The contract between the Government of the Republic of Belarus and the Government of the Republic of Lithuania on cooperation in the field of the prevention of catastrophic crashes, natural disasters and major accidents, and also liquidations of their effects

The government of the Republic of Belarus and the Government of the Republic of Lithuania which are hereinafter referred to as by Contracting Parties

in view of the Contract between the Republic of Belarus and the Republic of Lithuania on neighborliness and cooperation signed on February 6, 1995, the Convention on cross-border impact of industrial accidents signed on March 17, 1992 in Helsinki

considering the organization activity of the United Nations and other international organizations performed by them in the field of the prevention of catastrophic crashes, natural disasters and major accidents and also liquidations of their effects, provision of the international treaties accepted with assistance of the above-mentioned international organizations and connected with subject of this agreement

recognizing threat of emergence of catastrophic crashes, natural disasters and major accidents,

being convinced of need of cooperation of Contracting Parties in the field of the prevention of catastrophic crashes, natural disasters and major accidents, and also liquidations of their effects,

agreed as follows:

Article 1. Terms

The terms used in this Agreement have the following value:

1. The requesting Party - the Contracting Party which authorized body asks for the help authorized body of other Contracting Party.

2. The providing Party - the Contracting Party which authorized body carries out request about assistance of other Contracting Party.

3. Catastrophic crashes and major accidents (further - catastrophic crashes) the effects caused by forces majeure, and also activities or negligence of the person, constituting big danger and (or) doing harm to life and health of the person, property and the environment.

4. Rescue operations - actions which purpose is protection of life and human health and mitigation of the harm to the environment and property done by catastrophic crashes.

5. Equipment - technical and the vehicles intended for assistance including materials, equipment of rescue group, necessary for their operation, guard dogs and things of private use of participants of rescue groups.

6. The materials intended for assistance - necessities, drugs and medicines, including drugs and medicines as a part of which there are narcotic and psychotropic substances used for the purpose of mitigation of the effects caused by catastrophic crashes and intended for non-paid distribution among injured catastrophic crashes.

7. Rescue groups - the prepared and equipped groups of persons of the Providing Party, except for divisions of armed forces, the states of the Requesting Party directed for assistance to the territory.

8. The expert - the specialist in certain area of the Providing Party directed for assistance to the territory of the state of the Requesting Party.

Article 2. Subject of the agreement

1. This Agreement regulates procedure for rendering the voluntary help in case of catastrophic crashes, natural disasters and major accidents, conditions of assistance and other forms of cooperation.

2. Treat other forms of cooperation:

2.1. forecasting, prevention, research and assessment of effects of catastrophic crashes;

2.2. rendering mutual aid in equipment of rescue divisions the equipment and equipment;

2.3. planning and conducting joint exercises according to the prevention and liquidation of catastrophic crashes;

2.4. experience exchange in the organization of preparation of the population for actions in the conditions of catastrophic crashes;

2.5. organization and holding joint conferences, seminars, working meetings;

2.6. collaborative planning, development and implementation of research projects, exchange of scientific and technical literature and results of research works, and also technologies in the field of the prevention of catastrophic crashes and liquidation of their effects;

2.7. training of specialists in educational institutions of the state of other Contracting Party, exchange of students, trainees, teachers, scientists and specialists;

2.8. exchange of information, regulating documents, periodic printing editions, methodical and other literature, video and photographic materials;

2.9. consultations between the authorized bodies and other organizations realizing this Agreement.

3. Authorized bodies can use other forms of cooperation, and also sign necessary agreements and create working groups for the purpose of implementation of this agreement according to the legislation of the states of Contracting Parties.

4. The provisions of this agreement regulating assistance are applied also during joint exercises.

Article 3. Authorized bodies

1. Contracting parties for implementation of this agreement determine authorized bodies:

from the Republic of Belarus:

Ministry of Emergency Situations;

from the Republic of Lithuania:

Ministry of Internal Affairs.

2. Authorized bodies of Contracting Parties notify each other on other bodies authorized on implementation of cooperation according to this Agreement and accomplishment of other tasks and also on changes of competence of these bodies.

Article 4. Request about assistance

1. The authorized body of the Requesting Party sends inquiry for assistance in oral or written form to authorized body of the Providing Party. The oral request shall be confirmed without delay in writing.

2. In request about assistance the form, amounts and terms of the required help are specified.

3. The authorized body of the Providing Party without delay organizes assistance and informs authorized body of the Requesting Party on opportunities, conditions and amount of assistance.

Article 5. Assistance

1. Assistance can be performed by the direction of rescue groups and (or) experts, delivery of equipment and the materials intended for assistance and provision of information.

2. Carrying out rescue operations is coordinated by authorized body of the Requesting Party.

3. Management of rescue operations on site of catastrophic crashes is performed of authorized body of the Requesting Party.

4. The authorized body of the Requesting Party informs heads of rescue groups and (or) experts on changes of situation on site of catastrophic crashes and if necessary makes available to these rescue groups and (or) experts of translators, renders them other services and allocates funds.

5. Equipment of rescue groups shall be sufficient for carrying out rescue operations on site of catastrophic crash within 72 hours. Upon termination of equipment inventories the Requesting Party provides the specified groups with necessary means for their further work.

6. The requesting Party provides free delivery and non-paid distribution between injured with catastrophic crash of the materials intended for assistance.
