About Majlisi Oli of the Republic of Tajikistan

Chapter 1. General provisions

Article 1

The Majlisi Oli - parliament of the Republic of Tajikistan is the highest representative and legislature of the government of the Republic of Tajikistan.

The Majlisi Oli performs the activities according to the Constitution of the Republic of Tajikistan, this constitutional Law, other regulatory legal acts of the Republic of Tajikistan.

Article 2

The Majlisi Oli consists of two Majlises - Majlisi milli and Majlisi namoyandagon.

The Majlisi milli consists of 33 members, 25 of which are chosen indirect, secret vote on joint sittings of deputies of the Gorno-Badakhshan Autonomous Region, areas, cities and districts of the area, city of Dushanbe and districts of the city, the cities and areas of republican subordination (jointly). In Majlisi milli the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the cities and areas of republican subordination have the equal number of representatives. 8 members of Majlisi milli are appointed the President of the Republic of Tajikistan. Each former President of the Republic of Tajikistan is the life member of Majlisi milli if he does not refuse use of this right. The Majlisi milli functions in the form of convocations.

The Majlisi namoyandagon consists of 63 deputies elected on the basis of general equal and direct suffrage in case of secret vote. The Majlisi namoyandagon is permanent and professional. The procedure for election of members of Majlisi milli and deputies of Majlisi namoyandagon is established by the Constitution of the Republic of Tajikistan, the constitutional Law of the Republic of Tajikistan "About elections of Majlisi Oli of the Republic of Tajikistan".

Article 2 (1)

The legislation of the Republic of Tajikistan on Majlisi Oli of the Republic of Tajikistan is based on the Constitution of the Republic of Tajikistan and consists of this constitutional Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Article 2 (2)

The Majlisi Oli in the activities is guided by the principles of rule of law, democracy, separation of the government, providing rights and freedoms of man and citizen, justice, transparency, publicity and collective nature.

Article 3

The term of office to Majlisi milli and Majlisi namoyandagon is five years. Powers of Majlisi milli and Majlisi namoyandagon stop in day of the beginning of activities of Majlisi milli and Majlisi namoyandagon of new convocation.

Majlisi milli and Majlisi namoyandagons on joint sitting can dissolve itself ahead of schedule with the consent of at least two thirds of members of Majlisi milli and deputies of Majlisi namoyandagon.

Majlisi milli and Majlisi namoyandagons cannot be dismissed during action of extraordinary and military provisions

Article 4

Majlisi milli and Majlisi namoyandagons perform the activities in the form of sessions, joint sittings of Majlisi milli and Majlisi namoyandagon. Council of Majlisi milli and Council of Majlisi namoyandagon, committees and the commissions of Majlisi milli and Majlisi namoyandagon perform the activities in the form of meetings. The Majlisi milli and Majlisi namoyandagon on the questions entering their competences carry out parliamentary hearings.

Coordinating bodies of Majlisi milli and Majlisi namoyandagon hold meetings separately.

The procedure for activities of Majlisi milli and Majlisi namoyandagon, their bodies, members and deputies is determined by the Constitution of the Republic of Tajikistan, this constitutional Law, other constitutional laws, the laws of the Republic of Tajikistan, and also Regulations of joint sittings of Majlisi milli and Majlisi namoyandagon, Regulations of Majlisi milli and Regulations of Majlisi namoyandagon.

The regulations of joint sittings of Majlisi milli and Majlisi namoyandagon are accepted on joint sitting, Regulations of Majlisi milli and Regulations of Majlisi namoyandagon - each Majlis at their meeting.

Joint sittings of Majlisi milli and Majlisi namoyandagon and their session open and closed by execution of the National Anthem of the Republic of Tajikistan.

Article 5

During the period between the sessions of Majlisi milli and Majlisi namoyandagon the President of the Republic of Tajikistan in case of need can convene extraordinary sessions. At these sessions only the questions which formed the basis for convocation of these sessions are considered
