The agreement on cooperation in the field of advanced training and occupational retraining of specialists of the states of members of the Commonwealth of Independent States

The State Parties of this agreement on behalf of the governments which are hereinafter referred to as with the Parties

in view of provisions of the Agreement on cooperation in the field of education of May 15, 1992, Agreements on cooperation on forming of single (general) educational space of the Commonwealth of Independent States of January 17, 1997, the Agreement on cooperation in the field of dissemination of knowledge and education of adults of January 17, 1997, the Agreement on humanitarian state cooperation - members of the Commonwealth of Independent States of August 26, 2005,

considering the increasing labor migration of gosudarstvuchastnik of the Commonwealth of Independent States requiring adaptation of workers in places of their accommodation

aiming at acceleration of technological reforming of economy of the Parties, providing them with qualified specialists, agreed as follows:

Article 1

For the purposes of this agreement the used concepts mean the following:

"advanced training of specialists" - implementation of the additional professional educational programs directed to expansion, deepening and enhancement of earlier acquired professional knowledge, skills lasting at least two complete educational weeks, or 72 class periods of school hours which are coming to the end with final assessment;

"occupational retraining of specialists" - implementation of additional professional educational programs lasting at least two complete semester, or 1000 class periods of school hours which are not leading to change of earlier reached education level and coming to the end with final assessment and assignment of new professional qualification.

Article 2

The parties take the measures for enhancement of regulatory framework, and also quality control of educational activities including licensing of the educational institutions providing advanced training and occupational retraining of specialists, certification and the state accreditation of the educational institutions providing occupational retraining of specialists.

Article 3

Each Party takes document forms of the state sample about occupational retraining of specialists, and also measures for recognition of documents of the state sample on occupational retraining of the specialists issued by accredited educational institutions of the Parties in the specified forms.

Article 4

Each Party determines the authorized body (bodies) responsible for recognition of documents of the state sample on occupational retraining of specialists, and also for provision to other Parties of information on system of advanced training and occupational retraining of specialists according to the legislation of this Party.

Article 5

Each Party provides to the citizens of other Parties who are constantly living on its territories, the equal rights with citizens of the specified Party to advanced training and occupational retraining. The procedure for advanced training and occupational retraining of citizens of other Parties which are not living constantly in the territory of the host party is established by this Party.

Article 6

The parties promote development of direct connections and experience exchange of work between the educational institutions of the Parties providing services in the field of advanced training and occupational retraining of specialists by the organizations interested in receipt of such services and also promote exhibition activities and advertizing of educational services in the specified area.

Article 7

The parties according to the international obligations and the legislation of the Parties promote joint educational activities in the territory of the organizations providing services in the field of advanced training and occupational retraining of specialists with participation of educational institutions of other Parties.

Article 8

The matters of argument connected using and interpretation of provisions of this agreement, are permitted by consultations and negotiations between concerned parties.

Article 9

Provisions of this agreement do not affect the rights and obligations of the Parties following from other international treaties which participants they are.

Article 10

This agreement becomes effective from the date of receipt by depositary of the third written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force. For the Parties which performed interstate procedures later this agreement becomes effective from date of delivery of the relevant documents to depositary.

Article 11

This agreement is open for accession to it of other states recognizing its provisions by transfer to depositary of documents on accession. For the joining state this agreement becomes effective from the date of obtaining by depositary of the last written notice of the Parties of consent to such accession.

Article 12

Changes which are drawn up by the protocol which is becoming effective according to Article 10 of this agreement can be made to this agreement.

Article 13

This agreement is signed sine die.

Any Party can leave this agreement, having sent the written notice of it to depositary not later than six months to exit.

Expiration of this agreement, and also the termination of its action of the either party does not affect accomplishment by the Parties of the rights and obligations on the projects begun during action of this agreement and not completed for date of the termination of its action.

It is made in the city of Yalta on May 25, 2007 in one authentic copy in Russian. The authentic copy is stored in Executive committee of the Commonwealth of Independent States which will send to each state which signed this agreement, its verified copy.
