About approval of Rules of implementation out of limits of Ukraine and in Ukraine of the transfers of physical persons on the current currency uncommercial transactions and their payments in Ukraine and modification of some regulatory legal acts

According to requirements of Articles 5, of 11, 13 Decrees of the Cabinet of Ministers of Ukraine of 19.02.93 No. 15-93 "About system of currency control and currency exchange control", Item 14 of Article 7 and article 44 of the Law of Ukraine "About the National Bank of Ukraine", the Law of Ukraine "About payment systems and money transfer in Ukraine", article 1 of the Law of Ukraine "About mail service" the Board of the National Bank of Ukraine DECIDES:

1. Approve Rules of implementation out of limits of Ukraine and in Ukraine of the transfers of physical persons on the current currency uncommercial transactions and their payments in Ukraine (further - Rules) which are applied.

2. Recognize invalid:

the resolution of Board of the National Bank of Ukraine of 23.09.96 No. 245 "About approval of regulations of the National Bank of Ukraine and modification and amendments in the existing regulations of the National Bank of Ukraine";

the resolution of Board of the National Bank of Ukraine of 14.10.2004 No. 486 "About approval of Rules of implementation of the transfers of foreign currency according to the order and for benefit of physical persons", registered in the Ministry of Justice of Ukraine 02.11.2004 for No. 1402/10001;

Item 1.3 of the resolution of Board of the National Bank of Ukraine of 31.08.2005 No. 321 "About modification of some regulatory legal acts of the National Bank of Ukraine", registered in the Ministry of Justice of Ukraine 20.09.2005 for No. 1074/11354;

Item 1 of the resolution of Board of the National Bank of Ukraine of 27.10.2005 No. 396 "About implementation of the international postal orders", registered in the Ministry of Justice of Ukraine 11.11.2005 for No. 1362/11642.

3. Bring in Regulations on procedure for issue of individual licenses by the National Bank of Ukraine on the placement of currency values by residents (legal entities and physical person) on accounts outside Ukraine approved by the resolution of Board of the National Bank of Ukraine of 14.10.2004 No. 485, registered in the Ministry of Justice of Ukraine 05.11.2004 for No. 1413/10012 (with changes), the following changes:

3.1. To add Chapter 1 after Item 1.16 with Item of such content:

"1.17. Physical persons - the residents who obtained the individual license of National Bank on placement of currency values on accounts outside Ukraine can make into these accounts transfer of foreign currency in the amount, in equivalent which is not exceeding 600 000 hryvnias a year".

4. Item 4 of Chapter 2 of the Section II of the Provisions on procedure and terms of trade in foreign currency approved by the resolution of Board of the National Bank of Ukraine of 10.08.2005 No. 281, registered in the Ministry of Justice of Ukraine 29.08.2005 for No. 950/11230 (with changes) to state in the following edition:

"4. Clients - physical persons - residents buy, exchange foreign currency from current accounts for the purpose of the translation out of limits of Ukraine according to the regulatory legal act of National Bank regulating procedure of the translations on the current currency uncommercial transactions (further - Translation rules), based on the following documents:

a) statements for purchase of foreign currency;

b) the documents provided by Translation rules testimonial of availability at physical persons of the bases for implementation of the transfers of foreign currency out of limits of Ukraine".

5. To department of currency control (O. A. Scherbakov) to develop and submit proposals concerning modification of Rules of the organization of the statistical reporting which moves in the National Bank of Ukraine, Boards approved by the resolution National Ukraine of 19.03.2003 No. 124, registered in the Ministry of Justice of Ukraine 07.05.2003 for No. 353/7674 (with changes), regarding provision of the reporting on the transfers in foreign currency under the current currency uncommercial transactions according to the order and for benefit of physical persons.

6. To department of currency control (O. A. Scherbakov) after state registration in the Ministry of Justice of Ukraine to bring contents of this resolution to permission of territorial administrations of the National Bank of Ukraine, authorized banks, authorized financial institutions and the national operator of mail service for use in work.

7. To impose control over the implementation of this resolution on Department of currency exchange control and licensing (O. G. Bilanenko) and territorial administrations of the National Bank of Ukraine.

8. The resolution becomes effective in 10 days after state registration in the Ministry of Justice of Ukraine.

Rules of implementation outside Ukraine and in Ukraine of the transfers of physical persons on the current currency uncommercial transactions and their payments in Ukraine

1. General provisions

1.1. These Rules regulate the translations on the current currency uncommercial transactions which are performed according to the order and for benefit of physical persons, namely:

procedure authorized banks, non-bank financial institutions and the national operator of mail service (further - banks) the translations at the request of physical persons - residents and nonresidents (further - the translations) out of limits of Ukraine and within Ukraine;

payment procedure banks of transfers from abroad and within Ukraine to physical persons - residents and nonresidents.

Rules do not extend to the translations connected with business and investing activities of physical persons.
