RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

of December 12, 2007 No. 1729

About approval of the Regulations on procedure and conditions of provision of one of additional day, free from work, in week

(as amended on 05-09-2012)

According to part three of Article 265 of the Labor code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure and conditions of provision of one of additional day, free from work, in week.

2. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of May 27, 1997 No. 593 "About approval of the Regulations on procedure for provision and payment of day, free from work, in week to mothers who are bringing up three and more children or the handicapped child aged up to 16 years and also the lonely mothers having two and more children of the same age" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1997, No. 16, the Art. 591);

the resolution of Council of Ministers of the Republic of Belarus of March 2, 1998 No. 318 "About modification and amendments in the resolution of Council of Ministers of the Republic of Belarus of May 27, 1997 No. 593" (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1998, No. 6, the Art. 148);

Item 44 of the resolution of Council of Ministers of the Republic of Belarus of February 28, 2002 No. 288 "About modification and amendments in some orders of the Government of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2002, No. 32, 5/10103).

3. This resolution becomes effective since January 26, 2008.

Regulations on procedure and conditions of provision of one of additional day, free from work, in week

1. This Provision determines procedure and conditions of provision of one of additional day, free from work, in week (further - the day off) mothers (the father, the guardian, the custodian) (further - the applicant) who is bringing up three and more children aged up to 16 years (the handicapped child - aged up to 18 years).

2. The day off is provided to the applicant in the presence of the following conditions:

in family of the applicant at least three children aged up to 16 years live and are brought up (the handicapped child - aged up to 18 years);

the applicant is engaged at work every day during five-day (six-day) business week with the normal duration of working hours equal to the complete or reduced its regulation established in Articles 112-114 of the Labor code of the Republic of Belarus. The day off is provided to the applicant with the summed-up accounting of working hours that week in which he is engaged five or six working days with duration of working hours in week at least the Republic of Belarus established in Articles 112-114 of the Labor code;

other parent in complete family is busy * or has training in clinical internship in presentia, receives disability pension or monthly insurance payment according to the legislation on compulsory insurance from labor accidents and occupational diseases.

* For the purposes of this provision busy are understood as the citizens specified in article 2 of the Law of the Republic of Belarus of June 15, 2006 "About employment of the population of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2006, No. 94, 2/1222).

3. In the presence of the conditions provided in Item of 2 this provision, the day off is not provided if the public holidays and holidays established and announced by the President of the Republic of Belarus non-working, and also days of temporary disability of the applicant, including in connection with child care fall on business week.

4. The day off is provided by the employer according to the written application. Are enclosed to the application:

copies of certificates of birth of children;

certificate of the residence and family composition.

Are in addition represented:

for complete families - the reference (services) of other parent with indication of data on provision (failure to provide) to it the day off or other documents, confirmatory that other parent is busy or has training in clinical internship in presentia, receives disability pension or monthly insurance payment according to the legislation on compulsory insurance from labor accidents and occupational diseases;

for incomplete families - the copy of the certificate on annulment of marriage or the copy of the judgment about annulment of marriage or other document confirming category of incomplete family;

for the families which are bringing up the handicapped child aged up to 18 years - the copy of the certificate of the handicapped child;

for persons designated by guardians (custodians) - the copy of the decision of local executive and administrative organ on establishment of guardianship (guardianship) over minors and appointment of a guardian (custodian).

5. Provision of the day off stops since the week following week of loss of the bases on which the day off was provided.

The bases attracting the termination of provision of the day off are:

execution to the senior from three children of 16 years;

execution to the handicapped child of 18 years or refusal in recognition by his disabled person in case of re-examination;

the room of child(children), handicapped child aged up to 18 years in child care residential care facility, organization of education on the round-the-clock stay or other changes in family influencing the applicant's right to provision of the day off;

the change of the mode of working hours which is not corresponding to the conditions established Item in paragraph three 2 this provision.

6. The days off can be used by one of parents or are divided between them at their discretion.

In case of separation of the days off between parents each of them submits the necessary documents provided in item 4 of this provision in the place of the work.

7. The day off is provided in the day of the week chosen by the applicant in coordination with the employer.

Provision of the day off is drawn up by the order (order) of the employer which is issued within 3 working days from the date of filing of application for any period of calendar year determined by the applicant in coordination with the employer. In the order the chosen day off of week is specified.

When accounting working hours provision of the day off is noted as unfinished working hours according to Article 133 of the Labor code of the Republic of Belarus.
