About creation of the State fund of development of transport and communication of Turkmenistan

For the purpose of complex development of transport infrastructure, telecommunications and communication systems in Turkmenistan I decide:

1. Create the State fund of development of transport and communication of Turkmenistan.

2. Approve the enclosed Regulations on the State fund of development of transport and communication of Turkmenistan.

3. Determine that all means of the State fund of development of transport and communication of Turkmenistan are created and used in strict accordance with Regulations on fund.

4. Open special accounts of the State fund of development of transport and communication of Turkmenistan: currency - in National bank of foreign economic activity of Turkmenistan and manatny Investbank in Joint investment commercial bank of Turkmenistan and National bank of foreign economic activity of Turkmenistan.

5. Form the Board of directors of the State fund of development of transport and communication of Turkmenistan in structure according to appendix.

Determine that the Board of directors of Fund submits for approval to the President of Turkmenistan perspective plans and comprehensive programs of development of industries of transport and communication, considers offers on the external economic contracts, exercises control of execution accepted to financing by fund of projects.

Regulations on the State fund of development of transport and communication of Turkmenistan

1. The state fund of development of transport and communication of Turkmenistan (the Fund is referred to as) is created for the purpose of complex development of infrastructure of transport and communication of Turkmenistan, the maximum requirements satisfaction of the national economy and the population in services of transport and communication.

2. The fund performs complex financial servicing of systems of transport and communication of Turkmenistan, determines optimum mechanisms of accumulating and distribution of financial resources by the priority directions of development programs of industries taking into account specifics of transition period.

Services industry of Fund joins the following ministries and departments:

Ministry of road transport of Turkmenistan,

National administration of civil aviation of Turkmenistan,

State railroad of Turkmenistan,

Turkmen sea shipping company,

Turkmen river shipping company of name of the President of Turkmenistan S. A. Niyazov,

State concern of Turkmenavtoyellara,

Ministry of Communications of Turkmenistan.

3. The fund is created at the expense of cumulative (manatny and currency) the income of the companies of transport and communication from all types of activity in the territory of Turkmenistan, charges for entrance and following by transit across the territory of Turkmenistan, voluntary contributions of the companies, public organizations, citizens, foreign legal entities and physical persons, the income from promotional fees, share issue.

4. Accumulating of financial resources in Fund happens by direct revenues to accounts of Fund (manatny and currency) the income of the companies from rendering of services to the subsequent direction of financial resources into accounts of the ministries, departments and companies according to previously approved scheme of financing of production cycle.

5. The fund determines taking into account production and financial specifics of each industry, procedure for accumulating and distribution of financial resources by industries and departments, and also establishes re press of functioning of accounts of the ministries, departments and companies for established procedure.

6. In case of direct receipt of funds for ensuring functional balance of production cycles with Fund the procedure for advancing, the reporting under the actual sales amount of services is determined and the scheme of financing of the corresponding production cycles is constituted together with the ministry or department, at the same time in the signed contracts for rendering of services only accounts of Fund are specified.

7. Fund:

participates in development of the comprehensive program of development of industries, approves the general financial scheme, funding mechanism, the budget, investing programs of industries;

provides continuous control of condition of financial system of subordinated industries and accomplishment of programs of their development, constitutes the cumulative report on functional condition of industry;

performs the analysis on cost structure of production cycles, proportions of external and internal investments, programs of scientific and technical researches, social development, ecology and realization of reforms of industries;

carries out classification of industry programs of financing by priority degree, sources and stages of financing and constitutes the general financial scheme on industries and Fund in general;

exercises financing and control of accumulating and distribution of financial resources of B strict compliance with the general scheme of financing approved by the Board of directors.

8. Fund is allocated for financial servicing of comprehensive programs of development of industries, r that number on:
