About the simplified procedure for education and registration of the rights of land use

In pursuance of the actions plan on implementation of the medium-term economic program of the Government of the Republic of Tajikistan for the period from November 1, 1998 to March 30, 1999 approved by the President of the Republic of Tajikistan on November 25, 1998 the Government of the Republic of Tajikistan decides:

Approve the enclosed Simplified procedure for education and registration of the rights of land use.

The simplified procedure for education and registration of the rights of land use

Preparation of land management materials by training of Dehkan (farmer) economy and state registration of right to use by the earth is performed by Committee on land resources and land management under the Government of the Republic of Tajikistan and its bodies on places according to Article 15 of the Land Code of the Republic of Tajikistan.

The following procedure for education and state registration of land use is established:

1. The petition from the citizen in district land committee about allocation of lands for the organization of Dehkan (farmer) economy.

2. Consideration of the application by the chairman of the area, city and the order raykomzy on preparation of land management case which contains the following documents:

a) the act and the drawing of the choice of the parcel of land which is taken away for the organization of Dehkan economy;

b) the decision of the land user (kolkhoz, sovkhoz, mezhkhoz) about withdrawal of the parcel of land to Dehkan economy;

c) solution of jamia (selkomzem) on formation of Dehkan (farmer) economy;

d) certificate of raykomzem of land share;

e) representation of raykomzem, about approval of materials of allocation of land, to the chairman of the area, city;

e) decision of the chairman of the area, city on approval of materials of allocation of land and formation of Dehkan economy;

g) plan of lands of Dehkan economy.

3. Registration of zemdel on allocation of land and transfer of materials to Committee on land resources and land management under the Government of the Republic of Tajikistan for issue of the Certificate on right to use by the earth.

4. State registration of the Certificate on right to use by the earth in raykomzema and issues to his land user.

5. The protocol and the drawing of transfer of borders of land use in nature (fixing of borders on the area).
