RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About guarantees in case of the direction for professional training, retraining, advanced training and training

Based on Article 102 and part four of Article 220-1 of the Labor code of the Republic of Belarus, part two of Item 2 of article 252 of the Code of the Republic of Belarus about education the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on guarantees in case of the direction for professional training, retraining, advanced training and training it (is applied).

2. Recognize invalid:

the resolution of the Cabinet of Ministers of the Republic of Belarus of December 30, 1995 No. 709 "Ab zatsvyardzhenni Palazhennya ab umova of materyyalnag zabespyachennya the listener-in ў sistemy pavyshennya kvalifikatsyi i perapadrykhto¸ki shot ў" (Collection of presidential decrees and resolutions of the Cabinet of Ministers of the Republic of Belarus, 1995, No. 36, the Art. 899);

the resolution of Council of Ministers of the Republic of Belarus of November 26, 1998 No. 1824 "About introduction of amendments to the resolution of the Cabinet of Ministers of the Republic of Belarus of December 30, 1995 No. 709" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1998, No. 33, the Art. 849).

3. This resolution becomes effective since January 26, 2008.

Regulations on guarantees in case of the direction for professional training, retraining, advanced training and training

1. This Provision establishes the guarantees provided to workers, military personnel (except for the military personnel undergoing compulsory military service), to the staff (workers) of paramilitary organizations having special ranks, directed by the employer to professional training, retraining, advanced training and training (further, unless otherwise specified, – workers), and also to persons who are trained on the basis of the agreement on professional training, retraining, advanced training of working (employee) in other organization which according to the legislation is granted the right to perform educational activities, at the expense of means of this organization within the Republic of Belarus.

This Provision does not extend to the managerial personnel of state bodies and other state organizations, the faces included in reserves of the managerial personnel and in perspective personnel reserve, sent to Academy of management in case of the President of the Republic of Belarus on retraining in internal (day) form of education according to the state order.

The direction of the worker on training is drawn up by the order (the order, the resolution) of the employer which is the basis for calculation and payment to the worker of money. In the order (the order, the resolution) dates of training taking into account challenge of organization of education, other organization which according to the legislation is granted the right to perform educational activities, including state body (further, unless otherwise specified, – organization of education), and (or) contracts with organization of education, journey time to the place of training and back, other circumstances are reflected.

2. For the workers directed by the employer on:

retraining, advanced training and training in internal (day) form of education, for the entire period of passing of training by them average earnings (cash allowance) on place of employment (military service, service) remain;

retraining, advanced training and training in absentia of education, average earnings (cash allowance) on place of employment (military service, service) for the working days (hours), days of service established by the working schedule (working in shifts) of the worker or employment policies and procedures (for the days of service established by rules of the internal office schedule), falling on the period of their direct participation in studies, training when passing intermediate and final assessment in organization of education according to challenge of organization of education and (or) the contract with organization of education remain. At the same time the staff of paramilitary organizations having special ranks in the cases provided by legal acts is granted social leave in connection with training;

retraining in remote form of education, average earnings (cash allowance) on place of employment (military service, service) in the day or the period of holding final assessment established by the curriculum in retrainings according to challenge of organization of education for the working days (hours), days of service established by the working schedule (working in shifts) of the worker or employment policies and procedures remain (for the days of service established by rules of the internal office schedule).

To the workers who do not have qualification (category) by profession of the worker, the necessary organization, and employed by this profession of the worker without specifying of the category or with its specifying directed to professional training, retraining, advanced training in internal (day) form of education during the training period at the expense of means of the employer salary payment from calculation in month of at least 0,15 of the budget of subsistence minimum for able-bodied population is performed, the cash allowance remains.

To persons who are trained on the basis of the agreement on professional training, retraining, advanced training of working (employee) in other organization which according to the legislation is granted the right to perform educational activities at the expense of means of this organization in internal (day) form of education during the period of training salary payment in the amount of, established by part two of this Item is performed.

3. To the workers directed by the employer to advanced training, retraining, training in internal (day) form of education to other settlement, the employer performs compensation of daily allowance according to the procedure and the sizes established by the legislation for the workers sent to official journeys within 30 calendar days from start date of training (taking into account time for journey to the place of training), throughout other period of training the grant in the amount of 0,5 of the tariff charge (tariff salary), salary, official pay rate in month is paid.

The serviceman (except for the military personnel undergoing compulsory military service), to the staff (workers) of paramilitary organizations having special ranks, directed to advanced training, retraining, training in internal (day) form of education to other settlement performs compensation of daily allowance according to the procedure and the sizes established by the legislation for the workers sent to official journeys for the entire period of training.
