1. Approve "Rules of issue of certificates on the technical devices and the equipment made and used on potentially dangerous objects" it (is applied).

Rules of issue of certificates on the technical devices and the equipment made and used on potentially dangerous objects

1. General provisions

1.1. These rules are prepared according to the Law of the Azerbaijan Republic "About technical safety" and the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About technical safety" of February 2, 2000 No. 269 and establish procedure for issue of the certificate on technical devices and the equipment (1), certified (daleesertifitsiruyemy) from the point of view of compliance to requirements of technical safety of potentially dangerous objects located in the territory of the Azerbaijan Republic.

1.2. Provisions of these rules extend to all legal entities and physical persons (further - person operating object) which are engaged in operation of objects in the territory of the Azerbaijan Republic regardless of legal form and pattern of ownership.

1.3. The list of the certified technical installations and the equipment made and used on objects affirms the Ministry of Emergency Situations.

1.4. Creation, registration and issue of the certificate on the technical installations certified on objects and the equipment is performed by the Ministry of Emergency Situations.

1.5. The expenses incurred in connection with issue of the certificate on the technical installations made and used on objects and the equipment, are paid by persons operating objects.

1.6. If the rules concerning regulation of the relations of technical safety established in interstate agreements in which the Azerbaijan Republic acts as the party differ from the rules provided in the Law of the Azerbaijan Republic "About technical safety", then rules of international treaties are applied.

1.7. These rules do not extend to the technical installations made and used on objects and the equipment which useful life left.

2. Issue of the certificate

2.1. For issue of the certificate on the technical installations and the equipment made and used on the objects accepted to operation according to the legislation of the Azerbaijan Republic, person operating object shall document in accordance with the established procedure data (2), characterizing everyone the technical installation and the equipment made and used on object, and to provide them to the Ministry of Emergency Situations no later than 10 days from the date of acceptance of object to operation. And certification and issue of the certificate on technical installations and the equipment of the objects brought into operation about day of entry into force of these rules is performed during the term established by the Ministry of Emergency Situations; The Ministry of Emergency Situations, registering the submitted documents, considers them within 15 days. 2.2. In case of non receipt of the certificate on the technical installations made and used on object and the equipment at the scheduled time, or assumptions person of use operating object on object along with the certified technical installations and the equipment as well not certified technical installations and the equipment the Ministry of Emergency Situations represents to person operating this object the notification with indication of deadline for certification and receipt of the certificate on the technical installations made and used on object and the equipment. In this notification it is specified that concerning the person which did not certify and who did not receive the certificate on the technical installations made and used on object and the equipment during the specified term, will be applied measures, stipulated by the legislation the Azerbaijan Republic.

2.3. In case of violation of safety requirements of state standards and normative and technical documents as a result of modification of designs of the technical installations and the equipment made and used on objects or of their proper use after issue on them of the certificate operating object person shall inform on it the Ministry of Emergency Situations previously.

The Ministry of Emergency Situations has the right to make the decision on need of repeated certification of technical installations and the equipment, to design or proper use of which changes, or about their additional check and testing are made.

2.4. The form of the certificate and term of its action are established by the Ministry of Emergency Situations. The certificate with the expired effective period is considered invalid.

2.5. The certificate is signed by the chairman of the Ministry of Emergency Situations (and in case of its absence, the deputy performing its powers) and is confirmed by seal of the Ministry of Emergency Situations.

2.6. Data on technical installations and the equipment on which the certificate is issued systematically accumulate the Ministry of Emergency Situations and person operating object according to the following Sections and are stored by them during useful life of technical means and the equipment on object:

a) passing of registration in the state register of objects on which technical installations and the equipment, and category of object are placed;

b) documents of compliance of technical installations and equipment;

c) the methodical materials, the program of certification applied when carrying out certified and test works;
