on the right of economic maintaining or in the form of joint-stock company which 100 percent of shares is in federal property or is given to the non-profit organization created by the Russian Federation in the form of the state corporation and (or) the state intermediary providing complex field service of the Russian aircraft equipment carried to military products - the specialized organization created in the form of joint-stock company which 100 percent of shares is in property of non-profit organization the created Russian Federation in the form of the state corporation, together with head contractors (contractors) determined in the state defense order. The decision on import (export) of military products in this case is the order of the Government of the Russian Federation about approval of the state defense order for the corresponding year;

rendering technical assistance in creation in the territories of the foreign states included in the list No. 2, of special objects, intended for production and fighting use of the military products included in the list No. 1;

paragraph twelfth ceased to be valid

transfer of the military products included in the list No. 1, to the state intermediaries, the Russian organizations - to developers and producers of military products for the purpose of work and rendering services for the benefit of the foreign states included in the list No. 2, if transfer of such products is performed from availability of federal executive bodies;

preparation according to the procedure, stipulated in Item 2.1-1 this provision, to delivery of the military products included in the list No. 1, containing the data which are the state secret in the foreign states included in the list No. 2, before issue of the expert opinion of the Interdepartmental commission on protection of the state secret on possibility of transfer of such data to foreign state;

c) based on decisions of Federal Service for Military-Technical Cooperation are performed:

export of the military products included in the list No. 1, in the foreign states included in the list No. 2, except as specified specified in the paragraph the second the subitem "b" of this Item and also temporary export of the military products which are not included in the list No. 1, in the foreign states included in the list No. 2, for carrying out displays (demonstrations in operation) and participations in exhibitions of military product samples;

holding the international exhibitions of military product samples in the territory of the Russian Federation and participation in exhibitions in the territories of foreign states according to the procedure, determined by the Government of the Russian Federation, on condition of approval of the Ministry of Defence of the Russian Federation and if necessary with other federal executive bodies of amounts of the advertizing and exhibition activities of information and ensuring protection of the data which are the state secret extended in the course;

carrying out displays (demonstrations in operation) military products in the territories of the foreign states included in the list No. 2, on condition of approval of the Ministry of Defence of the Russian Federation and if necessary with other federal executive bodies of amounts extended in the course of carrying out displays (demonstrations in operation) information and ensuring protection of the data which are the state secret;

carrying out testing of the samples (prototypes, useful models) military products made by the foreign states included in the list No. 2, without issue of recommendations about their enhancement;

rendering services in training of specialists of foreign states in production, fighting application and operation of military products if such training is performed by the Ministry of Defence of the Russian Federation and (or) the organizations - developers and producers of military products based on delivery contracts of these products;

ceased to be valid according to the Presidential decree of the Russian Federation of 05.03.2014 No. 121

temporary import of military products for demonstration at the international exhibitions or carrying out testing;

preparation according to the procedure, stipulated in Item 2.2 this provision, to delivery of the military products included in the list No. 1, containing the data which are the state secret (without transfer of data), in the foreign states included in the list No. 2, before issue of the expert opinion of the Interdepartmental commission on protection of the state secret on possibility of transfer of such data to foreign state;

carrying out research and development works on upgrade of the military products included in the list No. 1;

upgrade of the military products included in the list No. 1;

rendering services in adaptation of the military products included in the list No. 1, to samples of arms and military equipment of the foreign states included in the list No. 2;

rendering technical assistance in additional equipment and upgrade of special objects which are created in the territories of the foreign states included in the list No. 2;

rendering technical assistance in creation in the territories of the foreign states included in the list No. 2, of special objects, intended for the implementation of maintenance, repair, utilization and other works providing complex field service of the military products included in the list No. 1, and its upgrade and also for production and (or) storage of spare parts, aggregates, nodes, devices, components, special, educational and auxiliary property to the specified products;
