The government of the Republic of Kazakhstan and the Government of the Republic of Latvia which further are referred to as the Party
aiming to develop and strengthen mutually beneficial cooperation in the field of information technologies within the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Latvia about economic and sci-tech cooperation, made in the city of Astana on October 8, 2004,
considering that the Republic of Latvia became the State Party of the European Union,
in view of the fact that the cooperation in the field of information technologies and in the spheres which are of mutual interest by means of exchange of the ideas, information, skills and experience will be profitable to both Parties
considering the need for more complete capacity utilization of information technologies and opportunities of the application programs represented by information technologies
agreed as follows:
The parties, according to national legal systems of the states of the Parties and international treaties which participants are the states of the Parties promote development of cooperation in the field of information technologies.
The cooperation in the field of information technologies is performed by means of:
developments of information technologies and information systems;
project developments within realization of electronic control;
assistance in standardization of information and technological systems, products and services;
promotions of investments into areas of information technologies of both countries;
assistance to creation of joint businesses in the field of information technologies through projects in both countries or in the third countries, on mutually acceptable conditions;
development assistances of national legal systems of the states of the Parties on the information technologies and application programs represented by information technologies;
holding joint seminars, conferences, forums and exhibitions, experience exchange of specialists in application and development of the information technologies performed on the basis of the direct agreements signed by the organizations of both Parties;
other questions under mutual approval.
For the purpose of assistance to development of work in the field of information technologies, cooperation increase and development of new technologies, the Parties encourage the interested bodies, the organizations and the companies of the states of the Parties to collateral actions on development of closer interaction and exchange of information in information technologies and, whenever possible, to cooperation in accomplishment of specific programs and projects.
The parties provide opportunity to specialists of the states of the Parties to take collateral actions for the purpose of application of the experience gained by the Republic of Kazakhstan and the Republic of Latvia in the field of promotion and development of information technology solutions and applications.
Competent authorities within this agreement are:
for the Kazakhstan side - informatization and communication Agency of the Republic of Kazakhstan;
for the Latvian side - the Secretariat of the Minister of special orders for electronic control of the Republic of Latvia.
In case of transfer of function of competent authorities to other bodies or changes of official names of competent authorities of the Party without delay notify on this each other through diplomatic channels.
Working languages for joint operation of the Parties - Russian and English.
Before joint operation of competent authorities of the Party agree about what working language will be used.
In case of disagreements concerning application or interpretation of provisions of this agreement of the Party resolve them by negotiations.
By mutual consent of the Parties changes and additions which are drawn up by the separate protocols which are integral parts of this agreement, and becoming effective according to the procedure, established in Article 9 of this agreement can be made to this agreement.
The agreement becomes effective from the date of receipt of the last written notice through diplomatic channels confirming accomplishment of the corresponding interstate procedures by the Parties.
The agreement is signed for a period of five years and automatically prolonged for the subsequent five-year periods if one of the Parties not later than six months before the expiration of the corresponding five-year period does not send the written notice to other Party about the intention to stop its action.
Cancellation of the Agreement does not affect program implementation and the projects begun during its action if only the Parties do not agree about the return.
Signed in the city of Astana on November 16, 2006 in two original copies, everyone in the Kazakh, Latvian and Russian languages, and all texts are equally authoritative.
