The agreement between the Government of the Republic of Tajikistan and the Government of the Republic of Kazakhstan on cooperation in the field of culture and art

The government of the Republic of Tajikistan and the Government of the Republic of Kazakhstan which further are referred to as with the Parties

being guided by desire to expand and strengthen cultural cooperation on the basis of the principles of sovereignty, mutual respect, equality,

being convinced that such cooperation will promote mutual interests, understanding and friendship between the people of the states of the Parties,

agreed as follows:

Article 1

The parties develop cooperation in the field of culture according to national legal systems of the states of the Parties.

Article 2

The parties on the basis of bilateral agreements develop cooperation in the field of culture by holding exhibitions, the organization of exchange tours and establishment of communications between creative associations, the organizations and cultural institutions, both in state, and in private sectors.

The parties encourage mutual participation in the international events held in the territories of the states of the Parties in the sphere of culture and art - tenders, festivals, symposiums, conferences.

Article 3

The parties promote implementation of exchange of information, literature, methodological and statistical investigations, periodicals and magazines concerning culture and art.

Article 4

The parties strengthen cooperation in the sphere of regulation, protection, recovery, storage and restoration of cultural and art heritage of each state and promote mutual access to cultural heritage of the states of the Parties according to National legal systems of the states of the Parties.

Article 5

The parties take the measures directed to non-admission of illegal import, export and illegal assignment of rights of property on cultural values of each Party according to rules of international law and national legal systems of the states of the Parties.

Article 6

The parties promote mutual access to the state library, archival and museum stocks of the states of the Parties in the cultural, scientific and educational purposes.

Article 7

The parties independently incur expenses which will arise during the course of performance them this agreement, within the means provided by national legal systems of the states of the Parties if in each case other procedure is not approved.

Article 8

Changes and additions which are drawn up by the separate protocols which are its integral parts as agreed by the parties can be made to this agreement.

This agreement does not mention obligations of the Parties following from other international treaties which participants they are.

Article 9

In case of disagreements in case of interpretation or application of provisions of this agreement of the Party will solve them by negotiations or consultations.

Article 10

This agreement becomes effective from the date of receipt of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

This agreement is signed for a period of five years and will be prolonged for the subsequent five-year periods if one of the Parties not later than six months before the expiration of the next term, does not send to other Party the written notice of the intention to stop its action.

In this case this agreement will stop the action in six months after receipt of one of the Parties of the adequate written notice of other Party.

Cancellation of this agreement does not affect implementation of the programs begun during its action if other is not stipulated by the Parties.

It is made in Dushanbe on September 13, 2007 in two authentic copies, everyone in the Tajik, Kazakh and Russian languages, and all texts are equally authoritative. In case of disputes over interpretation of provisions of this agreement, the Parties will be guided by the text in Russian.
