based on the Agreement on the Customs union of January 20, 1995, the Lease agreement of the Baikonur complex of December 10, 1994, the Agreement on the status of the city of "Baikonur" of December 23, 1995;
wishing to provide favorable conditions for functioning of the Baikonur complex for its lease;
recognizing need of simplification of customs procedures concerning the goods imported from the Russian Federation on the Baikonur complex and which are taken out from the Baikonur complex to the Russian Federation
agreed as follows:
In this agreement terms in the following values are used:
"goods for accomplishment of space programs" missile and space equipment, technical, processing equipment, components of rocket fuel, fuels and lubricants and other equipment necessary for ensuring accomplishment of space programs;
"other goods" - the equipment, fuel and other materials necessary for ensuring functioning of the Baikonur complex occurring from customs area of the Russian Federation or issued in free circulation in this territory, except for excise goods.
Action of this agreement extends to goods for accomplishment of space programs and other goods imported from the Russian Federation on the Baikonur complex without right to sell and use in other purposes, and also on the Russian goods which are taken out to the Russian Federation from the Baikonur complex.
Goods for accomplishment of space programs are subject to customs clearance and control by customs authorities of the Russian Federation and customs authorities of the Republic of Kazakhstan without provision of licenses, collection of customs duties, taxes and fees on customs clearance, and also without obligatory goods placement on warehouses of temporary storage and declaring by submission of cargo customs declarations.
Customs examination is made for accomplishment of space programs in exceptional cases when there are good causes to believe that the specific batch moves to violation of the customs legislation corresponding the Russian Federation or the Republic of Kazakhstan. At the same time customs goods inspection, being under seals of the customer representative (military acceptance) and Quality Department, and also under seals of the companies and their Quality Department is performed under approval of security services (mode) of the companies of suppliers and/or specialists of the Baikonur spaceport in the rooms which are specially adapted for these purposes.
Other goods are subject to customs clearance and customs control by customs authorities of the Russian Federation and customs authorities of the Republic of Kazakhstan without collection of customs duties, taxes and fees on customs clearance, and also the obligatory placement on warehouses of temporary storage.
Declaration of goods is made for accomplishment of space programs by prestavleniye to customs authorities of commodity transport documents and invoices with obligatory specifying of the name of goods, from codes according to the Commodity Nomenclature of Foreign Economic Activity of the CIS and cost in US dollars.
In case of customs clearance of goods for accomplishment of space programs and other goods the written permission of the Russian space agency signed by the CEO of the Russian space agency or its deputies certified by seal of the Russian space agency is submitted to customs authorities of the Russian Federation and the Republic of Kazakhstan together with the above-stated documents. Samples of permission and impress of a seal of the Russian space agency are applied.
In case of customs clearance of goods for accomplishment of the space programs and other goods imported on Baikonur Cosmodrome for the benefit of the Ministry of Defence of the Russian Federation, the written permission signed by officials of the Ministry of Defence of the Russian Federation is submitted to customs authorities of the Russian Federation and the Republic of Kazakhstan together with the above-stated documents, authorized to issue permissions, certified by official stamp of the Ministry of Defence of the Russian Federation. The permission sample, the list of authorized officers of the Ministry of Defence of the Russian Federation, specimen signatures and seals are applied.
After carrying out customs clearance and control of other goods exported from the Russian Federation on the Baikonur complex in the documents specified in Article 5 of this agreement, the official of customs authority of the Russian Federation puts down stamp "Release is resolved" and if the goods of foreign origin are issued for free circulation on customs area of the Russian Federation, the entry confirming the Russian status of goods, the following content is made - "The goods are issued for free circulation in the territory of the Russian Federation which is certified by personal number seal of the specified official.
The specified record is considered by customs authority of the Republic of Kazakhstan in case of customs clearance of the goods imported from the Russian Federation on the Baikonur complex.
Customs authorities of the Russian Federation and customs authorities of the Republic of Kazakhstan perform interaction when carrying out customs control in the territory of the Baikonur complex, and also control of target use of other goods imported on the Baikonur complex.
Functions of customs authority of the Russian Federation in the territory of the Baikonur complex are performed by the staff of Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan.
The number of the staff of Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan who are on the Baikonur complex is determined by Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan in coordination with Customs committee of the Ministry of Finance of the Republic of Kazakhstan.
The customs clearance of the goods which are not intended for productive or other business activity and currencies is made according to the Protocol on the simplified procedure for customs clearance of the goods which are not intended for productive and other business activity, and the currency moved with physical persons through customs borders of gosudarstvuchastnik of the Customs union of January 22, 1998.
