Regulations on receipt of permission to the right of navigation of vessels under the flag of foreign state on inland waterways of the Russian Federation

1. This Provision determines procedure for receipt of permission to the right of navigation of vessels under the flag of foreign state by inland waterways of the Russian Federation, including procedure for receipt of permission to the right of navigation of vessels under flags of the Caspian states (The Azerbaijan Republic, the Republic of Kazakhstan, Turkmenistan and the Islamic Republic of Iran) (further - vessels under flags of the Caspian states) by inland waterways of the Russian Federation for the purpose of implementation of repair in the ship-repair organizations of the Astrakhan region (further - the ship-repair organizations).

2. The decision on issue of permission to the right of navigation of the vessel under the flag of foreign state on inland waterways of the Russian Federation, including the decision on issue of permission to the right of navigation of vessels under flags of the Caspian states on inland waterways of the Russian Federation for the purpose of implementation of repair in the ship-repair organizations, is accepted by the Government of the Russian Federation in the form of the order.

3. The basis for preparation of the draft of the order of the Government of the Russian Federation about permission to the right of navigation of the vessel under the flag of foreign state on inland waterways of the Russian Federation is the appeal of competent authority of foreign state to the Ministry of Transport of the Russian Federation about receipt of permission to the right of navigation of vessels under the flag of foreign state on inland waterways of the Russian Federation (further - the appeal of competent authority).

The basis for preparation of the draft of the order of the Government of the Russian Federation about permission to the right of navigation of vessels under flags of the Caspian states on inland waterways of the Russian Federation for the purpose of implementation of repair in the ship-repair organizations is the appeal to the Ministry of Transport of the Russian Federation of the ship-repair organization (further - the appeal of the ship-repair organization).

4. The appeal of competent authority is sent to the Ministry of Transport of the Russian Federation at least in 60 calendar days prior to the term of the planned pass of the vessel under the flag of foreign state on inland waterways of the Russian Federation. The address contains the following information in Russian:

a) the name of the vessel (in case of impossibility of specifying of the name of the vessel in Russian specifying of its name according to the international ship's papers in Latin transcription is allowed);

b) national identity of the vessel;

c) name of the shipowner;

d) vessel's home port;

e) type of vessel;

e) main measurings (length, width, draft, surface dimension) of the vessel;

g) route of navigation of the vessel;

4(1). 5. In case of incompleteness specified in the appeal of competent authority or the appeal of the ship-repair organization of the data provided by items 4 and 4(1) this provision, the Ministry of Transport of the Russian Federation requests from competent authority of foreign state, and in case of the appeal of the ship-repair organization - from the ship-repair organization the additional information.

In case of non-presentation of foreign state by competent authority or ship-repair organization of the additional information the Ministry of Transport of the Russian Federation informs them on impossibility of consideration according to the appeal of competent authority or the appeal of the ship-repair organization.

6. The Ministry of Transport of the Russian Federation performs:

a) preparation of the draft of the order of the Government of the Russian Federation about permission to the right of navigation of the vessel under the flag of foreign state on inland waterways of the Russian Federation in which are specified:

name of the vessel;

national identity of the vessel;

route of navigation of the vessel;

terms and the purpose of pass (the number of passes) of the vessel on inland waterways of the Russian Federation;

need of carrying out boundary, customs and other types of control of the vessel, its crew and passengers;

b) preparation of the draft of the order of the Government of the Russian Federation about permission to the right of navigation of vessels under flags of the Caspian states on inland waterways of the Russian Federation for the purpose of implementation of repair in the ship-repair organizations in which are specified:

national identity of courts under flags of the Caspian states;

terms and the purpose of passage of the vessels under flags of the Caspian states on inland waterways of the Russian Federation;

the list of the ship-repair organizations in which passage of the vessels under flags of the Caspian states for the purpose of repair implementation is resolved;

need of carrying out boundary, customs and other types of control of courts under flags of the Caspian states and their crews;

features of approval of the Ministry of Defence of the Russian Federation of the planned dates of passage of the vessels under flags of the Caspian states on inland waterways of the Russian Federation in the ship-repair organizations and back.
