PRESIDENTIAL DECREE OF THE AZERBAIJAN REPUBLIC

of September 28, 2007 No. 634

About approval of the List of the officials having powers to consider cases on administrative offenses

(as amended on 05-06-2015)

1. Approve "The list of the officials having powers to consider cases on administrative offenses" it (is applied).

2. Charge to the Cabinet of Ministers of the Azerbaijan Republic within one month:

2.1. prepare and provide to the President of the Azerbaijan Republic offers on reduction of the existing regulatory legal acts to compliance with this Decree;

2.2. prepare and provide to the President of the Azerbaijan Republic offers on reference to government employees of officials of the organizations entering into structure of other central executive bodies, except for bodies the stipulated in Item 2.3 presents of the Decree and Item 2-7 of the list approved by the Decree having based on the legislation of power to consider cases on the administrative offenses which however are not relating to government employees;

2.3. prepare and provide to the President of the Azerbaijan Republic offers on the officials having powers to consider cases on administrative offenses on behalf of the Ministry of Defence of the Azerbaijan Republic, the Ministry of emergency situations of the Azerbaijan Republic and the Ministry of Justice of the Azerbaijan Republic;

2.4. resolve other issues following from this Decree within the powers.

3. Charge central and to local executive bodies, stipulated in Item 1 list approved by this Decree, within two months to approve the list of the officials having powers to consider cases on administrative offenses according to the positions specified in this list and to place it after publication on the Internet pages.

4. This Decree becomes effective from the date of publication.

The list of the officials having powers to consider cases on administrative offenses

1. On behalf of the central executive bodies and local executive bodies to whom the legislation on public service extends:

1.1. head of state body;

1.2. deputy manager of state body;

1.3. chief of staff of state body;

1.4. deputy manager of the office of state body;

1.5. chiefs of departments, division managers in the office of state body;

1.6. deputy chiefs of departments, deputy managers of divisions in the office of state body;

1.7. chiefs of sectors in the office of state body;

1.8. main consultants;

1.9. senior consultants;

1.10. heads (deputy managers) of the state agencies and public services under the central executive bodies, heads of devices (deputy managers), chiefs of departments (deputy chiefs) and chiefs of sectors of the device;

1.11. heads and deputy managers being under the central executive bodies, in their subordination of the bodies which are in structural divisions.
